    The prohibition on the use of veils in some campuses raises the pros and cons in the community, coupled with the many khilafiyah debates regarding the law on the use of veils. The identification of the problem in this article is first how the law of the use of veils in Islam, secondly whether the prohibition on the use of veils on campus violates the principle of equality before the law. The method used is juridical normative with comparative approach method and conceptual approach. The writing specifications used are descriptive analytical. The results of this paper are Basically, the use of legal veils is permissible. Related to the ban on the use of veils on several campuses, the authors argue that it is okay to keep the good name of the campus and avoid abuse of veils from all forms of radicalism, intolerance, or fraud in the lecture process. But before the ban was put into effect, it should first be with discussion and even research involving the entire academic community related to the positive or negative veil on campus by using data and reference sources that can be trusted scientifically and academically and also pay attention to the values that live in society

    Tax has an important role in the governance of the state, including Indonesia which relies on tax revenues, to accelerate the creation of public welfare and the achievement of state objectives, as stated in the Preamble of the 1945 Constitution. Article 23 A The 1945 Constitution clearly determines taxes and other levies are regulated by law. The very foundation of this constitution must be interpreted legally that tax collection must be based on sound legal principles. The principle of the tax law must be based on fairness and equity in carrying the tax burden in accordance with the ability of the people. To increas the collecting of tax, the government applies policy such as through the provision of tax incentive facilities. This tax incentive is expected to be a concern for investors to make investments in Indonesia. The provision of tax incentive facilities in the context of investment needs to be reviewed in the perspective of legal theory, especially in terms of justice and its usefulness in the development of investment and the achievement of people's welfare. The method in this study uses the normative juridical method, using the statutory approach. The provision of income tax incentives in the investment sector is an embodiment of investment facilities, which is one of the factors that influence the growth and interest of foreign investors in investment in Indonesia. In the perspective of legal theory, the provision of this income tax incentive, which is regulated in the law, both the Income Tax Act and the Investment Act, which was formed by the authorized body for that, especially from the theory of utilitarianism and positive legal order must be guided by hierarchically in grundnorm (basic norm)

    Corruption in Indonesia is currently a serious crime that is carried out systematically and has a broad impact on people's lives. State’s assets which should be used for development in order to benefit the society, are used for personal interests. Through the Corruption Law, the State tried to eradicate corruption and restore assets that have been corrupted. The restoration is endeavored by the application of additional punishment in the form of payment of substitute money. In order to optimize the implementation of the payment, the Supreme Court has issued a regulation of Substitute Money to provide the same understanding for the Law Enforcers, specifically Judges, in the imposition of the regulation on Defendants of Corruption. The problems in this research are: How is the implementation of Supreme Court Regulation on Substitute Money in the verdict to the defendants of corruption. The method used in this research is sociological juridical method. The type of the research is descriptive by using primary data and secondary data. The results of the study revealed The Judges have implemented some of the clauses of the regulation on making the decision, however  the implementation have not evenly stated on each verdic

    This study aims to analyze the legal consequences arising from legal actions carried out before a notary by a couple whose marriage is not recorded and legal efforts to protect parties when legal actions occur. This research is a normative legal research using a law and case approach. The location of the study was conducted in Makassar City. The results showed that the legal consequences arising from legal actions carried out before a Notary by a couple whose marriage was not recorded is a Notary Certificate, cannot be made by the Notary because they do not have evidence that confirms that a legal marriage has been carried out. In this case what is meant is the Deed Marriage issued by the Civil Registry Office because the marriage is only done according to their religion and beliefs. Legal measures to protect parties when legal actions occur are the establishment of permits to return the name of the land certificate to the District Court where the object of land / building is located. In the application to the District Court, it should also be requested for the Judge's confirmation in the determination that Mona's mother is the only heir based on a marriage that has been carried out in accordance with religious law and her belief

