LEGAL POLICY OF INDONESIA’S AIR TRANSPORTATIONS HUMAN RESOURCES DEVELOPMENT IN FACING ASEAN ECONOMIC SOCIETY 2015
Legal policy of development and the provision of law flight human resources belong to national transportation policy subs-system. Legal policy contained in Act No. 7 of 2007 about RPJP puts the development of air transportation as one of the parts of the national facilities and infrastructure development. In the regime of flight law, human resources management is arranged in separated sections that belong to the national system development. The scope of human resources development and setting provision are as follow, human resources planning (manpower planning), education and training, expansion of employment opportunities, as well as surveillance, monitoring, and evaluation. The politic of legislated development setting and the provision of human resources that are made through delegated legislation above require further policy in form of three ministerial regulations as follow, ministerial regulation of the human resources provision and development in flight field, ministerial regulation of education and training in flight training, and ministerial regulation of competency certificate, licensee and training program.The writer advices the transportation ministry to realize in short time those three ministerial regulations which already have basic delegated delegation as the solution to face ASEAN open sky policy
PROMOTING REGIONAL INTEGRATION THROUGH HIGHER EDUCATION: LEGAL ANALYSIS ON THE EMPOWERMENT OF FOUNDATION IN PRIVATE UNIVERSITIES
Higher education holds an important role in developing nation to build the manpower capacity of young generation and generate intellectual property. The same case applies in Indonesia as the most populous country in South East Asia with unmanaged higher education. Originally set out as a social entity which is engaged in nonprofit activities, some foundations have engaged in higher education. However conflict arises when the purpose of foundation is skewed for personal use that ended up disparaging other good foundations and the society in general. These issues prompted the government to promulgate Law No. 16 of 2001 regarding the Foundation and Law No. 28 of 2004 regarding the Amendment of Law No. 16 of 2001 regarding the Foundation. With this legislation, the foundation is expected to carry out specific standard and policies in managing their activities especially in order to prevent internal and external interference This article discusses on four parts: i) thetheoretical legal background of foundation in Indonesia compared to other legal entities; ii) the exposition of organs on the foundation in such as the Board of Trustees, Board of Executive and Board of Supervisory; iii) The analysis of role between foundation and universities, including examples of internal and external conflict as study case; and iv) the role of foundation to enhance Indonesia’s regional position in the international community
EUROPEAN UNION INTEGRATION PROCESS: A LESSON LEARNED FOR ASEAN
The paper first highlights the historical background of Indonesian foreign policy, the current “downto-earth and pro-people diplomacy”, as well as Indonesian foreign policy for the period of 2015-2019. Secondly, it will briefly describe the current and future global and regional situation that could become challenges and opportunities for Indonesia ahead. Third, it will also explain the current development of the European Union relations with Indonesia and ASEAN. Finally, the paper will conclude a lesson learned from European Union integration process for ASEAN
INTERNATIONAL COPYRIGHT TREATIES AND ITS IMPLEMENTATION UNDER INDONESIAN COPYRIGHT ACT; IS IT A BETTER ACCESS TO KNOWLEDGE?
The Indonesian Government has enacted a new Copyright Act in 2014 on the basis that Copyright protection plays a strategic role for economic development and people’s prosperity. This new Act provides a higher standard of protection and ensures more legal certainty to copyrights holders. It is not only expands the scope of protection, duration, but also provides better economic rights to the right holder. This Article analyses Indonesia’s obligation under international treaties and whether Indonesia takes full advantages of all the flexibilities available under those treaties to enhance access to knowledge particularly for educational materials. It also analyses substantial provisions of the new Copyright Act in the context of scope, duration, limitations, and its exceptions. This Article argues that strongest protection of copyright is far beyond what is required by the international copyright treaties which Indonesia has acceded to them. This Article also argues that all available limitations and exceptions provided by the treaties that would have opened up access to knowledge has not all incorporated into the new Act. Accordingly, this Act has a potential to inhibit access to knowledge.Pemerintah Indonesia telah mengundangkan Undang-Undang tentang Hak Cipta yang baru tahun 2014 atas dasar bahwa perlindungan Hak Cipta memainkan peranan yang strategis bagi pembangunan ekonomi dan kesejahteraan masyakarat. Undang-Undang yang baru ini menetapkan standart perlindungan yang lebih tinggi dan lebih menjamin kepastian hukum bagi pemegang Hak Cipta. Undang-Undang ini tidak hanya memperluas lingkup dan jangka waktu perlindungan tetapi juga menetapkan hak-hak ekonomi yang lebih baik bagi pemegang hak. Artikel ini menganalisa kewajiban Indonesia berdasarkan treaties internasional dan apakah Indonesia mengambil semua keuntungan dari fleksibilitas-fleksibiltas yang disediakan oleh treaties tersebut guna mendorong akses ilmu pengetahuan terutama materi pendidikan. berita aktual ini menganalisa ketentuan-ketentuan substansi dari Undang-Undang tentang Hak Cipta yang baru mengenai lingkup, jangka waktu, pembatasan-pembatasan dan perkecualian-perkecualiannya. Artikel ini berpendapat bahwa perlindungan Hak Cipta yang lebih kuat, telah melebihi dari yang syaratkan oleh international treaties mengenai Hak Cipta yang telah disepakati Indonesia. Artikel ini juga berpendapat bahwa semua pembatasan dan perkecualian yang disediakan oleh treaties mengenai Hak Cipta tersebut, yang akan membuka akses pengetahuan, tidak dimasukkan dalam Undang-Undang yang baru, sehingga Undang-Undang ini mempunyai potensi menghambat akses pengetahuan
APPLICATION OF EXTRATERRITORIAL JURISDICTION IN EUROPEAN CONVENTION ON HUMAN RIGHTS (CASE STUDY: AL-SKEINI AND OTHERS V. UK)
This research explains the definition of jurisdiction, development of the extraterritorial jurisdiction and its regulation in international law which includes its principle and also boundaries. This research then analyses cases before Al- Skeini and others v. UK case regarding the application of jurisdiction mentioned in Article 1 of the European Convention on Human Rights (ECHR) by European Court of Human Rights (ECtHR). Furthermore, this research analyses the applications of Article 1 ECHR in United Kingdom’s House of Lords decision and ECtHR decision in Al-Skeini. In its decision ECtHR stated that the existence of Public Power in Al-Skeini causes an extraterritorial jurisdiction in that case. The judgement caters to the human rights protection but on the other hand it still leaves confusion in determining the requirement of extraterritorial jurisdiction in the ECHR
ADVANCING ASEAN HUMAN RIGHTS NORMS THROUGH EXTERNAL RELATIONS: CAPACITY, ADVANTAGES, AND THE POTENTIAL FOR EXTERNAL INTERFERENCE
The gradual development of human rights norms in ASEAN has been discussed until recently. As before the human rights provisions were formally enshrined in the ASEAN Charter, many experts have shared their views on how such norms should ideally be formulated and how to use the institutional approach in the promotion and protection of human rights in Southeast Asia region.This paper mainly discusses about the role of ASEAN’s external relations to advance the ASEAN human rights norms.On the more specific topic, this paper analyzes ASEAN’s capacity to bring human rights agenda in its external relations and also analyzes the advantages that can be gained from such activities.Based on the assumption that cooperation naturally opens the room for external influences, this paper also studies whether ASEAN’s external relations on human rights issues are potential for external interference
