LA CONCILIAZIONE NEL DIRITTO DEL LAVORO: SPUNTI PER UN DIBATTITO
L’A., dopo aver brevemente analizzato le ragioni di politica del diritto che da sempre hanno
portato il legislatore a prediligere lo strumento conciliativo rispetto a quello arbitrale nel diritto
del lavoro, ripercorre l’evoluzione normativa della conciliazione dalla legge n. 533/1973
al d.lgs. n. 80/1998 (come modificato dal d.lgs. n. 387/1998). L’A. si sofferma, poi, sugli ultimi
interventi ordinamentali in materia di conciliazione analizzando, nell’ordine, il tentativo
obbligatorio di conciliazione nelle ipotesi di licenziamento per giustificato motivo oggettivo,
introdotto dalla legge n. 92/2012 e la “proposta” facoltativa di conciliazione, azionabile in
tutte le ipotesi di licenziamento, di cui all’art. 6, d.lgs. n. 23/2015. In particolare, rispetto a
quest’ultima ipotesi conciliativa se ne evidenziano le criticità, ma anche il possibile nuovo
utilizzo alla luce della sentenza della Corte cost. n. 194/2018

Il tipo contrattuale: autonomia e subordinazione dopo il Jobs Act
The paper analyzes the impact and the possible interpretation of the provisions of art. 2 of legislative decree n. 81 of 2015, that, repealing the discipline of project collaborations, has established that the regulation of subordinate employment is applicable to those collaborations which are personal, continuous and whose mode of execution are organized by the client with reference to the time and place of job. The Author examines the evolution of statutory law, doctrine and case law regarding the type of subordinate employment, which is the basis for the most recent reform, and then considers the different interpretations about the nature of the collaborations disciplined by the recent regulation. In his reconstruction, the Author supports the autonomous nature of the organized collaborations and highlights the importance of the role of collective bargaining in the implementation of the new statutory provision, which lead to a new centrality of the two original categories provided for by the Italian Civil Code in articles 2094 (subordinate employment) and 2222 (independent work)

Surface topology of Minibody by selective chemical modifications and mass spectrometry
The surface topology of the Minibody, a small de novo-designed beta-protein, has been probed by a strategy that combines selective chemical modification with a variety of reagents and mass spectrometric analysis of the modified fragments. Under appropriate conditions, the susceptibility of individual residues primarily depends on their surface accessibility so that their relative reactivities can be correlated with their position in the tertiary structure of the protein. Moreover, this approach provides information on interacting residues, since intramolecular interactions might greatly affect the reactivity of individual side chains by altering their pKa values. The results of this study indicate that, while overall the Minibody model is correct, the beta-sheet formed by the N- and C-terminal segments is most likely distorted. This is also in agreement with previous results that were obtained using a similar approach where mass spectrometry was used to identify Minibody fragments from limited proteolysis (Zappacosta F, Pessi A, Bianchi E, Venturini S, Sollazzo M, Tramontano A, Ma?ino G, Pucci P. 1996. Probing the tertiary structure of proteins by limited proteolysis and mass spectrometry: The case of Minibody. Protein Sci 5:802-813). The chemical modification approach, in combination with limited proteolysis procedures, can provide useful, albeit partial, structural information to complement simulation techniques. This is especially valuable when, as in the Minibody case, an NMR and/or X-ray structure cannot be obtained due to insufficient solubility of the molecule
