    Islamic Law and Terrorism in Indonesia

    JihÄd and terrorism are not the same. In the context of sharia that implementation of the jihÄd has parameters measured with a layer of ethics based on the commands Al Quran and the Hadith of Prophet and the explanation the Ulama. Muslims in Indonesia views that the essentially not much different from the views on jihÄd and terror in other Islamic countries, especially the Middle East. In the context of Islamic law, jihÄd has multi spectral studies, but none of these studies that equate the meaning of jihÄd with terrorism, or none of them agreed that acts of terror as has been demonstrated by radical groups that are part of the concept Islam

    Product of multi services in sharia banks presented in order to meet the needs of society as well as the development of the era transactions that course in accordance with Islamic principles, then the ownership  in  the syariah products  including  multi  product  in  Islamic banking  services  using  the concept of multi akad therein. This is done so that innovation in Islamic banking products had been developed so that it can be chosen by the public in conducting business transactions.     As an academic course, critical thinking has emerged in the last century as the one of the important subjects, especially in the second half. But as a kind of thinking and a process of the human reason, it was exist as old as mankind. What are known, nowadays, as (standards) of critical thinking or (characteristic) of critical thinker were used by some ancient Greek philosophers, e.g. Socrates, Aristotle, as well as great Muslim scholars, e.g. al-Biruni, al-Ghazali, etc. al-Biruni was known as a great Muslim scholar due to objectively scientific method in his works. Moreover, he also was famed in comparative religion which early in history of discipline of comparative religion.     This article discusses strategic management at the school for educators. Strategic management of the school for educators is to support the development and construction of an educational institution for excellence and quality. If in the modern era which are all based on technology, computers, applications and the Internet, it is very unfortunate if there is an educational institution that still apply strategic management within the school administrative data processing by hand. It will not be effective and will take a very long time. With the application of finger print-based strategic management to monitor it all, it will facilitate an educational institution in managing data administration required, especially to see the work ethic of an educator as seen from the attendance list presence. This study aims to determine the extent to which management implementations finger print-based strategies to improve work ethics of teachers in the State Madrasah Aliyah (MAN) 1 Bandung. The research was conducted by interview or observation related technologies, applications, and data administration for educators in the State Madrasah Aliyah (MAN) 1 Bandung. With the finger print-based strategic management, it will be easier for the school to monitor and assess the work ethic of existing educators in the school

The above case is certainly influenced by any cases that very concern and also shows the loss of moral education in the education world. The Ministry of Religion and the Ministry of National Education have essentially concerned to improving educational system in Indonesia. It is to lead the formation of moral and religious spiritual that is still seemed very minimal. The aim of this study is to answer the question on what is the expected of learning moral in the purposive line of educational activities through the development of student personality. This paper requires a new concept in reconstructing the concept of formal education today to lead the formation of character or morals, and its implication to the improvement of spiritual-religious values among the students. In the case of MTs Karangpawitan Garut, Islamic Union is seeking to maximize the interaction between cognitive and psychomotor aspects in the whole of education process. Unfortunately, much of them are still trying to internalize the values of the Qur'an as God's revelation to be applied in behavior or morals.     At the recent decades, the business activity in Islamic Financial Institutions consists of funding, financing, and service. These are addressed to economic development and improving the society welfare. In the line of funding, the people can invest their money such saving and deposit. Uniquely, deposits may be withdrawn at any time with the use of checks, gyro, forms of payment order, or money transfer. But, not all gyro transactions can be justified by Islamic law (Sharia) in which uses the principle of sharia mutual benefit. Therefore, the National Sharia Council National Sharia Council of Indonesian Council of Ulama (NSC-ICU) deems it necessary to be set in the Fatwa muâ€™Ä mala form that can be used as the guidelines for the implementation of current accounts in Sharia Banking Institution. It is referring to the National Sharia Board Fatwa DSN-MUI Number: 01/DSN-MUI/IV/2000).     This article was composed from the fact that the presence of Sharia Financial Institutions (SFC) cannot be separated from the existence of Conventional Financial Institutions. Islamic Bank appeared in the midst of the conventional banking development. It certainly gives the impression product of Islamic Bank is seen as the imitation of conventional banking products. The historical analysis shows that the substantive function of banking operations has been practiced since the early days of Islam. Even the profit and lost sharing principle has been applied from transactions Islamic business transactions (Mu'amalah) in the ancient Arab, which has been explored in the modern era and also legitimized by the Fatwa of DSN MUI (National Sharia Council of Indonesian Ulama Council (NSC-ICU). This institution is often reinterpreting the concept of Islamic business, including the innovation of Islamic Banking products that are derived from the Quran, the Sunna, and Islamic Jurisprudence (al-Ijtihad)

