    REPRESENTATION AND CAPABILITIES OF NON-MUSLIM CHINESE WOMEN AS REGIONAL HEADS IN SINGKAWANG CITY: A Siyasah Dusturiyyah Analysis

    The phenomenon of non-Muslim Chinese women being elected as regional leaders in Indonesia is considered unusual, especially when elected amid a predominantly Muslim population and the strengthening of Islamist movements in national politics. This article, therefore, analyses the representation and capabilities of non-Muslim Chinese women as regional heads in Singkawang City, Indonesia, from 2017 to 2022. In the Indonesian context, we refer to this case as a “triple minority.” The research used a socio-legal approach involving data condensation, data display, and conclusion/verification stages. The findings of this study indicate that the representation and capabilities of non-Muslim Chinese women as regional heads in Singkawang City from 2017 to 2022 align with the principles of constitutional politics (siyasah dusturiyah) and Indonesian laws. Non-Muslim Chinese women elected as regional heads of Singkawang City, despite being in a Muslim-majority environment, have succeeded in making Singkawang City the top-ranked Tolerant City in Indonesia

    THE DECLINING ASWAJA THEOLOGY KNOWLEDGE PRODUCTION: A Case Study of al-Jam’iyatul Washliyah in Medan City

    Al-Jam’iyatul Washliyah (AW) and Aswaja theology are covered in this article. As a religious institution, AW acknowledges Aswaja’s ideology as the foundation for its mission. To maintain and develop Aswaja theology, AW utilizes educational institutions and recitation of the kitab kuning (yellow book) as a knowledge production for Aswaja theology. A question concerning the state of educational institutions today and the recitation of the Yellow Book at AW in Medan City was posed in order to comprehend the information presented. A case study about AW in Medan City is the qualitative research methodology that is employed. In addition, leaders, religious authorities, educators, and AW-related documents make up the primary  data source. According to his research, educational institutions that regularly support Aswaja books undergo internal changes and come to terms with the reality that teachers, or ustadh, are becoming less and less proficient in the classics. Additionally, a number of the study’s leaders””who were specialists in classic literature””passed away, which caused a setback to the kitab kuning study. Thus there was a downturn in the study of the kitab kuning. The results verify the weakening of the apparatus in AW that produces Aswaja theology

    Religious Moderation of Millennial Generation at Islamic Higher Education in Eastern Indonesia

    This research examines the religious moderation of the millennial generation in Islamic Higher Education in Eastern Indonesia and identifies the most dominant factors contributing to religious moderation. Cross-Sectional Study (CSS) method measures religious moderation through four pillars at the same time: national commitment, religious tolerance, conflict avoidance (non-violence) and accommodation of local culture. The respondents of this research are   millennial generations studying at the Islamic Higher Education in Eastern Indonesia. This research used the Consecutive Sampling with a total sample of 592 people. The research results show that religious moderation among millennial students in Eastern Indonesia is categorized as low concerning national commitment, religious tolerance, avoiding conflict (non-violence), and accommodation of local culture. The most dominant factors influencing the religious moderation of the millennial generation are social media and religious extra-campus curriculum.

    Lesbian, Gay, Bisexual, and Transgender (LGBT) campaigns on various social media are getting more massively echoed by pro-LGBT groups. The LGBT community channels their creativity and expression to gain recognition and acceptance from netizens through Instagram, Tiktok, and other social media. Responding to this phenomenon, Indonesia, as a Muslim-majority country, in article 85 of the Family Resilience Bill, defines LGBT as an act of sexual deviance. As the science of law in Islam, Fiqh does not only talk about the halal and haram of a job. Law provisions prevent deviations from the occurrence of human roles and functions based on their nature. Thus, the authors examine the construction of fiqh law to prevent and raise the grasp of Lesbian, Gay, Bisexual, and Transgender (LGBT) people on social media. This study employed a sociological approach to Islamic law based on phenomenological and literature studies. The results of this study indicate: (1) massive campaigns and LGBT hegemony in social media harm the sociocultural orientation of future generations, (2) the legal construction of fiqh al-ḥaá¸arah as a solution in providing awareness and prevention of LGBT campaigns on social media, (3) there is a spirit of collaboration between the concept of fiqh al-ḥaá¸arah and positive law in Indonesia in preventing and arousing LGBT campaigns in social media

    Religious Moderation in Constantinople in the Resolution of Political Conflicts in the 14th Century

    The Islamic conquest of Constantinople in the 14th century is a captivating historical episode in history that continues to intrigue historians. It stands out due to the involvement of two major world religions - Islam and Christianity. Furthermore, this conquest marked the end of the Roman civilization. One notable aspect of this conquest was the harmonious relationship between Muslims and Christians, which persisted before and after the event. This study aims to explore the implementation of religious moderation in Constantinople to resolve political conflicts. Adopting a historical methodology, the research collects data through extensive documentation and literature studies, employing a socio-political approach. The findings highlight that religious moderation played a crucial role in conflict resolution during the 14th century in Constantinople. The concept of religious moderation was not only applied before the conquest, but also after it. Before the conquest, the value of moderation was demonstrated through peaceful negotiations between the Islamic kingdom and the Catholic prelate in Rome. Several treaties were agreed upon, emphasizing the importance of faith and peaceful dialogue over resorting to military confrontation. Following the conquest, Sultan Muhammad al-Fatih exemplified religious moderation by engaging in negotiations with the inhabitants of Hagia Sophia. They agreed an agreement allowing Christians to continue practicing their faith despite being under Islamic rule. Additionally, al-Fatih displayed respectful treatment towards the prelate and Christian warlords, further exemplifying the value of moderation.     ECO-SPIRITUAL BASED ON MAQA>S}ID AL-SHARI>'AH: The New Relationship of Man with the Environment

