    Kebijakan legislasi sebagai elemen penting tata hukum pidana nasional-pada era reformasi yang menarik untuk dicatat ialah pengesahan dan pemberlakuan perundangundangan pidana khusus, yakni Undang-Undang Pemberantasan Korupsi. Undang-undang ini merupakan membutuhkan pencerahan dalam pembaharuan hukum di negara Indonesia dari tata hukum pidana nasional pada masa reformasi ini. Dari latar belakang di atas perlu dikaji bagaimana kebijakan Legislasi Penerapan Sanksi Tindak Pidana Korupsi. Hasil Penelitian adalah Kebijakan legislasi terhadap sanksi pidana  adalah Sanksi dalam Undang-undang Tindak pidana korupsi berupa dan Pengkajian dalam sanksi tindak pidan Korupsi adalah sansi yang ada dalam UU Tindak Pidana Korupsi yang ada tidak menimbulakan efek jera pada pelakunya dengan demikian saat ini mulai di tinjauu pembenahan dalam sanksi untuk pelaku tindak pidana korupsi dengan meninjau dari hukuman mati dan Harus ada upaya memalukan secara sosial ditambah juga dengan sanksi kurungan

    The industry of the financial services or banking sector is demanded to be constantly stable, that is healthy, transparent and well managed. Such banking conditions can build consumers to continue to actively engage in transactions. However, as time goes by the development of the financial services industry in Indonesia is increasing and the cross-sectoral problems of the financial services industry are increasingly in need of reform in the field of banking law, then the Financial Services Authority is formed as an institution that will replace Bank Indonesia in the supervision of banks and supervise institutions other finance. OJK in its formation has several objectives to carry out supervision, especially in the financial services sector. Pursuant to Article 4 of the OJK Law, OJK was formed with the aim that all activities within the financial services sector: (a) be organized regularly, fairly, transparently and accountably; (b) Able to realize a financial system that grows sustainably and stably; and (c) Able to protect the interests of consumers and society. Based on its authority, the OJK carries out the task of regulating and supervising the banking sector in accordance with its functions as stipulated in Article 5 of the OJK Law which functions to organize an integrated regulation and supervision system for all activities within the financial services sector. With the presence of OJK in supervision, banking and other financial institutions can create harmonious regulations so as to protect consumer rights

    The proliferation of drug trafficking and use activities in Indonesia today, makes Indonesia a drug emergency. Narcotics is an extraordinary crime and needs special attention in its eradication efforts. Therefore great power is needed by using the toughest legal actions in which Indonesia has a death sentence. The purpose of capital punishment is to give a violent deterrent to drug offenders and as a warning to other communities not to commit these crimes. The issue examined in this paper is the suitability of Pancasila as the legal basis for the application of the death penalty, and the application of the death penalty to narcotics crime. The reality of capital punishment in Indonesia shows that the implementation of the judicial system is not good and the execution of the death penalty is always postponed so that it seems indecisive . In addition, the regulation of capital punishment also raises the debate between the ethical values of Pancasila and positive law (KUHP). It is undeniable that in the effort to implement such assertiveness sometimes experience obstacles both from within and outside the country. As well as various counter opinions regarding capital punishment that violate human rights . Even in Indonesia alone for those who contradict the death penalty, it is associated with violating the first precepts of Pancasila, where God is the ruler of the universe who has full provisions for the right to life and death. But Indonesia still applies the death penalty based on the positive law (KUHP)

    Jika kita membeli saham, kita akan menghadapi dua kemungkinan, yaitu untung atau rugi. Jika harga saham yang kita beli naik, kita akan mendapat keuntungan (capital gain). Jika saham kita turun, kita akan mengalami kerugian (capital loss). Permasalahan dalam penelitian ini adalah bagaimana perlindungan hukum bagi investor dalam pembelian kembali sahamnya di pasar modal. Metode analisis data yang dipergunakan dalam penelitian ini adalah analisis secara kualitatif. Hasl penelitian menunjukan bahwa perlindungan hukum terhadap nasabah diatur dalam Undang-Undang Nomor 8 Tahun 1995 tentang Pasar Modal yang menentukan dan mengatur bahwa otoritas yang berwenang atas pasar modal adalah OJK. OJK lah yang memiliki wewenang untuk melaksanakan perlindungan hukum pasar modal yang bersifat preventif dan represif. Saran sebaiknya  Bursa Efek Indonesia dalam melaksanakan ketentuan dengan melihat peraturan yang ada agar tidak terjadi dampak yang merugikan para investor dikemudian hari

