CHALLENGES AND ALTERNATIVE OF CREATIVITY DEVELOPMENT IN HIGHER EDUCATION
No full textCreativity is the human ability to think, modify, discover and create something. Creativity in the scientific world and the general public is common term. In reality, creativity and human life are two different things, but inseparable, thus affecting and closely correlated. Life and civilization will stagnate and vacuum without creativity. Creativity always presents and appears in the rhythm of space and time as the level of thinking and the human needs. Problems faced by higher education in Indonesia today is the low creativity of both students and lecturers. Those are caused by: (1) creativity is not taught in higher education, (2) the creativity of students is less supported by parents, (3) the leader of higher education considers creativity as a means of damaging the system or existing products, and (4) the routines of lectures and students. In order to develop creativity in higher education, then the leader and lecturers should eliminate bad habits in destroying the creativity of subordinates and students, parents should continue the natural talent of the child, select the child’s social environment, minimize punishment, and do not curb excessively child to “do“ something. No full textIndonesia has the potential of marine and fisheries and a good variety of renewable or not renewable, but in the field fishery optimally still hampered with the rampant practice of catching fish illegally or criminal acts in the field of fisheries. The purpose of this writing is to know the influence of the culture of law in law enforcement criminal acts in the field of fisheries. Writing this type of normative research using secondary data, then the data were analyzed qualitatively-normative, examine the way interpret and construct the statement contained in document per-Act. The results showed that the law is strongly influenced by factors such as, among others: values, attitudes, and the community's view of called with cultures of law. Based on legal cultures which may give rise to differences in law enforcement between the communities that one with other communities. The legal culture is linked to the professionalism of law enforcers in the exercise of his duties, and public awareness in adhering to the law itself. Overall attitudes and values and behavior that determine the applicable law on society. Thus, the construction of the legal awareness should be oriented in an effort to promote the values underlying the legislation in question as well as paying attention to the communication of the ruling factor in order for the contents of such laws can be known by the public at large as the target of the rule of law itself. No full textThe intention contained in laws and regulations concerning the conservation of fish resources is so that there are activities that lead to protection of fish resources as a whole. During this time the utilization of fish resources more dominant done compared to the protection and preservation, so the impact on the aquatic ecosystem. The purpose of this research is to examine international agreements regarding the conservation of fish resources which have been ratified and implemented into other policies and legislation in order to become a guideline in behavior so bring a change in society. This research is a descriptive qualitative using a data source from an earlier study results and document the latest libraries. Results of the study that the conditions of the CCRF (Code of Conduct for Responsible Fisheries) became a legal basis in the formulation of the provisions concerning the management of fish resources responsibly. Sustainable fisheries zone were never regulated in the regulation of the management of conservation areas. The Fisheries Act has yet to implement the provisions of the UN fish stocks agreement of 1995 relating to the conservation and management of fish resources in the ZEE and Indonesia on the high seas. Therefore the Fisheries Act require refinement, considering Indonesia has been a member of two regional fisheries management organization and ratify the UNITED NATIONS Agreement on fish stocks of 1995

No full textThe Principle of the plan revision or amendment Of the Criminal Law Act and LAW No. 8 of 1981 on the law of criminal procedure (Criminal Code) is something that necessarily, because a number of judgments were not in accordance with the conditions of the present. Criminal Code which came into effect in 1915 during colonial times, many judgments which are not in line with people's lives today. For example, the ban showed, offering, or broadcast a preventive tool is pregnant, regulated in article 534 Criminal Code, although that provision had never been repealed as opposed to family planning programs. It's just that, those changes also should look at the reality of the needs of the community, particularly on corruption eradication efforts which should not be weakened. Although the Copyright ACT in recent times revision rule has been loaded but still very narrow so there can take to become a rule of law that can reverse engineer the behavior of society (notably the community of users of copyrighted songs and music) to stick with it.This paper tries to do a review of the literature and the law. The birth of Act No. 28 by 2014 about copyright gives the feel of a broader legal and encouraged to provide protection of economic rights (economic right) over Copyrights in particular Performing Right with an emphasis on fostering recognition of Collective Management Institutions, as well as on Related Rights protection for emphasis that gives economic maximization of existing opportunities of performing actors, producer ponogram, and broadcasters. And thus, created a large corpus of law in the field of Performing Right in Indonesia
