Going Beyond Counting First Authors in Author Co-citation Analysis

counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Variations on the Author
Get PDF“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
Get PDFWe provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. No full textIl commento all’art. 2394, cod. civ., si apre con l’esame della locuzione «obblighi inerenti alla conservazione dell’integrità del patrimonio sociale», alla luce della impossibilità di concepire attività economica meramente conservativa. Muovendo dall’ipotesi che la parola “patrimonio” sia utilizzata nel significato di “garanzia patrimoniale”, si argomenta che gli obblighi in esame sorgono tipicamente allorquando alla finalità di esercizio di una attività economica si sostituisce quella di definizione dei rapporti dei quali la società è parte: dunque a seguito del verificarsi di una causa di scioglimento. Si discute l’approdo con riferimento all’art. 2486, secondo comma, cod. civ. Quindi, alla luce della formulazione dell’art. 2392, primo comma, che enuncia un canone di diligenza centrato sulla natura dell’incarico, si suggerisce che l’obbligo di conservazione della integrità della garanzia patrimoniale possa sorgere ancor prima del verificarsi della causa di scioglimento, per effetto di una fattispecie complessa costituita dalla previsione da parte degli amministratori della impossibilità che la società faccia fronte alle proprie obbligazioni e dalla mancata decisione o attuazione di operazioni (di tipo finanziario, aziendale o societario) idonee al salvataggio, e che in tale prospettiva nell’art. 2394 possa rinvenirsi uno strumento di tutela dei creditori per ipotesi di wrongful trading.
Si afferma la natura contrattuale della responsabilità regolata dalla norma in commento, osservando che essa, essendo condizionata alla insufficienza del patrimonio sociale al soddisfacimento dei crediti, si presta a essere riguardata come una ipotesi di interferenza di terzi (gli amministratori) nella inattuazione delle prestazioni dovute dalla società ai propri creditori, e come tale a essere scrutinata nella prospettiva già nota alla scienza giuridica del diritto alla integrità del patrimonio e della connessa tutela, riconosciuta anche nei confronti di soggetti diversi da quello tenuto alla prestazione, ampliandosi a tal fine conseguentemente il lato soggettivo del rapporto obbligatorio.
Si esamina, poi, il presupposto al quale l’azione dei creditori sociali è subordinata (la insufficienza del patrimonio della società), affermandosi, in considerazione di quanto osservato in precedenza, che la sussistenza di esso deve essere valutata con riferimento alla differenza fra la situazione del patrimonio sociale nel momento a partire dal quale le finalità conservative si sostituiscono a quelle produttive e quella eventualmente diversa esistente al tempo in cui il creditore agisca ex art. 2394.
Si passa, quindi, a illustrare il rapporto con l’azione sociale di responsabilità, soffermandosi sulla distribuzione degli oneri di allegazione e di prova tra le parti del giudizio.
Si espongono le conseguenze della qualificazione della condotta sanzionata come complicità o induzione all’inadempimento in punto di quantificazione del danno risarcibile, richiamando anche le conclusioni della dottrina ritenuta preferibile in punto di funzione della responsabilità contrattuale.
Lo studio si conclude con considerazioni sulla prescrizione dell’azione, e su rinuncia e transazione.
