    Untuk menjaga demokrasi negara Indonesia dan kedaulatan rakyat, pemilihan umum menjadi sangat penting. Para peneliti telah melihat sistem proporsional tertutup sebagai solusi yang mungkin untuk pemilu 2024 karena fenomena ini. Sebenarnya, bagaimana siasat fikih dan audit yuridis wacana kerangka relatif dekat dalam putusan politik 2024? Mengingat sifat dan sumber bahan yang sah, penelitian ini menggunakan eksplorasi subyektif dengan pendekatan maqashid syariah fiqh muamalah. Hal itu dibuktikan dari hasil penelitian. Balapan Indonesia 2024 harus dilakukan mengingat hasil penilaian yang mendalam atas keputusan beberapa periode ke belakang. Mulai dari perintah yang dilindungi, sistem berbasis suara, pemerasan, biaya politik, rencana pengeluaran keputusan politik dan kebebasan bersama. Sistem yang ada saat ini dikhawatirkan hanya akan memperburuk demokrasi, kedaulatan rakyat, dan kecerdasan politik. Sistem tertutup dengan konvensi internal partai yang kaku harus dilawan dengan proporsionalitas terbuka. ABSTRACK In order to safeguard democracy Indonesian state and the sovereignty people, general elections are crucial. This peculiarity has provoked scientists to look at a shut relative framework as an answer in the 2024 election. Actually, how is fiqh siasat and juridical review of closed proportional system discourse in the 2024 election? Based on the nature and sources of legal materials, this study uses qualitative research using the maqashid sharia fiqh muamalah approach. That is demonstrated by the findings of the research. The 2024 Indonesian races should be done in view of the consequences of an exhaustive assessment of the decisions for a few periods back. Beginning from protected orders, a vote based system, extortion, political expenses, political decision spending plans and common liberties. It is feared that the current system will only worsen democracy, people's sovereignty, and the people's political intelligence. Open proportionality must be improved, and a closed system with strict internal party conventions should be discussed

    The Urgency of Rehabilitation in the Utilitarian Paradigm to Punishing Narcotics Addicts

    Rehabilitation for narcotics abusers is a recovery method that needs to be carried out by prisoners who are categorized as addicts and victims of narcotics abuse. Rehabilitation is part of the use of utilitarian principles. The purpose of this research is to analyze the urgency of implementing rehabilitation for drug addicts and to analyze the rehabilitation of narcotics addicts in the utilitarian paradigm. This research is a type of normative juridical research to examine the urgency of implementing rehabilitation for narcotics addicts in a utilitarian paradigm. Even though articles regarding the implementation of rehabilitation have been regulated, enforcement of the law remains rare, creating the impression of selective logging in its implementation. Therefore, it is essential to scrutinize whether the implementation of rehabilitation for narcotics users aligns with the provisions of the Narcotics Law and the norms outlined in the relevant articles. The benefits that people with drug addiction get from rehabilitation are in the form of detoxification and social rehabilitation, which are designed to facilitate the user's reintegration into regular life, along with the following stages of treatment. Thus, regarding the benefits for the Indonesian state, providing rehabilitation for narcotics addicts is believed to be able to reduce the number of narcotics trafficking itself

    Government Regulation Substituting the Law on Job Creation in the Perspective of Constitutional Law

    The debate over the Government Regulation in Lieu of Law on Job Creation has not ceased even though it has become an official law. Pros and cons persist due to its perceived deviation from Constitutional Court Decision Number 91/PUU-XVIII/2020, issued on November 25, 2021. This research aims to describe that regulations should not contradict one another, especially when there is already a Constitutional Court decision. Regulations should be made through a legitimate process without resorting to legal shortcuts. The research method used is a normative legal research with a qualitative approach. There is ample time available to follow the proper legislative process, yet shortcuts are taken by issuing Government Regulations in Lieu of Law, which are later ratified as laws. The research implies that despite the enactment of these regulations, there is significant resistance due to their divergence from the judicial review results at the Constitutional Court. As a result, this research suggests the necessity of revising relevant laws to include sanctions for failing to comply with Constitutional Court decision

