Testimony before the Kansas Legislature, House Health and Human Services Committee, by Sarah Fertig, Medicaid Director, Kansas Department of Health and Environment.Testimony in opposition to HB 2259. "The bill would abolish the Mental Health Medication Advisory Committee (MHMAC) and block the state Medicaid program from imposing any prior authorization requirements for mental health medications only. Our agency opposes this bill because it would block Medicaid, and only Medicaid, from imposing reasonable cost containment and safety requirements for mental health drugs. It would also eliminate the parity that currently exists in Medicaid between mental health drugs and other classes of drugs. ... First, HB 2259 would reopen the door to dangerous prescribing practices. ... Second, HB 2259 would eliminate current parity between mental health and medical drug coverage...allowing mental health drugs, and only mental health drugs, to escape any state oversight. ... Third, the Medicaid program is already working to reduce provider burdens. ... More discussions on how to reduce provider burden are already planned for 2023. This bill would short-circuit these discussions in favor of removing all prior authorization requirements. ... Finally, Medicaid's current prior authorization requirements for mental health drugs are reasonable and clinically sound. ... To conclude, KDHE opposes HB 2259 because it would undo a major policy reform that allows the Medicaid program to promote safer and more cost-effective mental health drug policies. HB 2259 would also come at a significant cost to taxpayers.
Section 2259 Restitution Claims and Child Pornography Possession
Get PDFIn 2009, a child pornography victim brought a criminal restitution claim against a defendant who possessed images of her abuse. The statutory provision authorizing restitution, 18 U.S.C. § 2259, had never before been used to bring a claim against a defendant who had only possessed, rather than produced or distributed, child pornography ( child pornography possession defendants ). The federal courts have not developed a consistent approach to resolving Section 2259 claims involving such defendants. This Note argues that two conceptions of traditional proximate cause doctrine can provide a framework for analyzing such claims. It examines Section 2259 claims using both a policy-based view of proximate causation and a view based on the relationship between the victim and the defendant. This Note concludes that, using either approach, current Section 2259 claims against child pornography possession defendants fail to prove proximate causation

A Mid-Infrared Counterpart to the Magnetar 1E 2259+586
Get PDFWe report the discovery of a 4.5μm counterpart to the anomalous X-ray pulsar (magnetar) 1E 2259+586 with
the Spitzer Space Telescope. The mid-infrared flux density is 6.3 ± 1.0μJy at 4.5μm and <20 μJy (at 95%
confidence) at 8μm, or 0.02% of the 2–10 keV X-ray flux (corrected for extinction). Combining our Spitzer
measurements with previously published near-infrared data, we show that the overall infrared emission from 1E
2259+586 is qualitatively similar to that from the magnetar 4U 0142+61. Therefore, the passive X-ray-heated dust
disk model originally developed for 4U 0142+61 might also apply to 1E 2259+586. However, the IR data from
this source can also be fitted by a simple power-law spectrum as might be expected from magnetospheric emission
