New developments in the regulation of online contracts in Directive (EU) 2023/2673
La Directiva (UE) 2023/2673 lleva a cabo una importante modernización del régimen específico de los contratos a distancia de servicios financieros con consumidores, adaptándolo a la transformación tecnológica y de los modelos de negocio que ha tenido lugar en las dos últimas décadas. Con el propósito de simplificar el marco legislativo previo, suprime el instrumento específico en materia de contratos a distancia de servicios financieros con consumidores -la Directiva 2002/65/CE-, integrando su régimen en el instrumento que contiene el marco general sobre contratación a distancia de consumo, la Directiva 2011/83. Además, introduce, nuevas obligaciones para los comerciantes tendentes a facilitar el ejercicio del derecho de desistimiento por los consumidores en los contratos celebrados mediante una interfaz en línea. Estas obligaciones no resultan de aplicación solo a los contratos a distancia de servicios financieros, sino a todos los contratos a distancia sujetos al derecho de desistimiento con arreglo a la Directiva 2011/83/UE celebrados mediante una interfaz en línea. En esta primera aproximación al nuevo instrumento se abordan las siguientes cuestiones: el desistimiento en los contratos a distancia celebrados mediante una interfaz en línea; la aplicación de la Directiva 2011/83/UE a los contratos de servicios financieros; y el régimen específico de los contratos a distancia de servicios financieros.Directive (EU) 2023/2673 brings about a major modernization of the specific regime for distance contracts for consumer financial services, adapting it to the technological and business model transformation that has taken place over the last two decades. In order to simplify the existing legislative framework, Directive (EU) 2023/2673 repeals the specific instrument on distance contracts for consumer financial services (Directive 2002/65/EC), integrating its regime into the instrument containing the general framework on consumer distance contracts (Directive 2011/83/EU). Additionally, Directive (EU) 2023/2673 imposes new obligations on traders concerning the exercise by consumers of the right of withdrawal from distance contracts concluded by the means of an online interface. These obligations apply not only to contracts for consumer financial services but to all contracts concluded by the means of an online interface where a right of withdrawal exists under Directive 2011/83/EU. Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
