Peran Pemerintah Daerah dalam Menghadapi ACFTA
This article discusses the implementation of Asean-China Fre Trade Area (ACFTA) and its consequences for the Indonesia economy. This article argues that its approval a decade ago, the Indonesian government showed sign of being unprepared to implement ACFTA. Data used in this article show that with the coming into force of ACFTA early 2011, a number of economic sectors have experienced negative growth, leading to the lay off of many workers in many sectors of the economy. To deal with this problem, the authors argue that local government and others stakeholders should be involve in effort to support Small-Scale and Medium Enterprise (SMEs) in strengthening their competitiveness. Doing so, requires local government to rescind various policies on SMEs considered inimical to their operation and adopt more business friendly e policies to support them
Oksimoron "Failed State" Absennya Negara dan BAngkitnya Gerakan Masyarakat Sipil Menyelamatkan Ruang Publik Pasca Erupsi Merapi
This study elucidates on strength of social capital in civil society with respect to effort to preserve public space for natural disaster refugees in light of the deterioration of the ability of the state to accomplish civil rights obligation. The analysis began with a study on the characteristics of a failed state. The state can be categorized as failed state if it fulfills three characteristics which are: 1) the negligence in fulfilling civil rights obligations; 2) the disposition of aggressive behaviors; and 3) the intensification of democracy deficit. On the basis of the failed state paradigm, this o the study subsequently moved toward to the focal point, which was that was divided into three parts. The first part examined the paradigm of basic essence in the national constitution and legislation on disasters, relating to public welfare. The second parts discussed the phenomenon of Mt. Merapi's eruption including the chronology of event which in part was responsible for the large number of refugees. The third pat elaborated on the best practice, which where adopted by Posko Mandiri Kadiosoka, as a forum that was established to deal with relief and assistance and service originally intended to fulfill basic rights of refugees. The erosion of social capital capacity in the long term, coupled with and decline in the role of the state as the basic rights handling disasters has seriously limited the independence of civil society in Posko Mandiri Kadiosoko
Studi Formulasi Kebijakan Perlindungan dan Pengembangan Pasar Tradisional di Daerah Istimewa Yogyakarta
This study attempts to identify the various of the traditional market, which have suffered from marginalization caused by rapid expansion and penetration of modern supermarkets and other large retailers. As a way out, this recommends various protection strategies, which are based on provisions of the constitution and legislation and/or enacting new ones. Providing legal protection to sources of livelihood is common practice in many developed nations, where weak players are shielded from foreign player, and is also evident in other sectors and institutional aspects of the broader economy. The study recommends certain models of traditional markets development, which makes it a source of reference for various parties, market manager, government, local universities, and others
Desentralisasi dan Sistem Pengukuran Kinerja Pemerintah Daerah: Kajian Independen Terhadap Sistem Evaluasi Kemampuan Penyelenggaraan Otonomi Daerah (EKPOD)
Implementation of decentralization in Indonesia, as mandated by Law Number 32/2004, has three main objectives, which include improving the welfare of society, public services, and regional competitiveness. This study holds an assumption the that the importance of Local Government Performance System, both in order to reduce euphoria as well as to ensure the accomplishment of decentralization goals that set out by the law. The ministry of Home Affairs, has developed three local government performance measurement system as mandated by PP Number 6/2008, namely: the evaluation system of new autonomous regions (EDOB), the evaluation of local governance performance system (EKPPD), and the evaluation of regional autonomy capacity (EKPOD). This study assesses the framework and applicability of the EKPOD system. Using data from 17 Districts/ municipal governments, the researcher conclude that EKPOD data are limited. With respect to data availability, these are limited to 2004-2006 period, which is not long enaugh to use in assessing the EKPOD system which requires 5 years in succession. Of the required 175 data units, only 40-60% are available (70-105 data units). These findings and statistical factor analysis, suggest that the number of EKPOD indicators should be reduced to 19 with 25 data elements. This will not only enhance system applicability, but also reduce financial resources needed to establish he baseline data by 86 percent
Meritokrasi VS Politisasi Jabatan Karir dalam Birokrasi Lokal: Sebuah Paradoks Netralitas Birokrasi
This paper attempts to assess various initiatives tailored toward strengthening bureaucratic reform at the local level. Some of the problems which characterize local bureaucracies include low professionalism, domineering influence of local government beads and politicians on key positions in the local bureaucracy. Though not new, the issue is still not accorded the attention it deserves. With respect to relations of the local government heads bureaucracy, there has emerged a tendency of diluting the bureaucratic culture, which has a become more common in the wake of the implementation of government policy in Act No. 32/ 2004 on local government, which allows direct election of local government heads.
Professional bureaucracy emphasizes the importance of legal-rational system of meritocracy. Consistency of merit system should promote fair competition for all. However, the intervention of the local government executives in appointing career members of the local bureaucracy who assume structural position, has hampered efforts at improving the professionalism ideal. Worse still, incumbent local government heads have undermined the neutrality of the local bureaucracy by filling important positions with handpicked political supporters. To that end, bureaucracy in many regions is increasingly being filled with bureaucrats who share affiliations with local government heads. Inevitably, cleavages in the bureaucracy have emerged as fractions are formed that support and appose the incumbent local government head. Consequently, discrimination in treatment occurs within the bureaucracy, which culminates into the promotion and demotion of personnel on the basic of affiliation rather than merit and capability. Enhancing professionalism in the bureaucracy calls for effort to ensure that high ranking officials in the bureaucracy be free from intervention from political pressure groups or politicians officials
Parameter Diskresi Birokratik: Studi Kasus Pemerintah Kota Surabaya dan Kabupaten Situbondo
This study sought to analyze the exercise of bureaucratic discretionary space in the areas of employee affairs in Surabaya Municipality and Situbondo Regency with regards to types of policy underlying the fulfillment of bureaucratic task, consideration underlying the decisions made at those bureaucratic levels, and acceptability of their outcomes. Conformity of discretion types with the types of public policy would promote attainment of policy goals in order for those policies to run effectively. However, capability of bureaucratic official officials in exercising their discretion in accordance with legal, ethical, professional, knowledge, and public interest parameters normatively acceptable was considered low. The available discretionary space was to a considerable extent exercised for "granting" access to other considerations beyond those normative ones, resulting in less acceptable decisions
