Sustainability as a Goal of the Switzerland OEnotourisme : Viticulturists and Winemakers Perspective
This paper examines how OEnotourisme, or wine tourism initiated by the wine growers in Switzerland, can play a role in promoting a sustainable society that reflects the government’s sustainability-related policy.The Swiss Government’s vision for sustainability in OEnotourisme has been developed in the context of its relationship with EU countries.Cross-border cooperation with EU countries is critical especially for policies and strategies in environmental conservation and climate change, which has a significant implication for nature and agriculture dependent tourism such as OEnotourisme.Switzerland has had a national constitution in place since 1996, setting out its goals in relation to sustainable development, which are reflected in all its policies, including agriculture and tourism. “Swisstainable”, a sustainability certification system introduced by the government in 2021, is one such scheme promoting sustainability in all industries.Swiss wine has nurtured a long history from Roman times to the present day, but with 70% of its production in the mountainous Alps, Switzerland ranks 24th in the world in terms of production, thus its wine is considered rare on the world wine market.This Paper focuses on the approaches to sustainability taken by viticulturists and winemakers through the results of a questionnaire survey, revealing the potentials of OEnotourisme in promoting sustainability in today’s society facing climate and other environmental challenges

Current Status of Rural Working Holiday Activities for University Students : Case Studies in Wakayama Prefecture
農村ワーキングホリデーは,都市農村交流の一つの形態であり,その効果は労働力の提供による農業振興,農業体験による「食」や「農」への理解醸成など多方面に及ぶ。学生を対象とする農村ワーキングホリデーについては,学生特有の制約はあるものの,労働力としての期待や交流による農家への鏡効果が論じられている。和歌山県における事例研究では,農家側の負担の軽減や,学生の特性を考慮するなどワーキングホリデーが持続する仕組みがみられ,さらにITを活用し全国的な学生参加を可能にしている。このような学生の農村ワーキングホリデーの現段階の意義は,①労働力提供という学生の社会貢献活動,②学生の農業・農村についての学びの提供,③地域における農的関係人口の創出である
Freedom of Contract, Restraints on Alienation and Patent Rights from the Perspective of the Colgate Case
This paper examines the legal basis of the restraint on alienation doctrine through an analysis of the Colgate case. Colgate held that even if the company has a policy of resale price maintenance (RPM), this does not constitute a violation of the Sherman Act as long as there is a simple refusal to deal. The background of this matter is the right of manufacturers to freedom of contract and the perspective of substantive due process in relation to the Cream of Wheat case. In this paper, we will compare the Colgate ruling with the theories of justification based on patent rights and restraints on alienation at the time the ruling was made. As a result, the following two points were illuminated regarding the restraints on alienation. The doctrine was used as an analogy for justification based on patent rights, and here the relation with the freedom of contract and the intervention in the property rights of third parties could be an issue. From an economic perspective, the doctrine was judged to function as a cartel within a brand when it is used as a contractual system. These points help to explain the understanding underlying the restraints on alienation in the Leegin ruling and the principle that governed the Lexmark and Kirtsaeng decisions, which have been consistent over time