    Theoretically, Islamic doctrines can adapt to the situation and conditions of reality. However, in Islamic history, it isn't easy to find studies about the importance of establishing a relationship with nature or the environment in which that reality stands. This research offers a paradigm that bridges the new relationship between humans and the environment. At this level, the author builds a paradigm with a multidisciplinary approach. Methodologically, maqa>s}id al-shari>'ah is used as a paradigm foundation and umbrella for human actions when responding to their environment. This study found that the maqa>s}id al-shari>'ah-based eco-spiritual paradigm is embodied in spiritual actions in the form of sacralization and ecological contemplativeness. Explicatively, sacralization and ecological contemplativeness are applied based on the principles of Islamic ethics, al-insija>m (harmony), al-iqtis}a>d (equality), al-ta'a>nu>q (interdependency), and al-tanz}i>f (cleaning).

    IDEOLOGIZATION OF MBRAKAH IN MAINTAINING INDONESIA SUSTAINABLE FOOD SYSTEM: Extracting From Pesantren’s Values and Prophetic Tradition

    Originally, mbrakah was a practice of food combining or food custom for spiritual purposes. The mbrakah tradition also can be categorized as 'food fashion.' In the global academic discourse, food culture and spirituality are important issues with strong traditional roots in Sufism and prophetic traditions, especially in Sufism. Particularly, mbrakah is even more unique because it is rooted in Sufism traditions and early Islamic norms and has been in dialogue with local wisdom, namely Indonesian Culture and, more specifically, Pesantren culture. One of the oldest Islamic educational institutions in Indonesia. In this article, We conceptualize that the mbrakah tradition does not merely stop as a food-combining tradition only carried out for personal interests. Based on the literature review, we argue that mbrakah can be transformed from theology to food ideology. Although the ideology referred to in the article is not an ideology in a complex sense, it can be a way of thinking and manifested into a movement and shared awareness about the importance of successful food diversification for food security during food problems in Indonesia. Mbrakah is a local culture and holds a religious dimension that many researchers consider, and it has the potential to be highly effective as a transformative movement.

    The Resistance of Palembang’s Local Religious Elites to Dutch East Indies Islamic Politics in the 20th Century

    The 19th century was the peak of the mission era and the beginning of the 20th century was the period of independence of the Protestant Church by inviting various missionary organizations from Europe to carry out their missions in the Dutch East Indies. This was a major threat to Muslims, including Palembang Malay Muslims. This article seeks to complement existing research with the aim of knowing the resistance factors of local elites in the Palembang Malay community. This study uses a socio-historical approach by making use of James C. Scoot’s resistance theory. Scoot’s theory of resistance. This study concludes that the resistance of local elites in Palembang Malay society is caused by the central role of local religious elites in preaching and teaching the Muslim community in Palembang to remote areas. The elites a r e in the category of free ulama. Figures such as Abdullah Munsyi and the Samaniyah tarekat teachers who made various efforts to save Muslims from Islamic politics run by the Dutch East Indies. Efforts were made such as the construction of various places that served as centers of Islamic studies such as langgar, mosques, and madrasas

    TRANSFORMATION OF IJARAH CONTRACT: The Review of The Concept and Its Implementation in Islamic Banking

    Innovations in sharia banking products and services in Indonesia continue to experience significant developments. This is important to do to answer the needs of recent financial transactions. Various financing products with various contracts have been applied by Islamic financial institutions. One of the products developed is ijarah-based financing. However, different viewpoints regarding the legal validity of ijarah with its various types are still being discussed among academics and practitioners. The concept of ijarah itself was practiced in early Islamic era and continues to be practiced today in various contemporary financial transactions. This study aims to review the process of transforming ijarah principles to the development of their varieties, as well as related legal and regulatory provisions as a basis for implementation in the development of financing products in Islamic banking and finance. This research was a qualitative research using a literature study approach with descriptive analysis. This study concludes that several texts from the al-Qur'an and Sunnah explain the concept of ijarah and its permissibility according to sharia. Nash explains at least two types of ijarah, namely ijarah in service and asset leases. Both were revealed in the provisions contained in the KHES, PBI, as well as several DSN MUI fatwas. These regulations form the basis for implementing ijarah, IMBT, and IMFD in various sharia banking products and services

    Ta’awun Siyasi and Winning the Election Fiqh Siyasi Perspective and Political Party Elites

    This study explains the meaning of ta’awun siyasi (political cooperation) which is usually carried out by party elites ahead of executive elections. Party elites see ta’awun siyasi not just an election rule but part of a political strategy to boost party votes during elections. In fact, there is great hope from ta’awun siyasi, but the results sometimes don’t go as desired because the impact of the coalition’s tail coat is not worth the energy expended. On the other hand, there is a communication ethic that is sometimes overlooked in addition to neglected siyasi  fiqh  norms.  The  main  problem  of  this  research  study  is how to reconcile the essential meaning of ta’awun siyasi with the ethics of coalitionalism in the style of party elites while still upholding  the  principles  of  democracy  and  siyasi  fiqh  with  the historical basis of the 2019 election coalition as a reference for the upcoming 2024 election. This study is a qualitative research that is descriptive in nature describing material objects with an analytical  knife  from  the  theory  of  democracy  and  fiqh  siyasi. The main data sources are interviews, questionnaires and other documents. The results of the study found that the true meaning of ta’awun siyasi describes sincerity and sincerity, partiality for the good  and  benefit  of  the  public  even  though  sometimes  political party elites are more entangled in purely pragmatic interests. The main principles of fiqh siyasi such as the concepts of siyasa ”˜adilah, haibah siyasasiyah, istishlah al-’ammah, siyasat al- dunya wa hirasat al-din must become a frame in building group communication
