Pendaftaran Merek Produk UMKM Setelah Berlakunya UU Cipta Kerja
Anggapan bahwa merek bukanlah hal yang penting, jangka waktu pendaftaran merek dianggap lama, serta biaya mahal membawa pengaruh banyaknya pelaku usaha UMKM yang belum mengajukan permohonan pendaftaran merek atas produk usahanya. Dengan belum meratanya pemahaman pentingnya merek bagi pelaku usaha UMKM menjadi telaah dalam artikel ini khususnya terkait efektifitas UU Merek dan Indikasi Geografis dan UU Cipta Kerja serta upaya Pemerintah Daerah/Dinas terkait dalam upaya memaksimalkan pentingnya pendaftaran merek sebagai identitas produk bagi pelaku usaha UMKM di Kabupaten Bangkalan. Penelitian ini merupakan penelitian yuridis empiris, menggunakan pendekatan perundang-undangan dan sosiologis serta dianalisis secara deskriptif kualitatif. Hasil penelitian menunjukkan bahwa pihak Pemerintah Daerah/Dinas terkait seperti Dinas Perindustrian dan Tenaga Kerja Bangkalan, serta instansi pemerintah Provinsi Jawa Timur melalui Kanwil KemenkumHAM telah mengupayakan cara untuk menyelesaikan anggapan dan hambatan dalam pendaftaran merek, salah satunya memberikan fasilitas pendaftaran merek secara gratis. Namun demikian masih menyisahkan catatan bahwa UU Merek dan Indikadi Geografis maupun UU Cipta Kerja belum dapat dilaksanakan secara efektif dan maksimal
PERLINDUNGAN HUKUM TERHADAP HAK PENGELOLAAN DAN PEMANFAATAN ATAS TANAH OLEH MASYARAKAT HUKUM ADAT YANG BERADA DALAM KAWASAN TAMAN NASIONAL KELIMUTU
The establishment of the zoning of the Kelimutu National Park by the relevant agencies resulted in the management of the forest area being closed to the access of the Customary Law community as the owner of agricultural/plantation land in Niowula Village, Detusoko District, Ende Regency and this is detrimental to the community. In this regard, this study aims to examine how customary forests are regulated in the versions of regulations before and after the Constitutional Court Decision No. 35/PUU-X/2012. This research is a normative research using a statutory approach. The existing primary and secondary legal materials were then subjected to a qualitative juridical analysis. The results of the study show that the constitution requires conflict resolution to be carried out using a functional approach and a human rights approach, but in fact the use of a human rights approach creates a conflict between the rules under the constitution and the constitution. This requires the government to harmonize regulations because there are still many regulations which are very dominant with a functional approach, and very little use of a human rights approach
Penguatan Rancangan Good University Governance Dalam Pencegahan Korupsi di Perguruan Tinggi
This study aims to analyze the design of good university governance in preventing corruption at the tertiary level and the role of the internal control unit and the university senate in supervising higher education governance. This research is motivated by the rampant acts of corruption committed by officials in the world of education in Indonesia, especially in tertiary institutions. Corruptors in the world of education take advantage of loopholes to commit acts of corruption in various ways, one of which is through goods and services procurement project funds. The research methodology used is a normative juridical method with a statutory approach, a case approach, and a conceptual approach. The novelty in this research is to complement studies conducted by previous studies which only affect student trust and influence in positive terms, without preventing acts of corruption that are often carried out by officeholders in tertiary institutions. The results of the research show that good university governance can help prevent corruption if all the principles of good university governance are implemented or implemented in universities
PENUNDAAN PEMILIHAN UMUM DALAM PERSPEKTIF DEMOKRASI
In the implementation of a democratic state, the implementation of what is commonly called a General Election is needed, especially in representative government. This is because the government’s authority is only obtained with the approval of the governed (the people). Democratic elections are not just simbols, the are competitive, periodic, inclusive and definitive elections. The legality of people’s involvement in the success of democratic parties in Indonesia, as regulated by Article 22 E of the 1945 Constitution of the Republic Indonesia. This research is a normative research, using statute approach and historical approach and analysis using the deductive method. The result of this research is that general elections in Indonesia should be held regularly, continuously and temporarily, especially in a presedential system of government. The consequence is that there is no postponement of the election, considering that the country is not in state of emergency (staatsnoodrecht or noodstaatsrecht). It means that the purpose of this research is to hold elections to fill public positions, namely the President and Vice President, the People’s Representative Council (DPR) and the Regional Representative Council (DPD)
