No full textEsta contribución proporciona un análisis de conjunto del nuevo Reglamento (UE) 2023/2854 de Datos, como instrumento que pretende establecer un marco para facilitar una asignación óptima de los datos en beneficio de la sociedad, garantizando a los usuarios de un producto conectado o servicio relacionado la posibilidad de acceder a los datos generados por su uso y de utilizarlos, incluso compartiéndolos con terceros. Se analiza, el fundamento, contenido y ámbito de aplicación del nuevo instrumento, así como el alcance de las obligaciones de los titulares de datos de ponerlos a disposición de los sus usuarios y de otros destinatarios y las normas frente a cláusulas abusivas aplicables incluso en las relaciones entre empresas. Asimismo, se expone la nueva normativa para facilitar el cambio entre servicios de tratamiento de datos y la interoperabilidad, valorando el significado de los contratos inteligentes como instrumento relevante a esos efectos y el alcance de la regulación de esa figura en el nuevo instrumento. Finalmente, se aborda el marco de aplicación y ejecución del nuevo instrumento, con referencia también a las carencias en lo relativo a su aplicación privada.This contribution provides an overall analysis of the new EU Data Act. Regulation (EU) 2023/2854 aims to establish a framework to facilitate an optimal allocation of data, guaranteeing users of a connected product or related service the possibility to access and use the data generated by its use, including sharing it with third parties. The foundations, content, and scope of application of the new instrument are discussed, as well as the obligations of data holders to make data available to their users and other recipients, and rules on unfair contractual terms applicable even to business-to-business relationships. Furthermore, the provisions on switching between data processing services and interoperability are discussed, assessing the significance of smart contracts as a technical tool in that context. Going Beyond Counting First Authors in Author Co-citation Analysis
No full textThe present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
