El derecho de marca en la liquidación de la sociedad conyugal
No full textThis investigation sought to analyze the legal nature of the trademark and how it should be considered by the judge before the development of a process of liquidation of the marital partnership, when one of the spouses has acquired or registered a trademark in the marriage. To achieve the objectives set, a bibliographic, explanatory and field research methodology was chosen. Having a mixed, qualitative and quantitative approach. Applying data collection techniques such as the survey and interviews, evidencing the need to carry out a reform of the Organic Code of the Social Economy of Knowledge, Creativity and Innovation, in order to establish the nature of the brand and the impossibility that it does not be taken as a good to be liquidated within a marital partition, but if the economic benefits derived from it, also when it has been acquired during the marriage, establishing rules that may govern intellectual property, as they have governed with the right to Author. Concluding that the brand is not part of the traditional classification of goods, so it is important to clearly state in the law its nature and the rules for its disposal, protection before the conjugal society.Esta investigación persiguió determinar la naturaleza jurídica de la marca y como debe ser considerada por parte del juez ante el desarrollo de un proceso de liquidación de la sociedad conyugal, cuando uno de los cónyuges ha adquirido o registrado alguna marca en el matrimonio. Para el logro de los objetivos planteados se escogió una metodología de investigación bibliográfica, explicativa y de campo. Teniendo un enfoque mixto, cualitativo y cuantitativo. Aplicando técnicas de recolección de datos como la encuesta y entrevistas, evidenciándose la necesidad de realizar una reforma al Código Orgánico de la Economía Social de los Conocimientos, Creatividad e Innovación, a fin de establecer la naturaleza de la marca y la imposibilidad que la misma no sea tomada como un bien a liquidar dentro de una partición conyugal, pero si los beneficios económicos derivados de la misma, también cuando ha sido adquirida durante el matrimonio, estableciéndose reglas que puedan establecerse en materia de propiedad intelectual, como han regido con el derecho de autor. Concluyendo que la marca no forma parte de la clasificación tradicional de los bienes, por lo que es importante señalar en la ley de forma clara su naturaleza y las reglas para su disposición, protección ante la sociedad conyugal
Going Beyond Counting First Authors in Author Co-citation Analysis

counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

Get PDF“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
Get PDFWe provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. La contradicción en la improcedencia de la adopción homoparental
Get PDFWith the approval of same-sex marriage, by sentence of the Constitutional Court No. 11-18-CN/19, a problem arises regarding the related rights inherent to the solemn pact between spouses. One of them is adoption, which is expressly defined for opposite-sex couples in the constitutional norm. This research seeks to analyze the inadmissibility and denial of access to adoption for same-sex couples on the requirement imposed by law to the applicants to be heterosexual, which generates a contradiction in Articles 67 and 68 of the Constitution, as well as in some articles of the Code of Childhood and Adolescence and the Civil Code. Throughout this research, the main aspects of same-sex parenting, the perspective of the child as a subject of rights, the theory of adoption as a false right, and the suitability of same-sex adopters were detailed. In addition, a conceptual framework with the most relevant terms was developed, and the legal and jurisprudential aspects were reviewed. The methodology used a predominantly qualitative approach based on a non-experimental, exploratory, descriptive, cross-sectional or transversal design. It is concluded that such a contradiction does exist to impose a moralistic criterion above the superior principles of the child. This criterion deviates from legal exegetics by conceiving adoption as a mere formality and not as an authentic right of minors to have parent figures that contribute to their holistic development.Con la aprobación del matrimonio igualitario, mediante sentencia de la Corte Constitucional N. 11-18-CN/19, surge un problema en cuanto a los derechos conexos propios del pacto solemne entre los cónyuges. Uno de ellos es la adopción, el cual está expresamente definido para parejas de diferente sexo en la norma constitucional. Esta investigación busca analizar la improcedencia y negativa del acceso a la figura de la adopción para familias homoparentales sobre el requisito que el derecho impone a los solicitantes, es decir, ser heterosexuales, lo cual genera una contradicción en los artículos 67 y 68 de la Constitución, así como de algunos artículos del Código de la Niñez y la Adolescencia y del Código Civil. A lo largo de esta investigación se detallaron aspectos resaltantes sobre la homoparentalidad, la perspectiva del niño como sujeto de derecho, la teoría de la adopción como un falso derecho y de la idoneidad de los adoptantes homoparentales; se desarrolló un marco conceptual con los términos más importantes; y se concluyó con un recorrido por los aspectos legales y jurisprudenciales. La metodología se fundamentó en un diseño no experimental, exploratorio descriptivo, transeccional o transversal, utilizado un enfoque predominantemente cualitativo. Se concluye que sí existe tal contradicción al para imponer un criterio moralista por encima de los principios superiores del niño, criterio que se aleja de la exegética jurídica al concebir la adopción como un mero trámite y no como un auténtico derecho de los menores a tener figuras parentales que contribuyan a su desarrollo holístico

No full textWe have done our best to complete the author checklist relating to the use of animals in the hut study. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