PEMENUHAN HAK ATAS PELAYANAN KESEHATAN MASYARAKAT VIA PENGADAAN BARANG DAN JASA VAKSIN COVID-19 BERBAYAR
Hak Asasi Manusia ( HAM ) atau Human Right merupakan suatu hak yang melekat kepada diri manusia yang dibawa sejak lahir sampai meninggal dunia. Seiring berkembangnya dari hak dasar tersebut manusia memiliki derajat kehidupannya, yang ditentukan oleh derajat pendidikan dan derajat kesehatannya. Sehingga hak mendapakan pelayanan kesehatan merupakan bagian dari penghormatan dari hak dasar. Pengadaan Vaksin Covid-19 secara mandiri atau berbayar bisa dikatakan sebagai pelanggaran Hak Asasi Manusia yang tercantum dalam pasal 9 ayat 3 UU HAM. Tujuan penulisan ini untuk mengetahui dan memahami kedudukan Kedudukan Hak Atas Kesehatan Dalam Pasal 28H ayat (1) UU Dasar Tahun 1945 dan Pasal 9 Undang-Undang Nomor 39 Tahun 1999 Tentang HAM dan Tinjauan Teori Walfare State terhadap pengadaan vaksin covid-19 secara berbayar.Penulisan ini menggunakan pendekatan kualitatif, denga teknik pengumpulan data melalui media sosial dan sumber pendukung lainnya. Hasil penelitian ini menunjukan bahwa kedudukan Hak atas kesehatan didalam UU Dasar tahun 1945 dan Undang-Undang HAM sangatlah tinggi derajatnya sebagai salah satu aspek dalam mempertahankan Hak untuk hidup dan teori walfare state memandang bahwa pengadaan vaksin covid-19 secara berbayar telah melanggar konsep Negara kesejahteraan sebagai Negara yang memiliki tujuan dalam memajukan kesejahteraan umu
MSME EMPOWERMENT POLICY STRATEGY IN ORDER TO DO ACCELERATING OF THE DEVELOPMENT FINANCIAL SERVICES ECOSYSTEM
The post-Covid-19 National Economic Recovery (PEN) is carried out through the synergy of the Government's policies with the Financial Services Authority (OJK), one of which is regarding financing for the Priority Economic Sector, namely MSMEs. The government issued a PEN policy in order to protect, maintain and improve the economic capacity of business actors during the pandemic. On the other hand, OJK is committed to encouraging the development of MSMEs so that they become a buffer for the economy. OJK's steps are committed to maintaining financial system stability. In implementing the policy, of course, there will be challenges and obstacles, therefore the legal issue that will be studied is how the policy strategy can be applied in terms of developing MSMEs in order to realize a financial services ecosystem. The research method used is a normative juridical approach using secondary data in the form of primary legal materials, namely legislation, secondary legal materials, namely journal articles and the results of previous research. Primary data is the result of research conducted using a legal approach, namely through a review of all laws and regulations related to the legal issues being studied. The results of the analysis show that the empowerment of MSMEs in the context of Accelerating the Development of the Financial Services Ecosystem begins with the issuance of policies by the government, namely: the National Recovery Program, the Implementation of the Job Creation Act and its derivative regulations, as well as the Indonesian-made Proud Movement program. In addition, steps to suspend the settlement of MSME obligations or debts for both tax obligations and business loan obligations, and provide loans directly to MSME actors so that they can have sufficient capital to maintain business and encourage the digitization of MSME businesses so that they can continue to operate in conditions where there are social restrictions. Community is a step that is considered to save the existence of MSMEs during the Pandemic
VICTIM IMPACT STATEMENT DALAM SISTEM PERADILAN PIDANA: SEBUAH URGENSI HUKUM
