Regulation of public procurement in Zimbabwe : an analysis of its international obligations
Text in EnglishThe adoption of the new constitution in 2013 led to the constitutionalisation of public procurement in Zimbabwe. The Constitution is the principal source of law in Zimbabwe. This set in motion a series of legislative reforms to realign public procurement with con-stitutional prescriptions. The principal objective of the study was to establish whether Zimbabwe’s procurement regulatory framework complies with what is set out in section 315(1) as read together with section 195(2) of the Constitution. The preceding constitu-tional provisions outline the six constitutional principles anchoring public procurement. These principles are mentioned hereunder as follows:
a. Openness;
b. Honesty;
c. Cost-effectiveness;
d. Fairness;
e. Competitiveness; and
f. Transparency
To pass constitutional muster, public procurement legislation must crisply flesh out the aforementioned principles. Public procurement legislative framework is extensively cod-ified in the Public Procurement and Disposal of Public Assets Act 5 of 2017. This Act is integrated with the Public Finance Management Act 11 of 2009. Noticeably, some of segments of Public Procurement and Disposal of Public Assets Act are bent on using public procurement to achieve socio-economic ends. Though the public procurement reg-ulatory legislation is far from being perfect, this study has shown that the procurement regulatory legislation conforms to constitutional dictates. However, the operationalisa-tion of this policy still remains haphazard. The legislative hindrance to the realisation of the procurement regime articulated in the Constitution is discussed in this thesis.
The secondary objective of this research is to measure the degree to which Zimbabwe’s public procurement regime conforms to COMESA Public Procurement Regulations. Simply, this entails comparing Zimbabwe’s public procurement regulatory framework with the COMESA Public Procurement Regulations. In crafting this segment of the study, the researcher was guided by the fact that Public Procurement Regulations are binding on member states. Public Procurement Regulations are guided by the following principles: a. competition and openness in public procurement proceedings;
b. fairness;
c. transparency, including disclosure of all relevant information for participation in, and oversight over, public procurement;
d. accountability; and
e. value for money.
To operationalise Public Procurement Regulations, member states are required to ensure that the public procurement laws incorporate the aforementioned principles. In addition, it is also necessary for member states to designate financial thresholds for regional com-petitive bidding for suppliers operating in COMESA region. The thesis reveals that Zim-babwe’s public procurement regulatory framework compares favourably to COMESA Public Procurement Regulations.
The study concludes the discussion on the comparative analysis by recommending legis-lative changes to public procurement law in Zimbabwe. These amendments will facilitate the participation of suppliers from within the COMESA region. At present, Zimbabwean public procurement law does not distinguish between suppliers from a non-COMESA member state and COMESA member states. Principals’ experiences in the implementation of inclusive education policy in primary schools in Nzhelele Central Circuit
Inclusive education is a fundamental paradigm shift in primary education, striving to
ensure that every child has equitable access to quality education regardless of their
diverse abilities and needs. This study focuses on principals’ experiences in the
implementation of inclusive education policy to understand what they consider critical
in ensuring that their schools implement inclusive education policy effectively in all
schools within the Nzhelele Central Circuit (NCC). The study was conducted in five
public primary schools, and a qualitative research approach was adopted using a case
study design. Lev Vygotsky's sociocultural cognitive theory was adopted. A purposive
sampling technique was used to select the research site and participants for the study.
