No full textThe Malacca Strait, together with the Singapore Strait, are two of the most important straits in the world and consequently there is significant traffic through them, reported to be approximately 60,000 vessels a year. The rising number of violent and well-coordinated attacks on transiting ships in these straits has become a very serious problem, such as threats of unauthorized boarding; theft of personal property, cargo and the ships themselves; and violence against, and the kidnapping or murder of, seafarers. One effort which is likely to enhance security in the Malacca Straits is the establishment of 'joint patrol areas', where more than one of the three littoral states will have the right to patrol and arrest persons and vessels where there is an incident of piracy. Extra regional assistance is also necessary to suppres and prevent piracy and maritime terrorism in the Malacca Strait, however the proposal by the United States to deploy its troops to help with patrolling these straits may violate the national soverignty of the three littoral states. Therefore, the foreign assistance given by the major user states should be given in other forms such as providing more advanced technology for combating piracy and terrorism, training for personnel who patrol the Malacca and Singapore straits and sharing intelligence information to prevent piracy and maritime terrorist attacks

No full textThe over exploitation of marine life is the first part of the planetary crisis. The second part of the crisis arises because man is ambitious and cannot be stopped from progressing everyday. This creates a dominoes effect, by raising concerns about species dependent on marine life, which would be everybody else. This threat on marine life along with hitherto unprecedented levels of development on a very fragile earth can lead to a very bleak future. Development and progress have made the world a smaller place. Development and progress have also ensured that there isn't so much of the earth left to go around. The nations of the world have always agreed that developing sustain ably and with precaution is the only way forward if we are to have a future. We come to a juncture where what is legally sound may not be morally acceptable. Here arises the problem of balancing. This paper considers the earth’s journey from the Stockholm Conference of 1972 and The Rio Declaration of 1992 to marine life and international trade issues faced by us today. It draws conclusions by tracing the evolution and the competition between the two parts of the planetary crisis. The paper offers an alternative story of the future, if the balance is not maintained between international norms and development by the nations of the world, by bringing forth paradigm shifts in the planetary crisis between ambitious nations and the survival of the living earth

Insurance and Islamic Law
No full textIn Islam, insurance has actually been practiced since the time of the Prophet Muhammad saw. The precursor of Islamic insurance, according to some scholars is al-diyah ‘ala al-’aqilah. Al-’aqilah is the habit of Arab tribes having been practiced long before Islam where I f one member of the tribe were killed by other tribe members, the heirs of the victim will be paid with blood money (al-diyah) as compensation by the next of kin of the killer. Next of kin of the killer is known as al-’aqilah. After the arrival of Islam, al-aqilah system was approved by the Prophet PBUH as part of Islamic law. Furthermore, al-’aqilah was contained in the Charter of Medina. In the next period, this al-’aqilah or insurance continued to be practiced by the caliphs, especially during Caliph Umar ibn al-Khattab until now. Islamic Insurance or sharia-based insurance is more nuanced with generosity rather than profit oriented. Therefore, the aspect of mutual help always serves as a primary basis of the practice of Islamic insurance. Islam regards insurance as a social phenomenon formed on the basis of mutual-help and a sense of humanity. Today Islamic insurance is growing rapidly in many countries. This suggests that Islamic insurance is quite attractive to the public in various countries. The problem is, until now there are many people including some Muslims who do not understand Islamic insurance