    Kuantitas partisipasi masyarakat pada Pemilihan Umum 2019 mengalami peningkatan dibandingkan dengan Pemilihan Umum 2014, yaitu 81,95% dari batas target 77,5%. Tingginya kuantitas partisipasi masyarakat pada Pemilihan Umum Serentak 2019  ini juga ternyata diikuti oleh tingginya angka surat suara tidak sah pada pemilihan legislatif. Kalimantan Selatan mencatat surat suara tidak sah sebanyak 44.305 atau 30,88% dari total 2.370.0469 pemilih. Surat suara tidak sah di Kalimantan Selatan didominasi oleh surat suara Dewan Perwakilan Daerah untuk pemilihan Kabupaten Hulu Sungai Tengah. Penelitian ini bertujuan untuk menganalisis sosialisasi dan pendidikan pemilih KPU HST, menganalisis pelaksanaan pemasaran politik kandidat DPD Dapil Kalsel dan menganalisis pelaksanaan pemilu yang ideal sebagaimana terdapat dalam Undang Nomor 7 Tahun 2017 tentang Pemilu dan PKPU Nomor 10 tahun 2018 tentang Sosalisasi dan Pendidikan Pemilu. Jenis penelitian yang dipakai adalah yuridis empiris dengan pendekatan deskriptif-analitis. Pengumpulan data primer dan sekunder dilakukan dengan observasi dan dokumentasi. Sedangkan lokasi penelitian yaitu di Kabupaten Hulu Sungai Tengah Provinsi Kalimantan Selatan. Hasil penelitian ini menunjukkan bahwa sosialisasi dan pendidikan pemilih oleh KPU telah melaksanakan tahapan-tahapan sosialisasi sebagaimana Undang Nomor 7 Tahun 2017 tentang Pemilu dan PKPU Nomor 10 tahun 2018 tentang Sosalisasi dan Pendidikan Pemilih. Pelaksanaan pemasaran politik oleh kandidat DPD RI Dapil Kalimantan Selatan dilakukan dengan tiga cara, yaitu push markeing, pull marketing dan pass marketing. Pelaksanaan sosialisasi oleh KPU dan DPD Dapil Kalsel telah dilaksanakan sebagaimana PKPU Nomor 7 tahun 2017 tentang Pemilu. Data surat suara tidak sah pemilihan presiden lebih kecil daripada DPD menunjukkan masyarakat Kalsel lebih terbawa euforia pemilihan eksekutif. The quantity of community participation in the 2019 general elections has increased compared to the 2014 general elections, which is 81.95% of 77.5%. The high quantity of community participation was also followed by the high number of invalid ballots in the Indonesian legislative election . Invalid ballots in South Kalimantan are 44,305 or 30.88% of a total of 2,370,0469 voters dominated by the Indonesian legislative election for the Election of Hulu Sungai Tengah Regency. This study aims to analyze the socialization and education of voters by the HST KPU, analyze the implementation of the political marketing of the South Kalimantan DPD candidates and analyze the implementation of the ideal election Law Number 7 of 2017 law about Elections and PKPU Number 10 of 2018 law about Election Socialization and Education. The type of research used is empirical juridical with a descriptive-analytical approach. The collection of primary and secondary data is done by observation and documentation. While the research location is in Hulu Sungai Tengah Regency, South Kalimantan. The results of this study indicate that voter socialization and education by the KPU has carried out the stages of socialization in accordance with Law Number 7 of 2017 law about Elections and PKPU Number 10 of 2018 regarding Voter Outreach and Education. The implementation of political marketing by the DPD RI Dapil South Kalimantan candidates is carried out in three ways, namely push marketing, pull marketing and pass marketing. The implementation of socialization by the KPU and DPD Dapil of South Kalimantan has been carried out in accordance with PKPU Number 7 of 2017 law about Elections. Data on invalid ballots for the presidential election is smaller than for the DPD, indicating that the people of South Kalimantan are more carried away by the euphoria of the executive elections