Data were generated through semi-structured interviews (SSIs) with 5 principals, 5
departmental heads (DHs), 5 teachers, and 5 parents. Data were analysed
thematically and followed a process that included data coding, theme identification,
and interpretation of findings to analyse the data related to the implementation of
inclusive education. The study's findings revealed that most participants were unaware
of the importance of implementing inclusive education in primary schools. It was also
revealed that the challenges that impede implementation include inadequate space
and overcrowded classrooms, insufficient time for teaching diverse learners, and
inadequate parental involvement and support. The study recommended that for
inclusive education to prosper, principals, DHs, teachers, and parents should undergo
training for adequate policy implementation in the implementation of inclusive
education policy. Schools should receive adequate funds to address the prerequisites
of all learners, and a lithe curriculum is crucial to providing every child with an
opportunity to learn and benefit from education. All education stakeholders should

A comparison of Dutch and South African legal mechanisms to address parental alienation
This mini-dissertation examines the phenomenon of parental alienation (hereinafter referred to as PA) within a family law context and conducts a comparative legal analysis of the existing legal mechanisms available in South Africa and the Netherlands to address it. Given their erstwhile colonial entanglements and historical legal ties in Roman-Dutch law, these two jurisdictions were chosen for comparison. The study’s problem statement highlights the number of divorces and other parental separations in both jurisdictions and the fact that PA features in some cases. The aims and objectives of the research seek to evaluate and critically analyse the legal tools used to address PA in both countries to identify gaps and make recommendations for legal reform in South Africa, drawing from best practices in the Netherlands. The researcher’s rationale for embarking on a study of this kind stems from the severe consequences of PA on some of the parties involved, but especially children. Academic literature and legal precedents from both jurisdictions are examined and commented upon. The document contains six chapters, commencing with an introductory overview and progressing through a comparative legal analysis, a discussion of the findings, and then concludes with legislative, policy and other reform proposals. A GIS-based approach to analyse potable water acccessibility in Langeloop Village in Ehlanzeni District Municipality, Mpumalanga
Potable water accessibility is fundamentally a human right, crucial for sustaining life
and ensuring the well-being of individuals and communities. However, in rural areas,
people struggle to find enough clean water to cook and drink; they travel or walk long
distances to access potable water. Langeloop settlement is a rural area that struggles
to access potable water. Therefore, this study aimed to analyse potable water
accessibility to the Langeloop community using a GIS-based approach. Langeloop
settlement consists of 11 sections/extensions used in this study. The mixed method
research approach was used, and potable water sources such as standpipes were
captured using a GPS, while observations and a questionnaire were used to conduct
a survey. Spatial service area network analysis was performed. The findings of the
study are that water accessibility is below average, and many households still do not
have access to potable water. This study also found that water availability is a more
prominent problem than water proximity. The recommendations of the study include
140 proposed standpipes in the areas where potable water is not accessible. However,
it reflects the importance of resource allocation and targeted interventions to improve

An examination of the intended-behaviour gap towards ethical fashion in South African millennials
The overconsumption of goods and services caused by increasing population and economic growth is threatening environmental stability around the globe. The fashion industry with its unsustainable and unethical practices has been identified as one of the major drivers of overconsumption, which has led to the deterioration of the environment and exploitation of workers. Consequently, concern and the intentions to avoid unethical consumption of apparel are on the rise, thereby causing retailers/brands to start producing ethical apparel in an effort to gain a strong market share of this new trend. Ethical apparel encompasses the sustainability dimensions of clothing production, which seeks to reduce environmental impact by using biodegradable or organic fibres, while prioritising workers' welfare through the avoidance of sweatshops and ensuring fair working conditions (Ethical Fashion Forum, 2016; Lundblad & Davies, 2016). Although expressing an intention to purchase ethical fashion, consumers are not following through with those purchases, indicating the presence of an intention-behavior gap. As ethical purchasing intentions among South African millennial consumers are on the rise, there has been insufficient research conducted on the factors influencing their decision to buy ethical clothing. Hence, the purpose of this study is to explore millennial consumers’ intended behaviour regarding ethical fashion. The study utilised the Theory of Planned Behaviour (TPB) as the primary framework to forecast consumer intentions regarding purchases. To the traditional TPB variables (attitude, subjective norms and perceived behaviour control), perceived consumer effectiveness, environmental knowledge, environmental concern, and situational context were added to improve the models’ predictive ability. A digital survey was circulated among South African millennials, resulting in a total of 302 responses that were collected and utilised for statistical analysis. The statistical analysis of the gathered data encompassed descriptive analysis, correlation analysis, and structural equation modelling.
