The NAAEC and Its Institutions as Catalysts for Environmental Governance in Mexico: From NAFTA to the USMCA
Get PDFThe renegotiation of the North American Free Trade Agreement (nafta) culminated in the signing of the new United States-Mexico-Canada Agreement (usmca) and a series of symbolic changes on environmental issues. Environmental protection was not a priority for any of the three member states during the round of negotiations. This has been analyzed and criticized by environmental groups, who argue that a twenty-first-century trade agreement should not ignore the environmental and climate crisis we are suffering today. This article summarizes the content of the North American Agreement on Environmental Cooperation (naaec), still in effect, and analyzes the changes slated for environmental issues with the signing of usmca and its new environmental accord, the Agreement on Environmental Cooperation (aec). Both usmca’s Chapter 24, dedicated to the environment, and the new aec are steps backward that paralyze the advances for environmental regulation in the region.La renegociación del Tratado de Libre Comercio de América del Norte (TLCAN) culminó con la firma de un nuevo acuerdo comercial, el Tratado entre México, Estados Unidos y Canadá (T-MEC) y una serie de modificaciones simbólicas al tema ambiental. Para ninguno de los tres Estados miembros la protección ambiental representó una prioridad a lo largo de las rondas de negociación. Esto ha sido fuente de análisis y diversas críticas por parte de los grupos ambientalistas, pues argumentan que un acuerdo comercial del siglo xxi no debería evadir la crisis ambiental y climática que padecemos hoy en día. Este texto presenta un resumen del contenido del Acuerdo de Cooperación Ambiental de América del Norte (ACAAN), todavía en vigor, y analiza los cambios que se dan en materia ambiental a partir de la firma del T-MEC y su nuevo acuerdo ambiental, el Acuerdo de Cooperación Ambiental (ACA). The Fight for Life in the Face of U.S. Necropower
Get PDFNecropower, defined as that which is capable of producing and administering death, has its highest First-World expression in the United States and is characterized by facilitating the use of technologies for death to nativist groups, neo-Nazis, supremacists, and groups who are anti-immigrant, anti-abortion, and pro-arms sales, among others. This article looks at the case of the Afro-American community in the United States to show how the country, led by Donald Trump, maintains a necropower that is only distinguished from post-colonial states in its use of law to create spaces for death instead of using legal exceptions. The author also underlines the role of the #BlackLivesMatter movement as a path for resistance in favor of life.El necropoder, definido como aquel capaz de producir y administrar la muerte, tiene su expresión primermundista en Estados Unidos y se caracteriza por la diferenciación al momento de facilitar el uso de tecnologías para la muerte a grupos nativistas, neonazis, supremacistas, antiinmigrantes, antiaborto, pro venta de armas, entre otros. Este artículo muestra, a partir del caso de la comunidad afroamericana, cómo ese país, liderado por Donald Trump, sustenta un necro-poder que sólo se distingue del de los Estados poscoloniales en el uso del derecho en vez de la excepción legal para crear espacios de muerte.
