ISTINBATH NUSHUS AL-SUNNAH MELALUI PENDEKATAN TEKSTUAL DAN KONTEKSTUAL
Muslims agree that the Sunnah or Hadith is the source of Law in Islam, in particular the authentic hadith which is undoubtedly the end. But it appears that some of the practices of Muslims in the past seem dissimiliar by the authentic Hadith itself. Such things can be found and traced to various books of fiqh whether it is classical or contemporary. To answer this phenomenon, a search on the approach used by the fuqaha' in the formulation of Islamic law, among which is most important is a textual and contextual approach. Then what does this textual and contextual approach mean? How do the jurists' formulate the law of the hadith based on these two approaches? Simply put, the textual approach is the legal istinbath based on a text of a hadith, while the contextual is instinbath of law based on qarinah or an indication that there is another meaning of the text of a hadith. In his application, the fuqaha' compares the order of command and prohibitions shigat in a hadith with indications indicating the existence of a specific purpose that imposes or abolishes the commands and prohibitions. If the order or prohibition is considered strong and clear, then it becomes a law enforcement. On the contrary, if an indication indicates a more specific purpose, then that is the purpose of the law enforcement

This article is related to politicians’ ziarah act to TarekatNaqsyabandiyah Babussalam (TNB). TNB is a phenomena that isalways related to political moment such as regional election and legislativeelection. The phenomena is important to be showed about how localpoliticians’ ziarah act in TNB. This articles’ objective is to answer thequestions have been proposed. As long the research has been done, can befound that local politicians’ ziarah act in TNB is to get the master’spraying and members’ praying. In ziarah activity there are reciting Yasin41 and praying in front of the founder’s funeral. RELASI GENDER DALAM RITUAL KENDURI BLANG PADA MASYARAKAT PETANI DI GAMPONG SUKAREJO LANGSA
Tulisan ini membahas relasi gender dalam ritual kenduri blang denganstudi kasus pada masyarakat petani muslim di Gampong SukorejoLangsa, Aceh. Data etnografis yang digunakan untuk penulisan inidikumpulkan melalui observasi dan wawancara semi terstruktur yangdilakukan pada Maret – Juni 2014. Observasi dilakukan terhadapprosesi pelaksanaan kenduri balang di Sukorejo, dan wawancaradilakukan terhadap enam orang laki-laki dan perempuan yang terlibatdalam prosesi tersebut. Tulisan berargumen bahwa tradisi kenduri blang(kenduri sawah) yang dilakukan masyarakat petani muslim diSukorejo tidak selalu menggambarkan subordinasi perempuan dalamtradisi ritual keagamaan. Tulisan ini akan menantang pandangan yangmengatakan perempuan dalam ritual keagamaan Islam berada padaposisi yang subordinat, dengan menunjukkan bahwa dalam masyarakatmuslim di Sukorejo, pembagian peran antara laki-laki dan perempuandalam prosesi ritual kenduri blang sama setara signifikansinya terhadapkesuskesan kegiatan. Temuan ini menegaskan bahwa laki-laki danperempuan dalam masyarakat petani muslim di Sukorejo tidak padaposisi saling mensubordinasi antara satu sama lain
SISTEM PENGELOLAAN ZAKAT (KAJIAN TERHADAP QANUN PROVINSI NANGGROE ACEH DARUSSALAM NOMOR 7 TAHUN 2004)
Zakat merupakan suatu kewajiban agama yang diwajibkan oleh orang-orang muslim yang digolongkan sebagai muzakki menurut ketentuansyari’at Islam. Zakat harus berperan secara maksimum dalammemberdayakan ekonomi umat, maka zakat haruslah dilaksakan olehsetiap negara Islam sesuai dengan perintah al-Qur’an dan al-Hadits. DiIndonesia, meskipun mayoritas penduduknya beragama Islam, kegiatanperzakatan belum berjalan secara optimal, sehingga manfaat atauhikmah yang terdapat pada program zakat itu sendiri belum maksimal.Pembentukan lembaga Baitul Mal tersebut merujuk pada QanunNomor 7 Tahun 2004. Dalam qanun tersebut telah diatur berbagaiteknis pelaksanaan pengelolaan zakat, sehingga bila terjadipenyelewengan dalam pengelolaannya, petugas akan dikenakan sanksihukum