In summary, the overall findings indicate that attitudes, subjective norms, and perceived behavioral control are significant predictors of purchase intention, as per the original framework. However, the additional variables yielded mixed results, with some variables such as perceived consumer effectiveness (PCE) proving to be good predictors of purchase intention. Environmental concern, which compared its relationship with all three TPB model variables and PCE, turns out to only influence PCE and not the three original TPB model variables. Environmental knowledge has also indicated a positive and significant influence on attitude meaning it is a significant predictor of intention, while situational context did not have influence on consumer intended behaviour, implying that it is not a good predictor of behavioural intention. As the knowledge and research on ethical fashion, particularly in South Africa, remains scarce, the current study enriches knowledge on ethical fashion and draws new insights on millennial consumers’ intended purchase behaviour towards ethical fashion, as this cohort exhibits strong purchasing power, as well as a care for ethical consumerism.M. Abstracts in English and SesothoThis qualitative case study explored teachers’ perceptions on the decline of the Sesotho language among Grade 4 learners in Ekurhuleni South District. Six Sesotho teachers from six public primary schools were purposively selected. The socio-cultural theory and the interpretivist perspective guided this study. Data were collected through interviews and observations and transcribed and arranged into codes and themes, using the thematic data analysis method. The study found out that the promotion of the home language within a multi-cultural society is dependent on the incorporation of cultural activities into school curricula for learners to learn about their cultures, gain knowledge and develop new skills. The study also found out that during the teaching of the Sesotho Home Language, teachers focused on areas such as reading and viewing, listening and speaking, writing and presenting, and language structure and conventions to ensure the development of Sesotho proficiency. Teachers supported learning with resources such as reading books, flashcards, and speaking grammatically correct Sesotho. However, it was established that teachers lack CAPS strategies knowledge which could assist in curbing the decline of the Sesotho language. The study further established that teachers did not explore innovative methods such as integrating technology into the Sesotho lessons. The study also identified several factors contributing to the decline of Sesotho in Grade 4 classrooms, such as parents not speaking the language with their children, intermarriages, urbanisation, misplacement of teachers, poor quality of Sesotho books, overcrowding, ineffective subject advisors and time constraints. Exploring the evolution of external auditing in corporate governance and its role in curbing corruption in the South African public sector
Abstracts in English, Xhosa and SothoThis research explored how external auditing evolved in corporate governance to curb corruption in South African public sector from 2018 to 2022. The research commences by providing an understanding of corporate governance. The research further explores the evolution of external auditing as a component of corporate governance and discusses the audit expectation gap concept. The research identifies the Public Audit Amendment Act No. 5 of 2018 as a development occurring in external auditing legislation in South Africa from 2018 to 2022. This development is explored to determine how it contributed towards curbing corruption and addressing the audit expectation gap from 2018 to 2022. The research is a qualitative study framed in the critical theory paradigm using documentary analysis. Exploring muti murder and the supernatural in selected Southern African novels: the case for (magical) realism.

understanding muti murder and other supernatural elements in selected southern African
fiction namely Alexandra McCall-Smith’s The No.1 Ladies’ Detective Agency (1998),
Christine Mary Elliott’s Sibanda and the Rainbird (2013), Zakes Mda’s Ways of Dying (1995) and Lauren Beukes’ Zoo City (2010). Postcolonial theory is adopted to navigate through the research questions of this study. Each chapter offers a distinct analysis of the novels noting that muti murder affects a text’s classification. Mda employs Intsomi to express muti murder in Ways of Dying, while Beukes in Zoo City employs faith-based magical realism. Developing a work engagement framework for employees in the tertiary education sector in Zimbabwe
Text in English with summaries in Xhosa and ZuluThe study focused on the construction of a work engagement framework, by investigating the relationship between perceived organisational justice, the psychological contract, work engagement and socio-demographic variables (age, gender, employment status and employment category). This is to inform work engagement strategies for different socio-demographic groups of employees in the context of the tertiary education environment in Zimbabwe.