    The Prisoners' Rights Protection in Indonesia Law System of Justice

    The aim of the paper is to examine the provision of the prisoner’s rights protection in Indonesia law system of justice and its relation to the exemption conditional (EC) in correctional institution. As an important issue, here is if the defendant override rules associated with the controversial issue in society, they will both at national and international level, such as human rights issues. The case was appeared recently, especially in the connection with the cases of exemption conditional, i.e. Pollycarpus Budihari Priyanto’s case. The case has become the center of public attention, especially after release of the Ministry of Law and Human Rights, who has been freeing the prisoners that related to the homicides Human Rights Activists (HRA) i.e Munir Said Thalib. In the community, this decision raises the pro and contra. This paper concludes that all persons deprived of their liberty will be treated with humanity and guaranteed them with respect for the inherent dignity of the human person to be in accordance with the existing rules. In this case, the government of Indonesia has given the rights of prisoners through the stages of development of the inmates according to the stage of the penal process that refers to laws and regulations and implementation of technical regulations. The paper also recommends that the need for the government to deliver data either traditionally or electronically linked plan of exemption conditional

    Defending the State as a Form of Love for the Fatherland in an Islamic Perspective

    Transnational ideology springs the faded attitude of state defends. On another side, state defend is always connected with the military. The concept of jihad (struggle) in the Qur’an can be understood as an obligation to defend the state at all levels. The obligation could be in the form of guarding unity and integrity, culturalizing of deliberation, struggling justice, and maintaining freedom. The obligation of state defends in the form of physical form could not be conducted whether individually or collectively. This obligation is performed only if a ruler commands to battle against, and when an enemy has besieged a region. If defending Indonesia's state is one of the requirements for the existence and glory of Muslims in materializing Islamic values and universal of humanity, so struggling for state defend is a condition sine qua non

    Waqaf is basically seen as one of the religious institutions in Islam which is relevant and functionally efforts to solve socio-economic problems and humanity, such as poverty alleviation, human resource development, and economic empowerment. The endowments are absolutely an important role in achieving a just social order. From the perspective of shapes, endowment money is seen as one of the solutions that can make endowments to be more productive. Because the money here will no longer to be used as a means of exchange, but more than it, we can explore it as a commodity to produce in the terms of economic development. Therefore, the cash money in the form of waqaf of money can result any benefit for the community. Appearances distribution of endowments can be used to productive activity in the era of economic downturn of the Islamic community in Indonesia. Now it should become the primary choice. In another sense, it is a productive waqaf endowment that must be a priority and dedicated its efforts to more fruitful. Thus, the sizes of different paradigms are done by the consumptive waqaf, because it gives a new hope for the majority of the Muslim community. Endowments are not willing to lead in worship of mahdhah which is directed to the consumptive waqaf. Using the findings of waqaf has been prioritized to give benefit in a very broad, including for economic empowerment, such as public facilities and worship activities, social facilities and educational activities as well as health, aid to poor people, displaced children, orphans, scholarship, progress and economic improvement for the people who needs the advancement of public welfare other non-contrary to the sharia business law