    Strengthening Anti-Money Laundering Framework in Online Banking: Bank Indonesia's Initiatives and Countermeasures

    Several types of illegal finance practices, including money laundering, can significantly result in a negative effect on the economy or government finances of a country. It is also extremely harmful to the society at large. This study was conducted to shed light on the government's efforts to curtail the illegal use of Internet banking, focusing on Bank Indonesia in particular. This article employs normative legal research as its methodology. According to research, the implementation of the Money Laundering Law regarding the prevention of money laundering in the online banking system resulted in the establishment of a special work unit in accordance with Bank Indonesia Circular No. 11/31/DPNP dated November 30, 2009. Additionally, financial institutions must develop Customer Due Diligence (CDD) and Enhanced Due Diligence (EDD) procedures. CDD refers to the procedures used by a financial institution to verify the identity of customers and business transactions before engaging with them. A comprehensive CDD method known as EED is required by the bank due to the elevated risk of money laundering and terrorist funding in its customer relationships. As the executor of the anti-tipping-off mechanism, the bank must protect the privacy of the customer's reporting information. Financial institutions are required to have a comprehensive information management system that enables the detection and assessment of suspicious funds to prevent money laundering

    Understanding the Pattern of International Migration: Challenges in Human Rights Protection

    International Migration can be described as the movement of people from one country to another county. The International Migration is one of the dynamic historical events, which was first legally regulated through the Tanzimat in the Ottoman Empire, signed on the 09 March 1857, which give the people who under the religious prosecuted legal permit to enter Turkey territory. Since then, the mass movement of the people between people becoming very common, especially after World War I, and World War II, when millions of people are moving from one region to another because of the displacement and violence. By utilizing Mixed Migration Center Dataset in 2019, which interviewed 9754 respondents, and the Mexican Government data on Migration in the year 2016, the main pattern of migration and motives are tracked and analyzed. It can be concluded, if the pattern of the migration is from East Africa to North Africa, East Africa to North Africa, East Africa to Southern Africa, East Africa to Europe, the Middle East to Europe, the Middle East to southeast Asia (Indonesia, Malaysia, and Thailand), Bangladesh/Myanmar to Malaysia, and from South America to North America. The motives are economics, Violence and General Security, and Lack of Rights. Still, International Migrants protection becoming a big challenge for many destination countries. From the analysis, can be concluded if the challenges in International Migrants Protection are because of the difference in terms, not all of the destination countries ratified the 1951 Convention about refugees and 1967 protocol as the legal basis and cultural and political context which make society in the destination countries refusing the International MigrantsInternational Migration can be described as the movement of people from one country to another county.     JARIMAH PEMERKOSAAN DALAM QANUN JINAYAT ACEH PERSPEKTIF FEMINIST LEGAL THEORY

