PERLUNYA LEMBAGA SITA EKSEKUSI PADA PENGADILAN HUBUNGAN INDUSTRIAL DI INDONESIA
Undang-Undang Nomor 2 Tahun 2004 tentang Penyelesaian Perselisihan Hubungan Industrial mengatur mengenai penyelesaian sengketa di dalam hubungan kerja antara pekerja dengan pengusaha, baik sengketa yang berupa perselisihan hak, perselisihan kepentingan, perselisihan pemutusan hubungan kerja, maupun perselisihan antar serikat pekerja di dalam satu perusahaan. Di dalam penyelesaian perselisihan hubungan industrial tersebut dibentuk Pengadilan Hubungan Industrial yang pada akhirnya akan memeriksa dan memutus sengketa perselisihan hubungan industrial tersebut, dan berdasarkan putusan tersebut akan dilaksanakan eksekusi atas putusan yang dijatuhkan. Yang menjadi permasalahan ialah bagaimana pelaksanaan eksekusi dalam Pengadilan Hubungan Industrial atas putusan yang telah mempunyai kekuatan hukum dan bagaimana perlunya didirikan lembaga sita eksekusi tersendiri diatur dalam Undang-undang tentang Penyelesaian Perselisihan Hubungan Industrial.Berdasarkan Pasal 57 Undang-Undang Nomor 2 Tahun 2004 tentang Penyelesaian Perselisihan Hubungan Industrial yang berbunyi bahwa hukum acara yang berlaku pada Pengadilan Hubungan Industrial adalah hukum acara perdata yang berlaku pada pengadilan pada lingkungan peradilan umum, kecuali diatur secara khusus dalam undang-undang ini. Artinya seluruh proses hukum beracara pada penyelesaian perselisihan hubungan industrial menggunakan proses beracara hukum acara perdata, termasuk aturan perihal pelaksanaan eksekusi

PERLINDUNGAN HUKUM PEKERJA TAMBANG GALIAN TANAH ILEGAL STUDI KASUS DI PARUNG PANJANG: Legal Protection For Illegal Soil Mining Workers In Parung Panjang
Illegal mining has become a complex phenomenon, involving low-income and poorly educated communities as mine workers. This practice poses high risks to workers, both in terms of occupational safety and environmental impact. The conducted study aims to examine the form of legal protection for workers in illegal soil excavation mining based on the applicable laws and regulations, particularly Law Number 13 of 2003 concerning Manpower. Additionally, the research problem in this case focuses on the protection of workers in illegal mining operations and the employer\u27s responsibility in the event of work-related accidents, such as the case of a miner\u27s death in Parung Panjang. The research employs a normative legal approach, supported by field studies to obtain empirical data. The findings and conclusions indicate that workers in illegal mining operations do not receive adequate protection. Cultural factors and the economic dependence of local communities exacerbate the situation, making it difficult to enforce legal regulations. The study recommends an active role of the government in supervising and regulating illegal mining operations, as well as the need for socialization on the importance of occupational safety and simplified licensing processes to provide better protection for workers
Perda DKI tentang Bangunan Gedung: Kedudukan Hukum Peraturan Daerah terhadap Peraturan Pemerintah dan Undang-undang
Pelaksanaan pembangunan nasional akan terwujud apabila dapat terwujud situasi dan kondisi yang tertib dalam penyelenggaraan Pemerintahan baik di pusat maupun daerah termasuk di tingkat propinsi dan daerah tingkat II kabupaten/kotamadya. Peraturan Daerah adalah yang dibentuk oleh dengan persetujuan bersama Kepala Daerah dan DPRD tingkat I maupun tingkat II. Sedangkan materi muatan Peraturan Daerah adalah seluruh materi muatan dalam rangka penyelenggaraan otonomi daerah dan tugas pembantuan, dan menampung kondisi khusus daerah serta penjabaran lebih lanjut Peraturan Perundang-undangan yang lebih tinggi. Peraturan Daerah terdiri atas: Peraturan Daerah Provinsi, yang berlaku di provinsi tersebut. Peraturan Daerah Provinsi dibentuk oleh DPRD Provinsi dengan persetujuan bersama, Peraturan Daerah Kabupaten/Kota, yang berlaku di kabupaten/kota tersebut. Peraturan Daerah Kabupaten/Kota dibentuk oleh DPRD Kabupaten/Kota dengan persetujuan bersama Gubernur/Bupati/Walikota. Peraturan Daerah Kabupaten/Kota tidak subordinat terhadap Peraturan Daerah Provinsi, Peraturan Daerah (Perda) merupakan bentuk peraturan perundang-undangan yang relatif baru. Sejak lahirnya Perda sebagai dasar hukum yang baru bagi penyelenggaraan pemerintahan di daerah, pembuatan Perda dalam konteks ekonomi daerah hendaknya ditujukan dalam kerangka melindungi dan memperluas ruang otonomi dan kebebasan masyarakat, membatasi kekuasaan (kewenangan dan intervensi) pemerintahan daerah dan pusat serta melindungi hak, menjamin kebebasan masyarakat daerah, melindungi dan membela kelompok yang lemah di daerah, menjamin partisipasi masyarakat daerah dalam proses pengambilan keputusan dan memfasilitasi perbaikan dan pengembangan kondisi politik dan sosial ekonomi masyarakat daerah. Menurut Pasal 143 UU No. 32 Tahun 2004, Peraturan Daerah adalah peraturan daerah provinsi dan peraturan daerah kotamadya/kabupaten yang dapat memuat sebagai berikut: Peraturan Daerah dapat memuat pembebanan biaya paksa penegakan hukum seluruhnya atau sebagian atas biaya pelanggar, Peraturan Daerah dapat memuat ancaman pidana kurungan paling lama 6 bulan atau denda sebanyak-banyaknya Rp 50.000.000 (lima puluh juta rupiah) dan Perda dapat memuat ancaman pidana atau denda lain sebagaimana dimaksud dalam Ayat (2), sesuai dengan yang diatur dalam peraturan perundang-undangan yang lain. Sanksi administratif dapat langsung diterapkan oleh Pemda, sedangkan sanksi pidana telah diatur penerapannya dalam KUHAP
Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
KEWENANGAN GUBERNUR DKI JAKARTA DALAM PENETAPAN UPAH MINIMUM PROVINSI BERDASARKAN PERMENAKER NO. 16 TAHUN 2024: Authority Governor Dki Jakarta In Establishing Provincial Minimum Wage Based On Manpower Minister Regulation Number 16 Of 2024
This study examines the role of the Governor of the Special Capital Region of Jakarta in determining the Provincial Minimum Wage (UMP) based on the Ministry of Manpower Regulation No. 16 of 2024. The background of this research is the wage policy dynamics in Jakarta, which often generate controversy, particularly the 2022 UMP determination by Governor Anies Baswedan, which caused tensions among the regional government, employers, and workers. The research problems focus on the UMP determination process by the governor and the governor’s role during the leadership periods of Joko Widodo, Basuki Tjahaja Purnama, and Anies Baswedan. The research method used is normative juridical, with a literature study approach on legislation and official documents, supported by interviews. The results show that the governor has a strategic authority in setting the UMP, integrating tripartite aspirations with local economic and social conditions. This process requires a balance between workers’ and employers’ interests, transparency, and compliance with national regulations. The study emphasizes the governor’s role as an accountable and fair decision-maker in setting the minimum wage and draws lessons from the 2022 case to strengthen governance mechanisms and UMP determination procedures in the future
Appropriate Similarity Measures for Author Cocitation Analysis
We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Dispelling the Myths Behind First-author Citation Counts
We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more