    Analisis Perubahan Bentuk Badan Hukum Perusahaan Daerah Bank Perkreditan Rakyat (PD BPR) Kota Makassar Menjadi Perusahan Perseroan Terbatas. Penelitian ini bertujuan untuk menemukan dan menjelaskan proses dan akibat hukum perubahab bentuk badan hukum Perusahaan Daerah Bank Perkreditan Rakyat (PD BPR) Kota Makassar menjadi Perusahaan Perseroan Terbatas. Penelitian ini merupakan penelitian normatif-empiris. Hasil penelitian ini menunjukkan bahwa perubahan Perusahaan Daerah Bank Perkreditan Rakyat menjadi Perseroan Terbatas Bank Perkreditan Rakyat Kota Makassar dilakukan dengan tahap persiapan dimana dalam tahapan ini melalukan revaluasi aset dan audit serta pembuatan anggaran dasar. Hal-hal yang harus diketahui Pemerintah Kota selaku Pengelola Badan Usaha Milik Daerah terkait perubahan bentuk badan hukum. Penyusunan rancangan perubahan bentuk badan hukum Bank Perkreditan Rakyat. Mengajukan permohonan persetujuan perubahan bentuk badan hukum kepada Otoritas Jasa Keuangan. Dikeluarkannya Peraturan Daerah Kota Makassar Nomor 7 Tahun 2016 tentang Perubahan Bentuk Badan Hukum Perusahaan Daerah Bank Perkreditan Rakyat Kota Makassar menjadi Perusahaan Perseroan Bank Perkreditan Rakyat Kota Makassar. Setelah berlakunya Peraturan Daerah tersebut, pelaksanaan perubahan bentuk badan hukum tersebut dilakukan sesuai dengan mekanisme pendirian Perseroan Terbatas sebagaimana tercantum dalam ketentuan Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas yang mana pendirinya dilakukan oleh Walikota. Adapun akibat hukum perubahan bentuk badan usaha Bank Perkreditan Rakyat adalah berubahnya struktur organisasi, manajemen dan penyebutan nama.     Penelitian ini bertujuan Untuk mengetahui peran Kantor Badan Pertanahan Nasional dalam menyelesaian Sengketa Pertanahan melalui Mediasi sesuai dengan Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional nomor 11 tahun 2016 tentang Penyelesaian Kasus Pertanahan. Penelitian ini merupakan penelitian normatif empiris, yaitu suatu penelitian disamping melihat aspek hukum positif juga melihat pada penerapannya atau praktek di lapangan. Teknik analisis data yang digunakan adalah deskriptif kualitatif, yaitu setelah data terkumpul kemudian dituangkan dalam bentuk uraian logis dan sistematis, selanjutnya dianalisis untuk memperoleh kejelasan penyelesaian masalah, kemudian ditarik kesimpulan secara deduktif, yaitu dari hal yang bersifat umum menuju hal yang bersifat khusus. Hasil dari penelitian ini menunjukkan bahwa Sebagai mediator, Kantor Pertanahan Kota Makassar mempunyai peran membantu para pihak dalam memahami pandangan masing-masing dan membantu mencari hal-hal yang dianggap penting bagi mereka. Mediasi di lingkungan instansi pertanahan dalam hal ini Kantor Pertanahan Kota Makassar sebenarnya juga secara tidak di sadari telah di jalankan olah aparat pelaksana secara sporadis dengan mengandalkan kreatifitas dan seni di dalam gaya kepemimpinan masing-masing pejabat, tetapi baru pada saat sekarang ini upaya mediasi telah memiliki payung hukumnya di lengkapi pedoman serta petunjuk teknis yang memadai sehingga tidak ada keraguan lagi bagi aparat pelaksana untuk menjalankannya.   Kata Kunci: Kantor Pertanahan, Mediasi, Penyelesaian Sengketa. &nbsp