In criminal justice system, the impact of crime suffered by victims is less considered. In international sphere, the consideration of impact suffered by the victim is known as the Victim Impact Statement (VIS). It is geared to determine the importance of VIS in the criminal justice system in Indonesia. This research is a normative legal research with statutory and conceptual approaches. All of the data are collected by using library and online search. Based on the research results, the urgency of VIS regulation is seen from 4 (four) basis, namely: (1) philosophical basis, the value of justice is the right of all people in equal treatment before the law; (2) the juridical basis, the limitations of the rules that explicitly regulate the rights of victims in the trial; (3) the political basis, the government has accommodated the Basic Principles of justice for victims of crime and abuse power 1985; (4) sociological basis, victims often experience injustice, VIS must be regulated to provide opportunities for victims to voice the impact of crimes suffered by them. The regulation of VIS will give space for victim involvement in the judicial process and gaining satisfaction with the judge's decision
KEABSAHAN STABLE COIN DALAM SISTEM PEMBAYARAN TERINTEGRASI
The non-cash payment instrument that is currently widely used is electronic money. The electronic currency that is currently developing is Stable coin as an answer to the obstacles faced by the payment system where it still relies on third parties as payment product issuing companies but regulations still show inconsistencies in the regulation. The research problem formulation in this article is what are the juridical implications for the validity of transactions using stable coins in a payment system that is integrated with a foreign exchange transfer system. The type of research in this article uses normative juridical research with interpretation analysis techniques on legal materials. The results of the study indicate that the use of stable coins for remittance purposes and foreign trade is legal, as long as the parties agree to use stable coins as a closed loop payment instrument in the system. The use of stable coins in remittances is only limited as a means of intermediary for remittances, but if the use of stable coins is limited it will have negative implications for growth supporting institutions of remittances
KEABSAHAN PERINTAH LISAN ATAS PENGHILANGAN WAKTU ISTIRAHAT MINGGUAN DAN UPAH LEMBUR
Overtime pays and work agreements between workers and outsourcing companies are often not enforceable. This study aims to determine the form of legal protection for overtime wages in outsourcing companies and their legal remedies. This research is normative juridical, especially on legal systematics and the level of legal synchronization. The results showed that there must be overtime orders and worker approvals. Overtime work is given after working more than 40 hours/week, a maximum of 4 hours/day and 18 hours/week. Employers are required to provide adequate rest time and minimum consumption of 1400 kilo calories. Guarantees for overtime pay are difficult to apply to outsourcing companies because work orders are given by employers to workers, not based on contracts that workers have made with outsourcing companies.. The legal remedy that can be taken by workers who do not receive overtime pay at the outsourcing company is to conduct bipartite negotiations with the entrepreneur who runs the outsourcing company. If it fails, you can apply for mediation; the lawsuit will be submitted to the Industrial Relations Court
ANALYSIS OF THE SYNERGY CONCEPT IN MANAGEMENT OF TOURISM POTENTIAL BASED ON SYIRKAH MUDHARABAH
This research is motivated by problems that become obstacles in developing the tourism sector. In this regard, the role of investors is needed in assisting in the management of tourism potential by synergizing with local governments. This study uses a normative research method with a statute legal approach to examine the rules governing tourism management in Indonesia, as well as the regulation of syirkah mudharabah; and a conceptual approach to examine the meaning of synergy, syirkah, and mudharabah akads. The results of the study explain that the form of synergy between local governments and investors in managing the tourism sector based on syirkah mudharabah includes 2 (two) forms, namely first, the synergy from the Local Government to investors in the form of providing information to investors regarding infrastructure or other needs that needed in managing tourism potential, reporting the results of coaching and mentoring of Pokdarwis, etc. second, the synergy carried out by investors to the Regional Government, in the form of providing funds following the RAB proposed by the regional government to investors, an investor can provide capital in the form of infrastructure needed by tourist objects
