PEMBAGIAN WARISAN MASYARAKAT MATRILINEAL DI DESA ANGKAES KABUPATEN MALAKA DALAM PERSPEKTIF HAM
Judul penelitian ini adalah “Pembagian Warisan Masyarakat Matrilineal di Desa Angkaes, Kabupaten Malaka dalam Perspektif Hak Asasi Manusia”. Pembagian warisan merupakan aspek penting dalam hukum waris yang terkait erat dengan sistem kekerabatan dan adat. Dalam masyarakat matrilineal, penerapan hukum waris menghadapi dinamika tersendiri, terutama terkait kesetaraan antara laki-laki dan perempuan sebagai ahli waris, sehingga perlu dikaji dari perspektif hak asasi manusia. Penelitian ini bertujuan untuk menganalisis proses pembagian warisan di masyarakat matrilineal Desa Angkaes dan mengkaji hubungan praktik pewarisan dengan prinsip-prinsip hak asasi manusia. Rumusan masalah meliputi bagaimana proses pembagian warisan dilaksanakan, kendala yang muncul, serta sejauh mana prinsip HAM terintegrasi dalam praktik tersebut. Metode penelitian yang digunakan adalah penelitian hukum empiris dengan pendekatan kualitatif, melalui wawancara, observasi, dan studi dokumentasi. Lokasi penelitian berada di Desa Angkaes, Kabupaten Malaka, Nusa Tenggara Timur, yang menganut sistem waris matrilineal. Hasil penelitian menunjukkan bahwa masyarakat matrilineal Desa Angkaes sebagian besar sudah memahami proses pembagian warisan. Dahulu, hak warisan lebih dominan diberikan kepada perempuan, namun saat ini laki-laki juga mulai memperoleh hak waris, meski tidak sepenuhnya, dengan prinsip kesetaraan dan keadilan. Hal ini menunjukkan adanya adaptasi sosial dalam praktik waris tradisional sesuai prinsip HAM. Kesimpulan penelitian ini menegaskan bahwa sistem waris matrilineal memberikan posisi kuat bagi perempuan sebagai ahli waris, namun perlunya peningkatan kesadaran terhadap hak laki-laki juga penting. Saran penelitian meliputi perlunya sosialisasi hukum waris dan penguatan kapasitas tokoh adat untuk mendukung keadilan dalam pembagian warisan bagi anak perempuan maupun laki-laki
FAKTOR PENYEBAB MASYARAKAT DI KELURAHAN MANULAI II KECAMATAN ALAK KOTA KUPANG TIDAK MEMBUAT PERJANJIAN PERKAWINAN
Telah dilakukan penelitian tentang faktor penyebab di Kelurahan Manulai II Kecamatan Alak Kota Kupang tidak membuat perjanjian perkawinan. Penelitian ini bertujuan untuk mengidentifikasi dan mengkaji pasangan nikah di Kelurahan Manulai II yang tidak membuat perjanjian perkawinan. Penelitian ini di awali dengan wawancara bebas Teknik wawancara dilakukan untuk menggali informasi atau data mengenai faktor penyebab masyaraka. Kemudian dilanjutkan dengan wawancara terstruktur yaitu peneliti membuat daftar pertanyaan yang telah disusun sebelumnya sehubungan dengan topik yang akan dibahas dalam bentuk kuisioner, lalu peneliti secara langsung mengamati perilaku subjek penelitian, dengan mengamati sekelompok atau seseorang dengan jangka waktu lama peneliti akan relative lama dan melakukan pendokumentasian berupa surat dan foto. Setelah dilakukan analisis terhadap 16 orang (suami/istri) dengan menjawab pertanyaan dari kuisioner dapat dikatakan bahwa untuk pola pengetahuan umum Masyarakat di Kelurahan Manulai II terbatas pada aspek normatif seperti usia dan hak/kewajiban, namun tidak menyentuh perlindungan hukum melalui perjanjian perkawinan. Sedangkan untuk Pola pikir Masyarakat di Kelurahan Manulai II masih konservatif dan tradisional dimana norma sosial dan budaya menjadi salah satu penghambat utama dalam penerimaan perjanjian perkawinan. Tetapi juga ada rasa saling percaya dan menganggap bahwa pernikah adalah sesuatu yang sacral. meskipun dari sisi legal istrumen ini sangat mendukung stabilitas dan kejelasan dalam rumah tangga.,dan akan tetapi ada tanda-tanda adaptasi pada aspek ekonomi dan tanggung jawab individual yang bisa dijadikan pintu masuk untuk edukasi hukum
Implementasi UU Nomor 23 Tahun 2004 Tentang Kekerasan Dalam Rumah Tangga Di Desa Ius Mollo Kabupaten Timor Tengah Selatan
This study aims to analyze the implementation of Law Number 23 of 2004 on the Elimination of Domestic Violence in Ius Mollo Village, South Central Timor Regency, with a particular focus on the role of customary leaders and village government in resolving domestic violence cases. This research employs an empirical legal research method with a field-based approach. The findings indicate that the resolution of domestic violence cases in Ius Mollo Village is predominantly carried out through customary law mechanisms, in which customary leaders act as mediators. Although customary law is considered effective in maintaining social harmony, its implementation faces several challenges, including weak enforcement of sanctions, limited coordination between customary leaders and village authorities, and low public awareness of the provisions of Law Number 23 of 2004. Therefore, stronger collaboration between customary institutions and village government, as well as the harmonization of customary law with national law, is necessary to enhance legal protection for victims of domestic violenc
STRATEGI PENANGGULANGAN PENYEBARAN VIDEO ASUSILA DI MEDIA DIGITAL DITINJAU DARI UU ITE HUKUM DAN TEKNOLOGI
