Going Beyond Counting First Authors in Author Co-citation Analysis
Get PDFThe present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

No full textΗ παρούσα διπλωματική εργασία πραγματεύεται τη μεταβίβαση απαιτήσεων από δάνεια και πιστώσεις του ν. 4354/2015 και τα ζητήματα που απασχόλησαν τη νομολογία με αφορμή τον νόμο αυτό. Εν μέσω της γενικότερης οικονομικής κρίσης που αντιμετώπιζε η Ελλάδα κατά τα προηγούμενα χρόνια, μείζον ζήτημα το οποίο απειλούσε σημαντικά το τραπεζικό σύστημα, αποτελούσαν τα «κόκκινα δάνεια», τα οποία συνιστούν την αφορμή για το νόμο 4354/2015. Πληθώρα οφειλετών αδυνατούσε να ανταποκριθεί στις δανειακές τους υποχρεώσεις προς τα τραπεζικά ιδρύματα, με αποτέλεσμα να διογκώνεται ραγδαία ο αριθμός των μη εξυπηρετούμενων οφειλών. Ο ν. 4354/2015 στόχευε στην αποσυμφόρηση του τραπεζικού συστήματος της χώρας μέσω της μεταβίβασης των μη εξυπηρετούμενων οφειλών σε Εταιρείες Απόκτησης, ή της απλής ανάθεσης τους σε Ειδικές Εταιρείες Διαχείρισης. Εν συνεχεία, με τροποποίηση που υπέστη ο νόμος, εξαλείφθηκε ο περιορισμός των μη εξυπηρετούμενων οφειλών, συμπεριλαμβάνοντας και τις οφειλές που εξυπηρετούνται. Έτσι ο ν. 4354/2015 εξελίχθηκε σε ένα σημαντικό εργαλείο – αρωγό για τη δημιουργία μιας πλήρους δευτερογενούς αγοράς απαιτήσεων από δάνεια και πιστώσεις. Την ανάλυση, του μηχανισμού αυτού που προσφέρει ο ν. 4354/2015 διερευνά η παρούσα εργασία, εμβαθύνοντας στα πεδία εφαρμογής του νόμου, στις ειδικότερες προϋποθέσεις του, στην προστασία που παρέχει προς τον οφειλέτη καθώς και στα δικονομικά ζητήματα που ανακύπτουν από την εφαρμογή του. Ταυτόχρονα, στη διπλωματική αυτή εργασία, για την σφαιρική κατανόηση του νόμου, πραγματοποιείται μια σύγκριση με συγγενείς θεσμούς, τέλος δε γίνεται αναφορά στις φορές που απασχόλησε τη νομολογία, με έμφαση στην πρόσφατη νομολογιακή συζήτηση αναφορικά με τις εταιρείες διαχείρισης του νόμου στο πλαίσιο της τιτλοποίησης του ν. 3156/2003 καθώς και τη διατραπεζική μεταβίβαση των απαιτήσεων με τον μηχανισμό του υπό εξέταση νόμου.The present thesis deals with the transfer of claims from loans and credits under Law 4354/2015 and the issues that have occupied jurisprudence in connection with this law. In the midst of the broader economic crisis faced by Greece in previous years, a major issue that significantly threatened the banking system was the "non-performing loans," which prompted the enactment of Law 4354/2015. A plethora of debtors was unable to meet their loan obligations to banks, resulting in a rapid increase in the number of non-performing loans. Law 4354/2015 aimed to relieve the congestion of the country's banking system by transferring non-performing loans to Acquisition Companies or simply assigning them to Special Management Companies. Subsequently, through an amendment to the law, the limitation of non-performing loans was eliminated, including those that are performing. Thus, Law 4354/2015 evolved into an important tool - ally for the creation of a comprehensive secondary market for claims from loans and credits. This thesis explores the analysis of the mechanism offered by Law 4354/2015, delving into the fields of its application, its specific conditions, the protection it provides to the debtor, and the procedural issues arising from its implementation. Simultaneously, in this thesis, for a comprehensive understanding of the law, a comparison is made with related institutions, and reference is made to instances where jurisprudence was involved, with emphasis on the recent legal discussion regarding the management companies of Law 3156/2003 in the context of securitization and the interbank transfer of claims under the mechanism of the law 4354/2015