    According to Article 3 letter f of Law Number 2 Year 2014 regarding Amendment to Law Number 30 Year 2004 about Notary Position a Notary candidate should take apprenticeship 24 consecutive months before allowed to practice as a notary.  The problem is how the obligation conducted and how is the responsibility notary organization in holding the apprenticeship. The method taken in this research is empirical juridical. The juridical approach is used to analyse the various laws and regulations, while the empirical approach is used to view and analyse the law compare to its practice in society along with all its aspects. Because in this research examining people in relation of life in society, hence method of empirical law research can be regarded as research of sociological law which is branch of law of law (socio legal research in sociological jurisprudence) because legal research is taken from facts that exist in a society. The research was held in Notary organization known as Indonesian Notary Association in Padang . The research show that  the Notary organization plays an important role in conducting  apprenticeship for notary candidate, by permit their office chosen to hold  apprenticeship.     Title of land, deeds of sale and other means of evidence are evidences of land ownership. Another type of evidence is a land ownership certificate as the document asserting a basic right of land ownership. Such documents provides weak evidence, but in Indonesia, especially in Tua Pejat region of  the Mentawai islands, this kind of evidence is still widely found and used by landowners. The article is discussing the legality of sale and purchase transaction on land which only proved with letter of Statement by Land Official. The method used in this research is empirical juridical (socio-legal research). The juridical approach involved analysis of various land regulations, while the empirical approach was used to examine and analyse the operation of the law in practice as could be observed from social behaviour along with its aspects and how the law works in the community.     Article 23 paragraph (1) of Aceh Islamic Criminal Law No 6 of 2014 tells about Indecency (Jinayat) law which regulates the criminal punishment for the perpetrator of jarimah khalwat. This article is expected can minimize the crime rate of the indecent (jinayah) behavior perpetrator. However, in fact the number of jarimah khalwat perpetrator increase steadily as what happened in Sabang Municipality law area. It proves that there were two legal issues, what is the causes of the ineffectiveness of the indecency (jinayat) law in minimizing the number of jinayat perpetrator in Sabang Municipality? This research was aimed to know the obstacle of the increasing jinayat khalwat issue which make jinayat law become ineffective in minimizing jinayat khalwat perpetrators in Sabang Municipality, and to know the efforts conducted by the Civil Service Police Unit, Sharia Policy, and Office of the District Prosecutor General of Sabang Municipality and to know the factor which causes the number of jinayah khalwat perpetrator in Sabang Municipality. The research method used in this research was empirical juridical empirical using case approach, historical approach, comparative approach, conceptual approach, and statute approach). The research result shown that there were 3 effectiveness obstacle factors  of jinayat law in Sabang Municipality, the first obstacle of jinayat law is the bad regulation because the punishment is an alternative not a cumulative  and for those who deal with the jinayat law is potentially punished with canning punishment in public, the application of jinayat law normatively is in contrary with the basis of personality and territoriality which causes this law contrary with the fair legal system (due process of law). The second factor which becomes the obstacle related to quality and quantity of the human resource of the law enforcement, law understanding and the number of personnel investigator of the Civil Service Police Unit and Sharia Police of Sabang Municipality was limited. One is the openness of public information described in the UU ASN and the Law on Public Information Disclosure (UU KIP). The implications of the application of the KIP Law to the public or the public are the opening of access for the public to obtain information related to the public interest. First, Information that must be provided and announced and Required Information Announced necessarily (easy to reach and easy to understand). Establishing characterized and proportional ASNs are various ways, namely: 1) State Civil Service Committee (KASN); 2) Utilizing information communication technology (ICT), which provides public information disclosure data to the public through the website; 3) Implementation of UU KIP; 4) need to be socialized both to public bodies and communities; 5) Public bodies are given space to establish, build, and develop institutional PPIDs in accordance with the characteristics of institutions of their respective public bodies; 6) The government should be able to optimize socialization and encourage public participation to be able to carry out information disclosure, as mandated by UU KIP. With these means are expected to realize the character of ASN and proportional that also amandat of UU KIP. Manajemen sumber daya aparatur sipil negara (ASN) merupakan salah satu bagian penting dari pengelolaan pemerintahan negara yang bertujuan untuk membantu dan mendukung seluruh sumber daya manusia aparatur sipil negara untuk merealisasikan seluruh potensi mereka sebagai pegawai pemerintah dan sebagai warga negara. Salah satunya adalah keterbukaan informasi publik yang dijelaskan di dalam UU ASN dan UU Keterbukaan Informasi Publik (UU KIP). Implikasi penerapan UU KIP terhadap masyarakat atau publik adalah terbukanya akses bagi publik untuk mendapatkan informasi yang berkaitan dengan kepentingan publik. Pertama, Informasi yang wajib disediakan dan diumumkan dan Informasi yang Wajib Diumumkan Serta-Merta (mudah dijangkau dan mudah dipahami). Membentuk ASN yang berkarakter dan proporsional terdapat berbagai cara, yaitu: 1) Komisi Aparatur Sipil Negara (KASN); 2) Memanfaatkan teknologi informasi komunikasi (TIK), yang menyediakan data-data keterbukaan informasi publik kepada masyarakat melalui website; 3) Pelaksanaan UU KIP; 4) perlu terus disosialisasikan baik kepada Badan Publik maupun masyarakat; 5) Badan publik diberikan ruang untuk membentuk, membangun, dan mengembangkan kelembagaan PPID sesuai dengan karakteristik lembaga masing-masing badan publik; 6) Pemerintah harus dapat mengoptimalkan sosialisasi dan mendorong peran serta masyarakat untuk dapat menjalankan keterbukaan informasi, sebagai amanat UU KIP. Dengan cara-cara tersebut diharapkan akan mewujudkan ASN yang berkarakter dan proporsional yang juga amandat dari UU KIP