PERKEMBANGAN PESANTREN DARI TRADISIONAL KE MODERN
Pesantren merupakan lembaga pendidikan tertua asli Indonesia.Pada awalnya pesantren ini memakai sistem pendidikantradisional, dari kurikulum, metode, sampai kepada sistempendidikannya. Seiring perkembangan zaman pesantren yangdikenal dengan sistem pembelajaran tradisionalnya, dianggaptidak mampu lagi menghadapi perkembangan zaman. Untukmenjawabnya pesantren melakukan perubahan-perubahan yangdalam skala terbatas untuk menjamin keberlangsungan danketahanan pendidikan yang diselenggarakannya. Perubahan darisistem pendidikan salafiah menjadi khalafiyah. Pesantrenkhalafiyah (modern) yang mengadopsi sistem madrasah atausekolah yang memasukkan pelajaran umum dalam kurikulummadrasah yang dikembangkan, atau pesantren yangmenyelenggarakan tipe sekolah-sekolah umum

POLA PENYELESAIAN KEKERASAN DALAM RUMAH TANGGA DALAM PERSIDANGAN
Undang-Undang No 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga atau KDRT dan Undang-Undang No 23 Tahun 2002 tentang Perlindungan Anak ternyata belum mampu menjadi benteng pemerintah untuk menyelamatkan perempuan dan anak-anak dari prilaku kekerasan. Berdasarkan data Tahunan Perkara dari Mahkamah Syar'iyah Pidie Jaya, perkara masuk dalam tahun 2016 mencapai 278 perkara. Dari jumlah itu, salah satu perkara yang ditangani lembaga itu adalah perkara kekerasan dalam rumah tangga (KDRT) yang mana perkara jumlahnya mencapai 108 perkara. Beranjak dari uraian ini, penulis merasa perlu adanya penelitian tentang konsep Hukum Islam mengenai penyelesaian kekerasan dalam rumah tangga dan bagaimana penyelesaian yang ditangani Mahkamah Syari’ah Meureudu Pidie Jay
The Contribution Of Waqaf Properties Toward Acehnese Dayah’s Educational Empowerment
Waqaf, throughout the Islamic history, serves tremendous dedications to sustain the Islamic development. For almost one and half millennium, waqaf is one of the key success factors in supporting the Islamic education. In the context of Aceh, waqaf has widely been used to fund the traditional institutions of education (Dayah). This study intent to examine the roles of waqaf properties in supporting the educational development, how dominant is the waqaf system has been perceived as an important function in Acehnese Dayah, and whether the spirit of generosity among Acehnese towards the Islamic education is reflected through the waqaf tradition. This research based on the interview sessions with the principal leaders of Dayahs in three different regions where the largest number of Dayah is found.
The results of the study showed that Waqaf has played the significant roles in supporting the Islamic traditional education or dayah in Aceh, and become the important source for many dayah since waqaf properties are utilized for the purpose of facilitating, enhancing and achieving the educational processes towards the student development. Besides, waqaf system has been also perceived its important function in funding the dayah institutions via four ways; providing the infrastructure facilities of the Dayah, supporting the principal, teachers and other dayah educational staffs in conducting the teaching learning processes, managing the programs and activities, controlling and evaluation the rules and strategies towards better student’s achievement, preparing the financial assistance to the teachers and tutors, and by handling the daily operational cost of these institutions. The findings also mentioned that the Acehnese generosity towards the Islamic education has been reflected by community as their dedications through the waqaf donations. As the territory that the Islamic Sharia is implemented, waqaf should be reactualize in maximaling its contribution towards better educational development in Aceh
