Ensayo ganador del VIII Premio Enrique Ruano Casanova: El principio de legalidad penal y su configuración como derecho subjetivo en el sistema regional europeo de protección de los derechos humanos
No full textDieser Artikel untersucht die Entwicklung der Rechtsprechung, die der Europäische Gerichtshof für Menschenrechte bezüglich des Artikels 7 der Europäischen Konvention zum Schutze der Menschenrechte und Grundfreiheiten verfolgt hat. In diesem Artikel wird der Grundsatz der Strafgesetzlichkeit festgeschrieben. Nach einem Bezug auf die historischen Ursprünge dieses Grundsatzes werden sein Inhalt und seine Reichweite aus der Perspektive der vergleichenden Rechtswissenschaft untersucht. Im Anschluss wird die Ausgestaltung untersucht, die der Grundsatz im europäischen regionalen System des Schutzes der Menschenrechte erfahren hat. Zunächst werden die Verfügungen des lex scripta und des lex certa in Bezug auf das Konzept des in der Konvention festgeschriebenen Gesetzes analysiert; anschliessend wird das Unterprinzip des Rückwirkungsverbot untersucht, wie auch die Begrenzungen, denen es unterworfen ist.This article looks into the case law development of article 7 of the European Convention for the Protection of Human Rights and Basic Freedoms made by the European Court of Human Rights, where the principle of legality in Criminal Law appears. Once referred to the historic origins of the principle, we study its content and scope from the point of view of contrasted law. Next we look into the shaping given to the principle in the European regional system for the Protection of Human Rights. First, we study the rules of statute law and lex certa regarding the concept of law as seen in the convention. After that, we analyze the subprinciple of the prohibition of retroactivity, as well as the boundaries the latter has.Este artículo analiza el desarrollo jurisprudencial que el Tribunal Europeo de Derechos Humanos ha realizado del art. 7 del Convenio Europeo para la Protección de los Derechos Humanos y de las Libertades Fundamentales, en el que se consagra el principio de legalidad penal. Tras hacer referencia al origen histórico del principio, se examina su contenido y alcance desde la perspectiva del Derecho comparado. A continuación se estudia la configuración que el principio ha recibido en el Sistema Regional Europeo de Protección de los Derechos Humanos. En primer lugar, se analizan los mandatos de lex scripta y lex certa en relación con el concepto «ley» consagrado en el Convenio y, posteriormente, se examina el subprincipio de prohibición de retroactividad, así como los límites a los que éste se ve sometido

Get PDFA partir de la relación entre la prensa italiana y española y los niveles de corrupción percibida en los mismos tejidos sociales, se analiza la capacidad de los periódicos para difundir adecuadamente la información acerca de la corrupción política y de informar al público sobre la realidad del fenómeno. La razón reside en el cambio de los métodos de difusión de información: ¿en la era de la información ‘en tiempo real’ por fuentes independientes (internet y redes sociales), es apropriado dudar del grado de transparencia y eficacia de los periódicos respecto a los otros medios de difusión?Starting from the relationship between the Italian and Spanish press and the levels of corruption perceived in the same social context, we analyzes the ability of newspapers to adequately disseminate information about political corruption and to inform the public about the phenomenon . The reason lies in changing the methods of information dissemination: in the ‘real time’ information age by independent sources (internet and social networks), it is appropriate to doubt the degree of transparency and effectiveness of the newspapers compared to other means of distribution

Get PDFEsta investigación consiste en un estudio mediante Análisis de Redes Sociales (ARS) sobre dos gobiernos recientes de la democracia española: el gobierno del Partido Popular formado en el año 2012 y el ejecutivo del Partido Socialista, constituido en el 2004. Estas dos agencias gubernamentales se conciben y se analizan como redes sociales que vinculan a sus miembros a partir de los contactos que estos establecieron en el pasado en cinco grupos de poder: los grupos ejecutivos, los legislativos, los políticos, los empresariales y los burocráticos. El estudio revela dos rasgos fundamentales para ambos casos: un elevado nivel de cohesión interna y un conjunto relevante de vínculos que relacionan a los gobiernos con importantes grupos de poder de la estructura social.This paper aims at analyzing two recent Spanish democratic governments: the Popular Party government in 2012 and the Socialist Party executive in 2004. Both governmental agencies are studied and understood as social networks that emerge from the links their members established in the past when they coincided in different power groups: executive, legislative, political, business and bureaucratic institutions. This study reveals two types of structural elements in both cases: firstly, a high degree of cohesion within each government and, secondly, a relevant set of links that relate the executive to several power groups of the social structure

Its management is of a group formed by social organizations and citizens. The programming of the radio mainly brings informative programs and of debate with a strongly answering look and of social critic. The listeners interviewed in this research are mainly people who have a memory of a political militancy and believe possible social change.Frecuencia Libre es una estación de FM en la ciudad de San Cristóbal de Las Casas en el Estado Mexicano de Chiapas, en aire desde 2002 sin permiso gubernamental. Su gestión es de un colectivo formado por organizaciones sociales y ciudadanos. La programación del radio trae principalmente programas informativos y de debate con una mirada fuertemente contestadora y de crítica social. Get PDFThe focus of this research note is to assess comparatively recent institutional change in Southern European welfare states. The outbreak of the financial and economic crisis in 2008 triggered a new scenario for welfare reform. Social protection systems were forthwith brought to a major transformation juncture under high political and economic strain. The political response to the crisis brought about austerity in public expenditure and harsh institutional reshaping of welfare provisions in order to regain fiscal consolidation, solvency of the public sector and external competitiveness. The outcome of austerity measures has been an increasing differentiation in the pace and process of institutional reform within the Mediterranean welfare model.Esta nota de investigación examina comparativamente el cambio institucional reciente de los Estados del bienestar en los países del Sur de Europa. La irrupción de la crisis económica y financiera en 2008 dispuso un nuevo escenario para la reforma del bienestar. Los sistemas de protección social se enfrentaron a una coyuntura de transformación bajo condiciones de elevada presión política y económica. La respuesta a la crisis se asoció a la austeridad en el gasto público y al rediseño institucional de las provisiones de bienestar, con el objetivo de recuperar la estabilidad fiscal, la solvencia del sector público y la competitividad exterior. El efecto de las políticas de austeridad ha sido la aparición de senderos de transformación institucional diferenciados dentro del modelo de bienestar Mediterráneo