Penyebaran video asusila adalah tindak kejahatan yang serius dan cukup memprihatinkan serta membutuhkan tindakan nyata dari penegak hukum dan juga masyarakat secara umum. Penelitian ini bertujuan untuk mengetahui strategi penanggulangan penyebaran video asusila dimedia digital dtinjau dari UU ITE hukum dan teknologi. Metode yang digunakan adalah pendekatan kualitatif dengan analisis deskriptif. Data dikumpulkan melalui studi literatur, wawancara dengan ahli hukum, dan pengamatan terhadap praktik di lapangan. Hasil penelitian menunjukkan bahwa meskipun terdapat peraturan yang mengatur terkait sanksi kejahatan penyebaran video asusila, masih banyak ditemukan kejahatan penyebaran video asusila yang dilakukan oleh masyarakat. Kurangnya pemahaman dan pengetahuan hukum serta bimbingan menjadi faktor penyebab tingginya penyebaran video asusila di media digital. Penelitian ini merekomendasikan perlunya penguatan penegakkan hukum terkait pornografi dan pentingnya memberikan literasi digital kepada masyarakat mengenai penggunaan media digital secara tepat dan positif, agar lebih bijak dalam menggunakan media digital serta memperkuat pembimbingan dan sosialisasi terkait bahaya dan sanksi bagi pelaku penyebaran video asusila. Dengan langkah tersebut diharapkan penyebaran video asusila di media digital dapat teratasi dengan baik dan memberikan kesadaran kepada masyarakat terkait sanksi bagi pelaku penyebaran video asusila
MAKNA KOIN FATIN (UANG PERAK) DALAM PERKAWINAN BAGI MASYARAKAT ADAT TIMOR DI DESA NUNUHKNITI
Traditional marriage holds a central position in Timorese indigenous society, with sacredsymbols such as fatin coins possessing profound legal and social significance. This studyaims to understand the legal significance of fatin coins in Timorese indigenous marriagesin Nunuhkniti Village, Fautmolo District, South Central Timor Regency—including theirposition within the customary legal structure, the ritual procedures, and the values theyembody. A qualitative-juridical approach was used, collecting data through in-depthinterviews with traditional leaders and the bride and groom, as well as analysis oftraditional documents and manuscripts. The analysis was conducted descriptively andqualitatively to depict social and legal realities holistically. The results show that fatincoins symbolize the social and spiritual legitimacy of marriage and serve as a sacredagreement between families. Furthermore, fatin coins play a role in resolving disputes,strengthening inter-ethnic relations, and maintaining social stability. Althoughmodernization brings social change, the people of Nunuhkniti Village continue tomaintain the use of fatin coins as a cultural identity and an instrument of customary law.Thus, the Fatin coin not only holds traditional value but also serves as a key instrument inmaintaining the sustainability of customary law amidst current social dynamic
PERAN IBU TERKAIT PENDIDIKAN ANTIKORUPSI DALAM KELUARGA
The purpose of this study is to examine the role of mothers in anti-corruption education within the family environment. This research employs a qualitative method with a descriptive approach. The data sources consist of primary and secondary data. The respondents of this study were six housewives. Data were collected through interviews and observations. The data analysis techniques included data reduction, data presentation, and conclusion drawing, supported by data validity testing.
The findings indicate that mothers play a crucial role in shaping children’s integrity, particularly in instilling anti-corruption values within the family. This role is reflected in communicating honesty values, fostering care and empathy, encouraging independence, applying positive discipline, teaching responsibility, promoting hard work, and cultivating a simple lifestyle. Mothers act as the first and primary educators in the family by instilling these values through role modeling, open communication, age-appropriate task assignments, and educational correction of inappropriate behavior
Pelaksanaan Penggantian Pidana Denda Dengan Pidana Pelatihan Kerja Terhadap Anak Dalam Undang-Undang No. 11 Tahun 2012
Law Number 11 of 2012 on the Juvenile Criminal Justice System emphasizes a restorative justice approach in handling cases involving children in conflict with the law. One implementation of this principle is the substitution of fines with job training sanctions. This study aims to analyze the implementation of substituting fines with job training for children, as well as to examine its effectiveness and the obstacles encountered in its application. The research method employed is normative legal research with a statutory approach and case studies in several juvenile courts. The results indicate that the substitution of fines with job training constitutes a more humane and rehabilitative alternative, in line with the objectives of child development and rehabilitation. However, its implementation still faces various challenges, including limited training facilities, lack of coordination among institutions, and insufficient awareness among law enforcement officers regarding restorative justice principles. Therefore, it is necessary to strengthen derivative regulations, enhance human resource capacity, and improve inter-institutional synergy to ensure that the implementation of job training sanctions for children can be carried out optimally and in accordance with the spirit of Law Number 11 of 2012
Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