A quantitative survey was conducted on a sample of academic and non-academic (permanent and contract) staff (n = 336) at the selected tertiary institution. The post-positivist philosophy and the census sampling technique were adopted. The bivariate correlations indicated strong relationships between perceived organisational justice, the psychological contract, and work engagement. Stepwise regression analysis revealed perceived organisational justice and the psychological contract to be the strongest predictors of work engagement. Moderated hierarchical regression analysis revealed that the identified socio-demographic variables did not moderate the relationships between perceived organisational justice, the psychological contract, and work engagement. Spearman’s bivariate correlation and regression analyses informed structural equation modelling and revealed a good fit between perceived organisational justice, the psychological contract, and work engagement. Statistically significant differences were found in respect of the socio-demographic variables. From a theoretical standpoint, the study enhanced deeper comprehension of the hypothesised work engagement framework; on an empirical standpoint, the study developed an empirically tested work engagement framework; and on a practical level, individual-level and organisation-level interventions pertaining to the work engagement framework are recommended for human resource managers.Esi sifundo sagxila ekwakheni isikhokelo somsebenzi ngokuphanda ulwalamano phakathi kobulungisa bequmrhu obucingelwayo, isivumelwano sesimo sengqondo nokusebenza nemiba yezobalo loluntu (ubudala, isini, uhlanga, nesimo sengqesho). Towards a skills development modeel for a South African mining organisation
Abstract in English with Afrikaans translationOrientation: South African mining companies are facing the loss of organisational knowledge due to retiring talent, the Great Resignation, and skills attrition due to remotely located work sites and harsh and hazardous working conditions. The sector is rapidly moving towards automation, and organisations are competing for engineering, electrical, and administrative skills to manage these systems. Mining organisations thus need a skills development system to address technological advances and global industry trends in order to remain sustainable and competitive.
Motivation for the study: The company under study, a large mining house in South Africa, did not redesign its skills development system after a recent merger, causing employee dissatisfaction. The organisation remained focused on compliance with legislation regarding skills development in the mining industry.
Research purpose: The study aim was to gather insights into current shortcomings and future needs with regard to skills development, to identify the elements required — represented in a theoretical framework — towards developing a comprehensive and fit-for-purpose model of skills development for a mining organisation in South Africa.
Research design, approach, and method: This exploratory study followed a qualitative research approach. Data were gathered through semi-structured interviews with 11 purposively selected managers and two focus groups (with eight and nine participants, respectively) consisting of non-managerial staff across various departments. The data were analysed using thematic analysis.
Main findings: This research revealed that, for a skills development system to be effective, it has to be based in a culture of a learning organisation and transparency regarding opportunities, together with accessibility. Mining organisations should identify skills gaps, both current and future, and design job- and career-specific development initiatives for both ‘hard’ and ‘soft’ skills, offered through a variety of methods, such as on-the-job instruction, online learning, and mentoring and coaching, coupled with formal recognition and accreditation. The system also needs to be supported by continual feedback loops to ensure that initiatives remain relevant over time and are improved where necessary. The vital elements identified from the findings are represented in a theoretical skills development framework upon which mining organisations could draw to develop a tailor-made and context-specific model of skills development.
Practical/managerial implications: Management should ensure that skills development initiatives are informed by skills audits, and the results of these initiatives should be monitored

continuously. Management should also implement feedback loops between employees, managers, and the HR department, enabling two-way communication to ensure that the system is continuously enhanced and curricula are updated in line with technological advances and global developments. A culture of continuous learning and transparency needs to be established in the organisation, with the visible support of executive management.
Contribution/Value-add: The study’s literature review and findings highlighted the critical elements of skills development, which informed in the development of the proposed Theoretical Framework of Skills Development for a Mining Company in South Africa.Oriëntering: Suid-Afrikaanse mynmaatskappye staar die verlies van organisatoriese kennis in die gesig as gevolg van uittredende talent, die Groot Bedanking en vaardigheidsverlies as gevolg van afgeleë werkterreine en strawwe werksomstandighede.
