Il beneficiario di assicurazione sulla vita per il caso di morte
L’elaborato assume in esame la figura del beneficiario di assicurazione sulla vita, per il caso di morte del contraente-assicurato.
Premessi brevi cenni sul contratto di assicurazione sulla vita in generale, l’indagine si sofferma, anzitutto, sull’assicurazione sulla vita a favore di un terzo, disciplinata dagli artt. 1920 ss. cod. civ., la quale, nell’impostazione del Codice civile del 1942, si inquadra, a pieno titolo, nel più ampio genus del contratto a favore di terzi, la cui disciplina è racchiusa negli artt. 1411 ss. cod. civ.; ne discende, quale naturale corollario, che, per il solo effetto della designazione, il terzo acquisti ipso iure, immediatamente, e senza necessità di accettazione, il diritto all’indennizzo assicurativo.
Dopo aver approfondito i diritti, e gli eventuali oneri, od obblighi, del beneficiario, l’analisi viene concentrata sulla designazione del beneficiario di assicurazione sulla vita.
Dapprima, vengono esaminati la natura, i caratteri e le modalità della designazione; successivamente, l’attenzione viene fermata sulle designazioni così dette generiche e, in particolare, sull’evoluzione della giurisprudenza in ordine alla designazione, da parte del contraente, dei proprî eredi.
Diviene oggetto di studio, poi, la revoca della designazione del beneficiario di assicurazione sulla vita; una volta analizzatine la natura, i caratteri e le modalità, l’indagine si concentra sulla revoca testamentaria e, specificamente, sulle possibili interferenze fra l’istituzione ereditaria testamentaria e la designazione contrattuale degli “eredi legittimi” dell’assicurato.
Lo studio della revoca della designazione si conclude con l’approfondimento dei casi di irrevocabilità del beneficio, avuto peculiare riguardo alla rinunzia al potere di revoca, e con la disamina delle ipotesi di decadenza dal beneficio stesso.
Vengono esaminati, infine, la ratio e l’àmbito applicativo del divieto di azioni esecutive, e cautelari, sulle somme dovute dall’assicuratore, anche con riferimento agli istituti del fallimento e della liquidazione giudiziale, nonché con riferimento alle polizze così dette linked.
In conclusione, vengono svolte alcune considerazioni intorno alle azioni sui premî pagati dal contraente, ovverosia intorno all’azione revocatoria degli atti compiuti in pregiudizio dei creditori, nonché alla collazione, all’imputazione, e alla riduzione, delle donazioni.The paper examines the figure of the beneficiary of life insurance, for the case of the death of the contractor-insured.
After briefly discussing the life insurance contract in general, the survey turns first of all to life insurance for the benefit of a third party, governed by articles 1920 ff. of the Civil code, which, in the approach of the Civil code of 1942, fits, in its own right, into the broader genus of the contract in favor of a third party, the regulation of which is encapsulated in articles 1411 ff. of the Civil code; it follows, as a natural corollary, that, for the sole effect of the designation, the third party acquires ipso iure, immediately, and without the need for acceptance, the right to insurance indemnity.
After delving into the rights, and any burdens, or obligations, of the beneficiary, the analysis focuses on the beneficiary designation of life insurance.
At first, the nature, characters and manner of designation are examined; then, attention is stopped on so-called generic designations and, in particular, on the development of case law regarding the designation by the contractor of his or her heirs.
Subsequently, the revocation of life insurance beneficiary designation becomes the subject of study; once the nature, characters and modalities of the revocation of designation are analyzed, the investigation focuses on testamentary revocation and, specifically, on the possible interferences between testamentary inheritance institution and the contractual designation of the insured’s “legal heirs”.
The study of revocation of designation concludes with an in-depth study of the cases of irrevocability of the benefit, having special regard to the waiver of the power of revocation, and an examination of the cases of forfeiture of the benefit itself.
Finally, the ratio and scope of the prohibition of enforcement, and precautionary, actions on sums owed by the insurer are examined, including with reference to the institutions of bankruptcy and judicial liquidation, as well as so-called linked policies.
In conclusion, some considerations are made around actions on the premiums paid by the contractor, that is, around the action to revoke acts done to the detriment of creditors, as well as the collation, imputation, and reduction, of donations
Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
