    [The insurance against tuberculosis:  historical aspects and criteria of legal medicine]In the period after the First World War, tuberculosis was a real social emergency and, as such, has been addressed by the legislature providing for the economic conditions that would ensure the worker and his family. It was discussed whether today still makes sense to keep up this protection in the light of the presence of other significant social problems. In recent years, however, tuberculosis has increased again and, for this reason, it is not to be relegated to a minor problem. The economic benefits, of course, cannot replace the loss of earnings due to illness but makes the period considered less traumatic. Furthermore, considering the high specificity of modern diagnostic tests, the whole issue should be revisited.This article briefly outlines the historical evolution of insurance against tuberculosis and the medical and forensic criteria to be assessed in the different phases of tuberculosis

    [Driving under influence of psychotropic drugs (Article 187 Italian Road Code)]On March 15th 2010 is promulgated the law 30/2010 that stimulates the use of the opioids for pain therapy. After a few months the Italian Road Code is modified in the article 187, eliminating the necessity of a psychophysical evaluation from a physician to the drivers sanctioning in case of biological positiveness to the psychotropic substances.The burden of such evaluation reverts so on the police that can be not able to perform such procedures.The patients in therapy with opioids are therefore potentially discriminated despite that their driving performances are often best of who guide with pain without therapy or whose assumes benzodiazepines, psychotropic drugs enrolled in the same ministerial list together with opioids and illicit drugs.The authors then describe the results of an APP from them invented in degree to perform such evaluations in an objective way, repeatable and "on the road", with the purpose of prevention of the road car crash and as a tool for the police during their controls

    [Sentinel general practitioner as a key element for an effective environmental health surveillance]The concepts of Epidemiological Surveillance and Environmental Public Health (EPHT) are outlined. In addition to the clues of their importance in different settings, it is claimed their usefulness in view of a sustainable, healthy and competitive society where environment and health are pillars of wellbeing and productivity, especially in a time of socio-economic and even cultural crisis.Public-health decision makers can use this timely, accurate and systematic data to inform and draft policies that reduce environmental health burdens and prevent disease efficiently and cost-effectively. Indeed tracking can also support the response to increasing community concern about point sources of pollution (e.g. incinerators and landfill sites) and also contributes to the statutory obligations of several member states around environment and health surveillance.Surveillance systems might enhance collaboration among public health and environmental agencies, health-care providers, information-system professionals, academic investigators, and industry. However, surveillance does not substitute direct physician reporting of unusual or suspect cases of public health importance.As matter of fact many experiences of Sentinel General Practitioner have been carried all around the world, and also in Italy some relevant experiences have proven the importance of the information, competencies and prestige also in the field of Environmental-Health which General Practitioners are universally reputed to hold.Some proposal are provided to settle a National network of Environmental Health Sentinel Practitioner

    [Update of the handicap registry of the Autonomous Province of Trento]There are some good reasons that support our effort to annually update the handicap registry of the Autonomous Province of Trento.The first reason is due to the fact that in our country there is an incomprehensible dispersion of information that feed the numerous existing databases on disability. This dispersion does not allow to have precise information on the actual number of people with disabilities and their characteristics.A second reason is that each functional articulation of the National Healthcare Systems is accountable to the community of what is enacted for the protection of the fundamental right to health, as proclaimed in Article 32 of the Constitution.A third reason is to make statistical data accessible to policy makers and to all the government since they have a responsibility in making strategic decisions and planning the supply of social and health services dedicated to people with disabilities.The fourth and final reason is the uniqueness of the protection given by our country to people with disabilities. But there is a fourth and final reason that supports our obstinacy: we indicate the typicality of the protection given by our country to people with disabilities. Protection that, in absolute contrast with the general logic of our welfare system, is aimed to the right of citizenship of these people (and their families) when they are not yet hospitalized in long-term structures. With the result that this database, beyond the general macro-statistical indicators, provides a clear idea of the needs that disabled people have when they actually live in the home, witnessing the strong commitment exercised by the network of relatives and the difficulties faced by families in the care burden.Between 1992 and 2012 the database managed by the Operative Unit of Legal Medicine, APSS (Azienda provinciale per i Servizi sanitari di Trento), recorded 18,380 people with disabilities who have submitted 23,920 applications designed to obtain the benefits and facilities provided by the Law of 25 February 1992, no. 104.The article presents the macro-statistical indicators database (sex and age) and some other indicators that represent the complexity of the phenomenon, such as trends of applications, types of disabilities, impairments causing disability, benefits and facilities recognized

Comment to: judgment of the Court of Milan, July 17th 2014]Today, more and more evidence is perfected a peculiar creation process of law: law is jurisprudence!The judgment of the Court of Milan, here under review, sets out a direction completely contrasting with the well-established theory of liability of “social contact” in the health sector.The point at issue? The same for some time, now: the Decree Balduzzi revived the responsibility model in force before the landmark ruling in 1999, or only represented a failure of the Legislator?The jurisprudential debate arises from the interpretation of Article 3 of Law 189 of November 8, 2012, the conversion of D.L. September 13, 2012 n. 158, the notorius “Decree Balduzzi”.The Court of Milan promotes the interpretation that the second part of Article 3 of Law n. 189/2012, would change the “living law”, making a choice in line with the purpose of containing the costs of compensation of public health and to remedy the phenomenon of so-called “defensive medicine”, “throwing to the nettles” the usability in practice of the theory of social contact.The position taken by the Court of Milan cannot be shared: the reference to art. 2043 of the Civil Code must be interpreted as a failure of the Legislator, too worried about reducing health care costs. We must therefore continue to apply the model of liability of art. 1218 of the Civil Code, and then the theory of social contact. Anyway: posterity will judge

    [Mapping of clinical risks through the integration of information sources]At the IRCCS Rizzoli Orthopaedic Institute in Bologna (Italy) has been active a program of risk management since 2007. It provides integrated and systematic use of tools and sources of information related to the safety of patients, workers and environment and to the management of claims and litigation.To define priorities for actions included in the «Plan to Safety» and to address appropriately the resources available for the reduction of adverse events, it was developed a mapping of risks through the integration of data from different information sources related to patient safety and obtained at the company level (Incident Reporting, Patient Complaints, Claims). To classify the events was utilized the International Classification of Patient Safety (ICPS) developed by the World Health Organization (WHO). It were used 875 reports derived from the three sources of information and they were related to the categories of class «Incident Type» of ICPS. Four categories of accidents were most frequently observed: «Clinical Process/Procedures» (20.0%), «Clinical Administration» (16.8%), «Documentation» (11.3%),«Medication/IV Fluids» (10.2%). For the class «Patient Outcomes» of ICPS were more frequently events with «None» harm (64.6%) and those with «Mild» harm (29.9%).The classification with the ICPS system has proven to be a useful tool for a preliminary mapping of risks and identify critical areas to be tackled as a priority. The ICPS introduces a conceptual framework for patient safety with which it is possible to make comparisons of the results of activities related to risk management both locally and at a regional and national level.
