No full textAun cuando la contratación pública no está diseñada para que sea un medio de fomento directo ni de control específico de medidas sociales, la verdad es que puede tener un extraordinario poder de conformación sobre el tejido empresarial; no en vano quienes quieran acceder a los procedimientos de licitación pública y resultar finalmente adjudicatarios deben cumplir forzosamente con las condiciones y exigencias predefinidas de antemano por los poderes adjudicadores. Bajo tal premisa, la Ley 9/2017, de 8 de noviembre, de Contratos del Sector Público, apuesta por la incorporación transversal y preceptiva de criterios sociales en las distintas fases del proceso de contratación con el fin de mejorar el régimen laboral de los trabajadores afectados.Even if public recruitment is not thought to be a means of direct promotion or specific control of social measures truth is that it may have an incredible power of structure over company network. Under that premise Act 9/ 2017, 8 November of Contracts of the Public sector bets for mandatory and transversal social criteria throughout the various phases of contracting procedure so as to improve the working conditions of the affected workers.Obwohl die Anstellung im Staatssektor weder ein direktes Mittel zur Arbeitsförderung ist noch eine spezifische Regulierung von sozialen Maßnahmen darstellt, so ist es doch wahr, dass sie eine gestaltende Auswirkung auf die Unternehmensstruktur ausüben kann. Nicht umsonst müssen die Bewerber, die bei den öffentlichen Ausschreibungen zugelassen und Erfolg haben wollen, zwangsläufig die vorgegebenen Bedingungen und Anforderungen der Vergabebehörden erfüllen. Unter dieser Prämisse tritt das Gesetz 9/2017 vom 8. November über Verträge im Staatssektor in Kraft, das sich für die übergreifende und verbindliche Einbeziehung von sozialen Kriterien in die verschiedenen Phasen der Anstellung einsetzt, um den arbeitsrechtlichen Status der betroffenen Arbeitnehmer zu verbessern

Una previa, convocada un año después de la muerte del dictador Francisco Franco, todavía en Cortes Franquistas, y una segunda amnistía, convertida en la denominada “Ley de Amnistía”, consensuada y redactada por todos los grupos políticos de las Cortes democráticas, emanadas del Parlamento, a excepción de Alianza Popular, la cual votó en contra. El artículo refleja el espíritu de su origen, su escaso desarrollo legislativo posterior, y su transformación en argumento jurídico para denegar el acceso a la Justicia y el derecho a la Tutela Judicial Efectiva, reconocidos como Derechos Fundamentales de la Constitución Española de 1978.The Amnesty Law, is born as a negotiation in two parts. A prior, convened a year after the death of the dictator Francisco Franco, still in Francoist Courts, and a second amnesty, converted into the so-called “Amnesty law “, agreed and drafted by all political groups in the democratic courts, emanating from Parliament, with the exception of Alianza Popular, which voted against it. Get PDFEl presente artículo da cuenta del hallazgo de unos documentos en que se ofrecen datos concretos y aspectos desconocidos y esenciales en torno a la financiación cultural llevada a cabo en el tardofranquismo por el Estado a una revista cultural de larga trayectoria, La Estafeta literaria. Gracias a estos datos quedan mejor explicadas muchas afirmaciones presentes en otros los estudios existentes hasta hoy sobre esta revista cultural. Tales documentos explican los porqués de las modificaciones efectuadas en la revista a partir de enero de 1971.This article gives an account of the discovery of documents that offer concrete data and unknown and essential aspects of the financing made in the Francoist regime by the State to a long-standing cultural magazine, La Estafeta literaria. Thanks to these data, many statements made in the other studies published to date on this journal are better explained. In addition, these documents specify the reasons why changes were made in the journal since January 1971
El género y sus interseccionalidades desde una perspectiva sociológica e histórico-crítica en las narrativas autobiográficas de Angelou, Lorde y Davis
No full textIn the development of feminist studies intersectionality theory has contributed with some paradigms of great relevance to understand the violence and discriminations that women suffer due to gender and race issues. This article will deal with the development of intersectional feminism paying attention to the historical and political moment of the black feminist movements previous to intersectionality. Likewise, the different oppressions of gender, race and class will be investigated by means of an in-depth analysis of three autobiographical words written by African American women and that are precursors of de denunciation of different intersectional oppressions. Using these three autobiographical works as an analytical grid, we will be able to prove that intersectionality theory refers to a complex system of oppressions that are multiple and simultaneous demonstrating, in addition, the diverse forms in which their interaction leads to different ways of exclusion.En el desarrollo de los estudios feministas la teoría de la interseccionalidad ha aportado paradigmas de gran relevancia para explicar la violencia y las discriminaciones que, por razones de género y raza, sufren las mujeres. En este artículo se abordará el desarrollo del feminismo interseccional, prestando atención al momento histórico y político de los movimientos feministas negros anteriores a su aparición y desarrollo. Asimismo, se analizarán las distintas discriminaciones por razones de género, raza y clase mediante el análisis en profundidad de tres obras autobiográficas escritas por mujeres afroamericanas y que son precursoras de la denuncia de distintas opresiones interseccionales. Utilizando estas autobiografías como rejilla analítica, podremos observar que la teoría de la interseccionalidad hace referencia a un sistema complejo de opresiones que son múltiples y simultáneas demostrando, además, las diversas formas en las que la raza y el género interactúan dando forma a diferentes maneras de exclusión

Get PDFEl trabajo parte de una mirada interdisciplinaria para retomar una práctica religiosa del noroeste argentino: la peregrinación del Milagro en Salta. El abordaje intenta analizar cómo se construye el cuerpo peregrino en el discurso mediático y devocional referido al caso. A partir de allí, se explora la manera en la que los enunciados de la prensa tienen inscripciones del discurso religioso y configuran miradas cristalizadas sobre el ritual. En las voces de los peregrinos, los sentidos se desbordan, lo que permite pensar la disputa por las representaciones y las identidades que dan cuenta de diversas mediaciones.The work starts from an interdisciplinary perspective to resume a religious practice in northwestern Argentina: the pilgrimage of the Miracle in Salta. The approach tries to analyze how the pilgrim body is constructed in the mediatic and devotional discourse referred to the case. From there, the way in which the press statements have inscriptions of religious discourse and crystallized the ritual is explored. In the voices of the pilgrims, the senses overflow, which allows us to think about the dispute for representations and identities that account for mediations
Principios inherentes a la mediación intercultural en la escuela
Get PDFDuties of intercultural mediator at the school context keep being a task in process of building, unfortunately linked to the conflict resolution and to the linguistic understanding, preventing in this way from their consolidation as professional group. The primary goal is to analyze the teaching perception in pre-school and primary education about duties of that professional figure at school. To this effect, interviews with teachers belonging to educational centers with higher concentration of immigrant schoolchildren have been done. The research findings reveal a wide range of actions, in contrast to the simplistic association abovementioned.Las funciones del mediador o mediadora intercultural en el contexto escolar sigue siendo una tarea en proceso de construcción y que lamentablemente se vincula sistematicamente a la resolución de conflictos y a la interpretación linguistica obstaculizando así su consolidación como colectivo profesional. El objetivo principal es analizar la percepción de los docentes en educación infantil y primaria sobre las funciones de dicha figura profesional en la escuela. Para ello, se ha realizado entrevistas a docentes pertenecientes a centros educativos con mayor concentración de alumnado migrante. Los resultados revelan toda una bateria de actuaciones que rompen con la asociación simpista anteriormente mencionada