    The Qanun Jinayat (Islamic criminal code bylaw) in Aceh has often received criticism from various groups, especially those working on the issue of protecting women and children against sexual violence, including rape, for often harming women rather than accommodating their interests. Article 52 paragraph (1) becomes a stumbling block for female victims of rape to report the crime they experienced because it requires the victim to prepare sufficient preliminary evidence. This is considered a form of discrimination against female rape victims because it multiplies their burden. Using feminist legal theory, this study investigated the structure of injustice that underpins discrimination against women in the construction of legal norms for rape (articles 48-56) of Qanun Jinayat Aceh. A philosophical approach is used in the research to examine in depth the legal norms of rape in the Qanun a quo, especially in the axiological aspect. This study found a link between aspects of masculinity and understanding of religion that supports the structure of injustice in the Qanun Jinayat Aceh which has implications for the emergence of difficulties faced by female victims of rape to access justice. The difficulties faced by female rape victims reflect efforts to perpetuate masculine domination with an interest in making women always languish in the prison of injustice. Due to the lack of efforts to fight for women's access to justice, the construction of legal norms for rape crimes even more echoes the critical legal feminist assumption regarding law as a means of subjugation to women. Instead of empowering, the Qanun a quo further perpetuates female subordination and rape. Qanun Jinayat Aceh acapkali mendapat kritik dari berbagai kalangan, khususnya yang bergiat dengan isu perlindungan perempuan dan anak berkaitan dengan jarimah pemerkosaan yang kerap merugikan perempuan ketimbang mengakomodir kepentingan mereka. Pasal 52 ayat (1) menjelma tebing yang tinggi bagi perempuan korban pemerkosaan untuk melaporkan kejahatan pemerkosaan yang dialaminya karena mewajibkan kepada korban untuk menyiapkan bukti permulaan yang cukup. Hal demikian merupakan wujud diskriminasi terhadap perempuan korban pemerkosaan karena melipatgandakan beban mereka, menggunakan feminist legal theory penelitian ini akan menelaah struktur ketidakadilan yang menopang diskriminasi terhadap perempuan dalam konstruksi norma hukum Jarimah Pemerkosaan (pasal 48-56) Qanun Jinayat Aceh. Pendekatan filosofis digunakan dalam penelitian untuk menelaah secara mendalam norma hukum Jarimah Pemerkosaan dalam Qanun a quo, khususnya pada aspek aksiologis, penelitian ini menemukan kait kelindan aspek maskulinitas dan pemahaman terhadap agama yang menopang struktur ketidakadilan dalam Qanun Jinayat Aceh yang berimplikasi pada kemunculan segenap kesulitan yang dihadapi perempuan korban pemerkosaan untuk mengakses keadilan. Kesulitan yang dihadapi perempuan korban pemerkosaan mencerminkan upaya untuk melanggengkan dominasi maskulin yang berkepentingan untuk membuat perempuan senantiasa mendekam dalam penjara ketidakadilan. Lewat minimnya upaya untuk memperjuangkan akses bagi perempuan atas keadilan, konstruksi norma hukum jarimah pemerkosaan justru semakin menggemakan asumsi feminis hukum kritis perihal hukum sebagai alat penundukan terhadap perempuan. Alih-alih memberdayakan, Qanun a quo justru semakin mensubmisi perempuan dan melanggengkan pemerkosaan

    Analisis Peraturan E-Commerce di Indonesia terhadap Ketentuan Trans Pacific Partnership

    President Joko Widodo stated that Indonesia intended to join the Trans Pacific Partnership (TPP). In international treaties, when a country becomes part of international cooperation, the country is obliged to adjust its national law. The TPP consists of 30 Chapters, where the regulation regarding e-commerce is specified in Chapter 14. If Indonesia becomes part of the TPP, then the domestic e-commerce regulations must be adjusted according to the provisions that apply to the TPP. By employing the normative legal research method, this analysis aims to analyze laws and regulations related to e-commerce in Indonesia and e-commerce provisions in the TPP and identify the gaps between them. The results of the analysis show that if Indonesia joins the TPP, the Indonesian government needs to make adjustments to several regulations, such as Law Number 11 of 2008 as amended by Law Number 19 of 2016; Law Number 7 of 2014) of Law Number 11 of 2020; Government Regulation Number 71 of 2019; and Government Regulation Number 80 of 2019. Presiden Joko Widodo menyatakan bahwa Indonesia bermaksud untuk bergabung dengan Trans Pacific Partnertship (TPP). Dalam perjanjian internasional, ketika suatu negara menjadi bagian dari suatu kerjasama internasional, maka negara tersebut wajib menyesuaikan hukum nasionalnya. TPP terdiri dari 30 Chapter, dimana pengaturan mengenai e-commerce terdapat pada Chapter 14. Apabila Indonesia menjadi bagian dari TPP, maka regulasi e-commerce di dalam negeri harus disesuaikan menurut ketentuan yang berlaku pada TPP. Dengan menggunakan metode analisis yuridis normatif, tulisan ini bermaksud untuk menelaah peraturan perundang-undangan mengenai e-commerce di Indonesia dan ketentuan e-commerce dalam TPP serta menganalisis kesenjangan di antara keduanya. Hasil analisis menunjukkan bahwa apabila Indonesia bergabung dengan TPP, maka pemerintah Indonesia perlu mengadakan penyesuaian terhadap beberapa peraturan dalam Undang-Undang Nomor 11 Tahun 2008 jo. Undang-Undang Nomor 19 Tahun 2016; Undang-Undang Nomor 11 Tahun 2020; Peraturan Pemerintah Nomor 71 Tahun 2019; dan Peraturan Pemerintah Nomor 80 Tahun 2019