    The organization of traditional medicine practices is an alternative healing path besides medical methods. The practice of traditional medicine must be supported by a health law device intended to provide legal certainty and protection for community members as patients and traditional treatment providers. This study is intended to find out the regulations that protect the organization of traditional medical practices and the forms of healing agreements provided by providers of traditional medical practices for patients. The research method used is normative by reviewing regulations, literature studies and observations of traditional medicine. The implementation of traditional medical practices is supported by several regulations including the Minister of Health Decree No. 1076 / MENKES / SK / VII / 2003 concerning Traditional Medicine Administrators and Law No. 36 of 2009 concerning Health. The health law instrument is intended to provide legal certainty and protection for community members as patients and traditional treatment providers. The traditional treatment agreement is clear that if carried out in accordance with the procedures specified by law is a legal agreement and binds the parties to traditional healers and patients. The type of agreement used by traditional healers and patients is a healing agreement (therapeutic agreement). A therapeutic agreement is a term of agreement that deals with a doctor that also applies to traditional healing staff as health care providers. Healing agreements within the scope of traditional medicine are not currently supported by clarifying the legal requirements of the agreement specifically

    Guru adalah salah satu komponen yang sangat menentukan dalam proses dan peningkatan mutu pendidikan di sekolah. Persyaratan untuk tenaga fungsional guru pembina untuk naik pangkat setingkat lebih tinggi diwajibkanmengumpulkan angka kredit dari pengembangan profesi. Masalah dalam penelitian ini adalah bagaimana implementasi ketentuan kenaikan pangkat tenaga fungsional guru?. Metode pendekatan yang digunakan pendekatan yuridis normatif dan pendekatan  empiris, data yang diperoleh diolah dan dianalisis secara yuridis kualitatif.Hasil penelitian menunjukkan bahwa  implementasi kenaikan pangkat guru dari pembina (IV/a) ke Pembina TK.I (IV/b) belum dapat berhasil sepenuhnya karena faktor sistem koordinasi yang dilakukan oleh dua instansi yaitu Dinas Pendidikan Kabupaten/Kota/Propinsi dan Departemen Pendidikan Nasional yaitu pada satu sisi pembagian tugas, penempatan dan promosi dilakukan oleh pihak Dinas Pendidikan Kabupaten/Kota/Propinsi, sedangkan penilaian atau penetapan angka kredit dilakukan oleh Departemen Pendidikan Nasional.Sebagai saran penulis adalah dalam pelaksanaan kenaikan pangkat guru jalur birokrasi dipersingkat agar proses penetapan angka kredit tidak terlalu lama

    Dalam rangka meningkatkan Pendapatan Asli Daerah Kota Metro. Salah satu perangkat daerah yang memiliki kewenangan dalam melaksanakan Peraturan Daerah adalah Badan Pendapatan Daerah Kota Metro. Permasalahan penelitian adalah bagaimana implementasi Pasal 3 Peraturan Daerah Kota Metro Nomor 02 Tahun 2012 tentang Pajak Daerah Pendekatan masalah pada penelitian ini adalah pendekatan yuridis normatif dan empiris. Pengumpulan data dengan studi pustaka dan studi lapangan dan data dianalisis secara kualitatif. Hasil penelitian ini menunjukkan bahwa implementasi Pasal 3 Peraturan Daerah Kota Metro Nomor 02 Tahun 2012 tentang Pajak Daerah dilaksanakan oleh Badan Pendapatan Daerah dengan cara memperluas tax-base pajak hotel dan melakukan sistem penarikan pajak door to door, yaitu dengan melakukan penagihan dengan mendatangi wajib pajak hotel secara langsung, melakukan reidentifikasi mandat organisasi dan melaksanakan pemungutan pajak hotel sesuai Standar Operasional Prosedur melalui program intensifikasi dan ekstensifikasi pajak. Saran untuk meningkatkan pajak hotel yaitu memperluas tax-base pajak hotel dengan cara melakukan pendataan kembali objek pajak hotel yang telah ada, meningkatkan motivasi pegawai dengan cara memberikan imbalan kepada pegawai yang berprestasi

How the Implementation of North Lampung Regency DPRD Regulation No. 16 of 2014 on the Procedure of North Lampung Regency DPRD In Making Local Regulation, Factors that become obstacles for the DPRD in carrying out its role in the process of making local regulations, Efforts made by DPRD Kabupaten Lampung Utara To overcome the obstacles that exist in carrying out its duties and roles in the process of making local regulations. The method of research is the method of Juridical Normative and Juridical Empirical approaches, with data sources taken are secondary data and primary data, then analyzed qualitatively. Implemetation of North Lampung Regency  DPRD  Regulation  No.  16  of  2014  on  the  Procedure  of  North  Lampung Regency DPRD in making the regional regulation that is, the role of Local Legislation Body in making the local regulation either comes from local government and also the initiative of DPRD. It is expected that the DPRD members of North Lampung Regency can  better  understand  the implementation  of  the DPRD Code of  Conduct  in  local regulation making, following technical guidance related to the improvement of human resources capacity of DPRD members, the provision of experts, the role of political parties to be more selective in the recruitment process of candidates
