Get PDFThe objective of this article is to study the political identity that characterizes the current Catalan social and political independence movement (2011-2017) from the rhetorical theory of democracy perspective. The question to be analyzed will be whether this identity contains democratic deficits that affect its inclusivity and pluralism in such a way that its ability to interact with a significant portion of Catalan society is limited. For this purpose, the political identity in question will be examined to determine if it is a common or a partial political identity because, in the latter case its normative problems will be significant, from a democratic perspective, given the goal that this movement aims to achieve.El objetivo del artículo es estudiar la identidad política que caracteriza al actual movimiento social y político independentista catalán (2011-2017) desde la teoría retórica de la democracia. La cuestión a analizar será si dicha identidad contiene determinados déficits democráticos que afecten a su inclusividad y pluralismo de tal modo que su capacidad de interacción con una parte significativa de la sociedad catalana quede limitada. Para ello, se comprobará si dicha identidad política es una identidad política común o bien una identidad política parcial porque, en ese caso, y teniendo en cuenta el objetivo que dicho movimiento pretende alcanzar, sus problemas normativos desde un punto de vista democrático serán relevantes

No full textLa extensión de la duración de la incapacidad temporal ha sido uno de los temas más modificados dentro de la normativa reguladora de una contingencia protegida en el sistema de la Seguridad Social española. Sigue generando además múltiples controversias, como muestra la regulación actual contenida en el Texto Refundido de la Ley General de la Seguridad Social de 2015, que contempla la combinación de las distintas opciones que las entidades gestoras y las mutuas han de tomar en relación con las extensiones temporales posibles de esta contingencia protegida. A partir de ellas, mostramos la necesidad de justificar que el mero transcurso del tiempo no ha de ser entendido por sí mismo como causa de finalización de las prestaciones de incapacidad temporal, sino que debe conectarse con alguna de las circunstancias que la ley recoge como operadora de la extinción de la protección a través de esta contingencia.The extension of the length of temporary inability hereinafter temporary inability— has been one of the subjects with the most amendments within the legal system regulations for a contingency which is legally protected in the Spanish System of Social security. It continues to raise controversy as it is shown by the current wording of the amended text of the Social Security Act 2015, which studies the combination of the several options that managing entities and Mutual Insurance Companies have to choose regarding the likely temporary extensions of that provided contingency. It is through them that we can show the need to justify that the mere lapse of time should not be understood on its own as the reason to terminate temporary inability benefits, but it should also be connected with some of the circumstances the law welcomes as to terminate the protection through this contingency.Die Verlängerung der Laufzeitfristen der kurzzeitlichen Arbeitsunfähigkeit —im folgenden abgekürzt durch kAU— ist eines der Themen die innerhalb der geltenden Vorschriften zu Leistungsarten der Spanischen Sozialversicherung am meisten abgeändert wurden. Außerdem verursacht sie verschiedenartige Kontroversen, wie die derzeitigen Vorschriften beweisen, die in der konsolidierten Fassung des allgemeinen Sozialrechts der Spanischen Sozialversicherung von 2015 enthalten sind. Diese sehen die Kombination von verschiedenen Optionen vor, welche die Ausführungsorgane und die Versicherungsgesellschaften ergreifen sollen bei möglichen zeitlichen Verlängerungen dieser Leistungsart. Ausgehend von diesen, verweisen wir auf die Notwendigkeit der Rechtfertigung des Umstands, so dass der bloße Umstand des verlängerten Zeitverlaufs nicht automatisch zur Beendigung der Leistungen der kAU führen muss, sondern verbunden werden muss, mit einem der Umstände, die das Gesetz als Ausführungsorgan der Beendigung des Versicherungsschutzes für den Eventualfall beinhaltet

Get PDFLa presente investigación estudia el posible discurso islamófobo de los medios de comunicación escritos a través de un análisis de los artículos de opinión en los diarios generalistas, ABC y El País, en torno a dos atentados perpetrados en 2015 por el terrorismo yihadista: Charlie Hebdo y el 13-N. El artículo recurre a una metodología de análisis de contenido cuantitativo y de análisis cualitativo del discurso sobre 217 artículos de opinión que se someten a una ficha de análisis de elaboración propia con 22 variables. Los resultados principales reflejan que en los artículos de opinión de ambos medios aparecen argumentos islamófobos asentados en los discursos coloniales y del choque de civilizaciones.The aim of this research is to study a possible Islamophobic discourse in the written media through an analysis of opinion articles from generalist newspapers such as ABC and El País, around two jihadist attacks committed in 2015: Charlie Hebdo y el 13-N. The article resorts to a methodology of quantitative and qualitative discourse analysis about 217 opinion articles that are submitted to a coding sheet of own elaboration with 12 variables. The main results show that in the opinion articles, of both newspapers, there are Islamophobic arguments established in the colonial discourses and in the clash of civilizations
