Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Dispelling the Myths Behind First-author Citation Counts
We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. Remedios del regulador frente a la ilegibilidad de las cláusulas predispuestas en los contratos bancarios y financieros
Banks and financial institutions have been frequently using fine and illegible print in their contracts. The regulator has had to react to this bad practice. First, the Bank of Spain intervened, through its Circular 5/2010 on transparency of banking services and responsibility in the granting of credit. Later, the national legislator also acted, through Law 3/2014 amending the Consolidated Text on Consumers. This paper analyzes this regulation and the remedies it offers to avoid that the use of fine and illegible print in general conditions and predisposed clauses can negatively harm the clientele. Finally, it focuses on the principle of advertising integration of the contract, defending the expulsion from the contractual document of those clauses not negotiated by the parties that include advertising content in small and illegible print that contradicts the main message.Las entidades bancarias y financieras vienen utilizando frecuentemente letra pequeña e ilegible en sus contratos. Ante esta mala práctica contractual ha tenido que reaccionar el regulador. Primero lo hizo el Banco de España, a través de su Circular 5/2010 sobre transparencia de los servicios bancarios y responsabilidad en la concesión de préstamos. Más tarde, intervino el legislador nacional, mediante la Ley 3/2014 de modificación del Texto Refundido de Consumidores. Este trabajo presta atención a esta normativa y a los remedios que contiene para evitar que el uso de letra pequeña e ilegible en condiciones generales y cláusulas predispuestas pueda perjudicar negativamente a la clientela. Finalmente, se centra en el principio de la integración publicitaria del contrato, defendiendo la expulsión del documento contractual de aquellas cláusulas no negociadas por las partes que incluyan contenidos publicitarios en letra pequeña e ilegible que contradigan el mensaje principal
Hacia una regulación general del uso lícito de la letra pequeña en la publicidad
The ilicit use of the fine print in the advertising basically consist of the use of an eyecatching message (both for its content and for its presentation) that captures the attention of consumers, being said message substaintally nuanced or limited by another written in much smaller typographic character. It is a practice that is detrimental to the interest of both consumers and competitors. This explains that said practice that is detrimental to the interests of both consumers and competitors. This explains that said practice can be considered as an act of deception (articles 5 and 7) and of violation of norms (article 15) according to the Unfair Competition Law. On the basis of some experience in comparative law, of the sectorial regulation that exists on this matter in our Law relative of the banking and financial sector, and of the rule 3 of the Advertising Self_Control Code, this paper tries to propose some rules to the elaboration of a general regulation of the lawful use of small print in the advertising. This general regulation seems convenient to avoid having to appli extensively to the advertising sector the requirement of article 80 of the Consolidated Test to the Consumers, Which requires that the size of letter used in the contracts is not less than 1,5 in any case millimetres in height.El uso ilícito de la letra pequeña en la publicidad consiste básicamente en la utilización de un mensaje llamativo (tanto por su contenido como por su presentación) que capte la atención de los destinatarios, siendo dicho mensaje matizado o limitado de forma sustancial por otro redactado en caracteres tipográficos de mucho menor tamaño. Se trata de una práctica perjudicial para los intereses tando de los consumidores como de los competidores. Esto explica que tenga encaje en los actos de engaño (arts. 5 y 7) y de violación de normas (art. 15) de la Ley de Competencia Desleal. Sobre la base de alguna experiencia de Derecho comparado, de la regulación sectorial que sobre esta materia existe en nuestro Derecho en el ámbito bancario y financiero y d ela norma 3 del Código de Autocontrol de la Publicidad, este trabajo persigue proponer algunas reglas para la elaboración de una regulación general del uso lícito de la letra pequeña en la publicidad. Esta regulación general parace conveniente para evitar tener que aplicar extensivamente al ámbito publicitario la exigencia del artículo 80 del Texto Refundido de Consumidores, que exige que el tamaño de la letra utilizada en los contratos no sea inferior en ningún caso a 1,5 milimetros de altura
Declaraciones ambientales, competencia desleal y patrones en la jurisprudencia comparada: A propósito del blanqueo ecológico o greenwashing
The growing concern for the preservation of the the Sustainable Development Goals (SDGs) has acquired significant importance in recent years. This explains the increase in the number of environmental claims made by companies in the market. In this context, greenwashing practices, which are the subject of this paper, have developed. This work answers affirmatively to the question of whether the current legislation on unfair competition contains adequate instruments to combat this type of conduct. In addition, the new harmonizing standards that the European Union is proposing to adopt in this area are examined. Finally, attention is paid to comparative case law on this issue, drawing some interesting conclusions about the way in which different jurisdictions have been dealing with this interesting problem.La creciente preocupación por los Objetivos de Desarrollo Sostenible (ODS) ha adquirido una importancia significativa en los últimos años. Esto explica el incremento que han experimentado las declaraciones ambientales de las empresas en el mercado. En este contexto se desarrollan las prácticas de blanqueo ecológico o greenwashing sobre las que versa este trabajo. En él se responde afirmativamente a la cuestión de si la normativa vigente sobre competencia desleal contiene instrumentos adecuados para combatir este tipo de conductas. Además, se examinan las nuevas normas armonizadoras que propone aprobar la Unión Europea en este ámbito. Por último, se presta atención a la jurisprudencia comparada, extrayendo algunas conclusiones de interés acerca del modo en que las diferentes jurisdicciones vienen abordando esta problemática
