CRIMINAL VICTIMIZATION ON LARGE-SCALE INVESTMENT SCAM IN INDONESIA
Mass scale investment fraud (Ponzi) schemes result in protracted suffering for the victims. In this article the author investigates this crime from a juridical normative, case, and conceptual approach. From the very start potential victims may fall to promises of lucrative and safe investment schemes. In the eyes of the more prudent, it would or should be obvious that the collaborative business offers as presented contains logical flaws, running against common sense and is at the outset illegal. Notwithstanding, victims seems to fall easily into this trap, lured by the promise of getting easy, quick, and huge investment returns. In the end, even when this fraudulent investment scheme unravels, the government of law enforcement seems to be unable to act decisively and offer a satisfactory solution. Slow and ineffective government response in the end exacerbate economic loss and victims suffering
PERJALANAN REFORMA AGRARIA BAGIAN DARI AMANAH KONSTITUSI NEGARA
The author examines and describes how agrarian reform is realized during different government periods. To do that, policy, and legal documents, directly or indirectly related to agrarian reform, is analysed. This research reveals that attempt at agrarian reform up to present is focussed developing policies aiming to restructure land ownership and utilization (land reform). Another finding is that the promulgation of Law No. 11 of 2020 (Law on Job Creation) tends to shift the focus more on granting easy access to land for development purposes. This change of policy priority will have dire consequence to access to land for the poor and most likely increase agrarian conflicts
GANTI KERUGIAN TERHADAP ANAK KORBAN TINDAK PIDANA PENCABULAN
Children’s rights, as victim (of sexual offences) or perpetrator of crime, are not yet well secured or protected by law. This issue will be discussed by examining closely the substantive and procedural rules-regulation in the Law of Child Protection (no. 23 of 2002) and Law on Child Court (no. 11 of 2012). In addition, legal practice about children court shall also be highlighted. The author suggest that the prevailing substantive and procedural law has not yet be made adequately in response to the special needs of children victims of sexual abuse as well as accommodating the need for sufficient and fair compensation. It is as it is, due, amongst others, for the lack of victim perspective in the making of the children court system and how this system is being practiced
URGENSI AUTOPSI FORENSIK DAN IMPLIKASINYA DALAM TINDAK PIDANA PEMBUNUHAN
The court does not always demand or require visum et repertum when examining homicide cases. Forensic autopsy may not be required at all by the criminal court when deciding that the accused is guilty of homicide as charged. The verdict may be reached based on other evidence. The author, using a juridical normative approach, concludes that the absence or presence of a visum et repertum does influence the judge’ consideration and matters to the final verdict. Considering that, regardless of the surviving family’s consent, in cases of unnatural death, forensic autopsy and the making of a visum et repertum should be mandatory
KOMITMEN INDONESIA DALAM PELINDUNGAN WARISAN BUDAYA BAWAH AIR DI PERAIRAN INDONESIA
This article discusses the extent to which Indonesia provides legal protection to prehistoric and historical object, especially shipwrecks, found within its national waters. It is known that Indonesia has not decide to ratify the UNESCO 2001 Convention on the Protection of Underwater Cultural Heritage (UNESCO 2001 Convention). Legal audit performed to existing national rules and regulations reveals that, legally wise, Indonesia has shown its commitment to ensure that underwater cultural heritage within its maritime zones enjoy protection. In addition, it may be argued that therefore Indonesia is not in a position having to ratify the UNESCO 2001 Convention soon
UPAYA PENCEGAHAN PEMUTUSAN HUBUNGAN KERJA PEKERJA DI SEKTOR FORMAL BERDASARKAN KEADAAN MEMAKSA PANDEMI COVID-19
The business world everywhere including those in Indonesia cannot but felt the brunt of economic slowdown caused by the public health emergency (the COVID 19 pandemic). Quite a few national and local businesses have had to close their operation and lay off all its employees. Although the consensus between the government, workers (individuals and unions) as well as employers is to prevent and avoid termination of employment at all costs, the Law No. 11 of 2020, re. Job Creation allows massive dismissal of employees due to economic necessity or state of emergency. This article shall critically examine how the prevailing law, Law No. 11 of 2020 re. Job Creation regulates termination of employment in case of state of emergency.
KEKUASAAN DISKRESI HAKIM PENGADILAN HUBUNGAN INDUSTRIAL
In this article the author discusses the discretionary powers granted to Labour Dispute Court judges. Better known, in comparison, are the discretionary powers of criminal court judges in determining penal sanctions or of Islamic court judges when granting dispensation to marry for underage couples. Using a juridical normative method, the discussion focusses on the principles underlying the Labour Dispute Court judge’ discretionary powers and its implementation. The analysis shows that Labour Dispute Court judges do have and enjoy discretionary powers in determining betterment of working conditions, how to best fill gaps or seek clarity in the face of ambiguous rules and regulations found in work contract, company regulations or collective work agreement
LEMBAGA TUNGGAL PENGELOLA REGULASI: DASAR PEMIKIRAN DAN TAWARAN IMPLEMENTASINYA DALAM KETATANEGARAN INDONESIA
In this article the author seeks to answer, within the context of the Indonesia state organizational system, why and how Indonesia should establish a single government authority entrusted with supervising the making of ministerial policy regulations or regional government regulations. To that purpose a comparison with other countries is conducted. It is a fact in Indonesia that regulatory powers or function is shared by and among different ministries and by regional governments. The result of which is the problem of sectoral approach and the existence of numerous overlapping and conflicting regulations. To overcome this problem, in consideration of best practices in other countries, the author suggests the establishment of a single government agency entrusted with, inter alia, previewing ministerial or regional government draft regulations
MITIGASI BENCANA PERKAWINAN ANAK SEBAGAI UPAYA MEWUJUDKAN KELUARGA SAKINAH: PERSPEKTIF FIKIH PERLINDUNGAN ANAK
Child marriage, in the final analysis, is denial of childrens basic right. The practice also violates the prevailing law which sets a statutory age limitation for both men and women to marry at 19 years. The author seeks to analyse this legal-societal issue from Islamic law perspective. The analysis starts from the general observation that to prevent future dissent-disolvement of marriages, both parties should consider “rusyd”, in other words, their own or potential partners psychological, biological, and socio-economic maturity. In addition, to prevent child marriage, attention should be given to basic values of benefit (al mashlalah), the general principle of affection (mawaddah wa rahmah) and fulfillment of needs (taufir al-hajat)
PERLUASAN KEWENANGAN BPK DALAM MENGAWASI KEUANGAN NEGARA DI LINGKUP PEMERINTAHAN DAERAH
State budget management is tightly related to how the existing state law regulates fiscal relationship between the central government and the regional-local governments. The authority granted to regional-local government to manage their own budgeting more or less autonomously in practice results in mismanagement, misuse of available financial resources and even corruption. Unfettered and unchecked financial leakage at the regional government level may and have resulted in failure to realize and implement projects much needed by society. In light of this situation, a justified need arise for state intervention to monitor-control planning and realization of regional-local government budget. The author proposed the expansion of the Audit Board of the Republic Indonesia’s authority. They should not passively wait for financial reports to be submitted but actively assist regional-local government in planning their own budget, monitor the spending and realization of it and lastly, provide assistance in drafting the final report.