    Penelitian ini membahas tentang kondisi sistem legalisasi sertifikasi tanah di wilayah perdesaan. Ketentuan-ketentuan tentang pertanahan yang ada di Indonesia dapat diatur dalam Undang-Undang No.5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria atau biasanya lebih dikenal juga dengan UUPA. Adapun tujuan dari penelitian ini adalah untuk mengetahui faktor-faktor dalam kendala pengurusan sertifikasi tanah dan nilai manfaat sertifikasi, skema dan proses alternatif legalisasi serta menyusun strategi keberhasilan dalam sertifikasi tanah di Indonesia. Hasil analisis menujukkan bahwa faktor yang mempengaruhi seseorang berkeinginan untuk melakukan sertifikasi tanah yang paling dominan adalah dapat menambah nilai objek tanah, mengurangi rasa ketakutan kehilangan tanah, dapat mengurangi sengketa tanah, meningkatkan investasi dan memudahkan akses permodalan. Skema dan kemudahan proses legalisasi dalam sertifikasi tanah diperlukan pemahaman bagi masyarakat untuk memperhatikan persyaratan dokumen sertifikasi tanah, mengetahui kegiatan pengukuran dan pemetaan bidang-bidang tanah hak dan pendaftaran bidang tersebut dalam daftar tanah, serta memfollow up status penerbitan sertifikat petugas BPN. Keberhasilan dalam sertifikasi tanah di Indonesia perlu upaya sosialisasi oleh pemerintah baik dari tingkat Kelurahan, Kabupaten/Kota bahkan dari Pusat agar informasi terkait sertifikasi dapat diterima dan masyarakat mengetahui manfaatnya serta adanya sosialisasi terkait standar pengurusan sertifikat tanah, pembuatan manual book atau tata cara pengurusan sertifikasi tanah untuk dapat didistribusikan pada masyarakat baik dalam bentuk online maupun textbook. This study discusses the condition of the land certification legalization system in rural areas. The provisions on land in Indonesia can be regulated in Law No. 5 of 1960 concerning Basic Regulations on Agrarian Principles or usually better known as UUPA. The purpose of this research is to find out the factors in the constraints in obtaining land certification and the value of the benefits of certification, alternative legalization schemes and processes as well as formulating a strategy for success in land certification in Indonesia. The results of the analysis show that the most dominant factors that influence a person's desire to certify land are being able to increase the value of land objects, reducing the fear of losing land, reducing land disputes, increasing investment and facilitating access to capital. The scheme and ease of the legalization process in land certification requires understanding for the community to pay attention to the requirements for land certification documents, knowing the activities of measuring and mapping parcels of land rights and registering these fields in the land register and following up on the status of issuance of certificates by National Land Agency (BPN) officers. Success in land certification in Indonesia requires socialization efforts by the government from the Village, Regency/City levels and even from the Center so that information related to certification can be received and the community knows the benefits as well as socialization related to land certificate management standards, making manual books or procedures for obtaining land certification. to be distributed to the public in both online and textbook for

    The purpose of this research is to find out about law enforcement regarding the crime of money laundering in Indonesia based on Pancasila, and what are the obstacles faced. This study uses a normative juridical approach, the results of the study state that the crime of money laundering is legally regulated in Law no. 8 of 2010 concerning the Prevention and Eradication of the Crime of Money Laundering. In Article 4 of Law no. 8 of 2010, also imposed on those who enjoy the proceeds of the crime of money laundering which is imposed on any person who hides or disguises the origin, source of location, designation, transfer of rights, or actual ownership of Assets which he knows or reasonably suspects is proceeds of a crime.
