Product liability is a form of civil law given by producers upon financial loss faced by consumers as the result of using products which are made or produced by the producers. The presumption of liability principle is the principle that is practiced by UUPK. Product liability principle which follows the strict liability principle is important because it gives protection to consumers who are in weak position especially in transactions. Applying strict liability principle in e-commerce transactions can give law protection for consumers in these transactions.

In section 1338 (1) KUHPerdata which states that the agreement of selling and buying voices is as law if agreement occurs. However, to decide the validity of such agreement, it should be measured by conditions stated in section 1320 KUHPerdata. Selling and buying voice in elections comply with conditions but it collides with law Number 10 year 2008 about legislative election section 84 part (1). Evading the objective condition in selling and buying voices will cause the agreement to be invalid

This phenomena provokes many legal problems for consumers which they have not enough bargaining power. Consequently, they have a weak position in business transaction. Crucially, The government should regulate the legal protection for consumer especially based on its actualization and urgency. Aim of this is to fulfill legal certainty which is needed both for business transaction and to protect consumer’s rights. Furthermore, the legal protection should be given in many aspects of law both simultaneous and comprehensive protection. This also should be implemented with international approach through legal institutions cooperation
