    In this article I try to show some problems of the interpretation of civil disobedience as a practice that aims to maintain democratic principles against discriminative legal patterns or oligarchic forces. I will present two doctrines, the Rawlsian (followed by Habermas) and the one proposed recently by supporters of a radical constitutional change through the exercise of “constituent power”. The Rawlsian account a) offers a too stringent model of justification of this type of practice and b) does not recognize the plurality of subjects to which civil disobedience appeal. The supporters of radical constitutional change fall into a form of heterogony of ends. They reject liberal accounts of separation of power and pride popular control of judiciary power. But thus, the possibility of escaping sanctions for those who practice civil disobedience is dramatically reduced. Moreover it increases the risk of concentration of power

    After a difficult and disputed drafting, on July 5, 2017, the Italian Parliament approved the Act n. 110/2017, which introduced the crime of torture in Italy The lack of will of Italian Parliament in promulgating the law, even though Strasbourg Court urged in several occasion to reform the law in order to avoid cases of insufficient sanctions in case of violation of art. 3 of the European Convention on Human Rights, can be explained through a redefinition of the model of legislative rationality: legislator might be considered rational when it enacts ambiguous legislative texts at the lowest electoral cost if it urged to do by the pressure of supranational jurisdictions. Finally, even though this act needs continuous intervention by the judges, who could adopt the role of substitute legislators (thus violating the legality principle), the norms enacted might be considered “ethically justified” since enhance legal remedies against torture. For, our redefinition of rational legislator does not imply a form of moral scepticism in public affairs

    In questo articolo, si argomenta che la Law of Peoples di John Rawls è uno strumento utile per affrontare il problema etico-giuridico della tassazione del capitale mobile delle multinazionali. In particolare si mostra come l'opera di Rawls1) parta dall’accettazione della pretesa dei singoli stati di esercitare i loro poteri di sovranità fiscale senza però produrre esternalità negative sugli stessi poteri attribuiti agli altri stati , 2) giustifichi la preferenza per affrontare problemi di giustizia globale di strumenti regolativi (una coordinata regolazione minima della tassazione sui redditi delle società multinazionali, e una istituzione di controllo e di risoluzione delle controversie analoga alla Organizzazione Mondiale del Commercio ) piuttosto che l’istituzione di una tassa a livello globale su risorse (come auspica Pogge) o sulla circolazione del capitale (come propone Brock) che dovrebbe poi finanziare le politiche di sviluppo dei paesi più pover

    En esta contribución intentaremos demonstrar tres tesis. 1. La noción de estructura básica es principalmente una herramienta teórica (al igual de la idea de un mercado ideal) que mira a determinar lo que las prácticas redistributivas tácitamente asumen: su mantenimiento en el tiempo, la obligación de cada uno de cooperar según las normas establecidas, y la posibilidad de que haya sanciones para los que no cooperan, al fin de mantener relaciones de reciprocidad estables entre miembros libres e iguales de la estructura. 2. Las críticas de Beitz, Buchanan, Pogge, a las que han seguido muchas otras, se sustentan en una lectura parcial de la obra de Rawls. Una lectura que no considera el desarrollo de su pensamiento, sobre todo el pasaje desde TJ a LP, y el cambio teórico que este ha conllevado. 3.     Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed.     “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.
