    Gebundene Kontrolle

    No full text
The standards that the Federal Constitutional Court applies, based on the Basic Law, to the democratic legitimacy of state organs acting with sovereign authority are identified through a jurisprudential analysis and then applied to the Court itself through a deductive approach. Finally, based on the model of bound control, an equivalence between the function of the Federal Constitutional Court and its democratic legitimacy is established

Unbound Queer Time in Literature, Cinema, and Video Games

    No full text
Unbound Queer Time in Literature, Cinema, and Video Games investigates the potential of queer conceptions of time to unbind forms of understanding identities. In doing so, it recognizes the power of time to determine us but chooses to queer time and turn it into an ally of unbound forms of understanding identities. Through the analysis of different media—literature, cinema, and video games—the chapters revolve around three key ideas: that there are inherently queer styles of using and dealing with time and temporality in culture; that the critical rediscovery of canonical texts and the analysis of largely ignored queer texts and authors allow for a better understanding of queer identities; and, finally, that normative conceptions of time can—and should—be challenged through critical tools that reconceptualize notions of the self around time. This volume will be of interest to postgraduate students and researchers working close to areas such as queer and gender studies, media and cinema studies, cultural studies, literary theory, comparative literature, game studies, and art history

    Reframing the Ethnographic Museum

    No full text
Since the later part of the twentieth century, ethnographic museums have come under increasing scrutiny, and many have reflected on and changed their presentation as they questioned collections so often made by colonial officials and explorers. Now is a good time to explore whether new developments in display and cultural politics provide a viable future for ethnographic museums. In particular, policies for restitution by colonial era institutions create a changed landscape for ethnographic display both in the countries from which they originate and in former colonising states. Reframing the Ethnographic Museum presents a wide range of cultural settings across the world where ethnographic displays have appeared in their local circumstances. Non-European museum strategies raise new problems but also new solutions. Nationalism has been especially significant in museology in Asia, and in Africa new museum objectives have emerged. They share a problematic future in a digital age when the aura of artefacts is challenged by digital repositories and a public less willing to travel to visit original objects. Authors in this book grapple with the new complexities facing them as curators in the contemporary world. Praise for Reframing the Ethnographic Museum ‘Ethnographic museums have been controversial – and have been undergoing re-invention – for decades. They are considered illegitimate, but have renewed prominence, as highly visible ""contact zones"" and theatres of cross-cultural mediation. This book reviews and explores the sector with insight and nuance, reporting the successes and failures of key curatorial projects, both within Europe and across the Global South.’ Nicholas Thomas, University of Cambridg

The Future of Third Sector Research

    No full text
The volume discusses the current state of international comparative Third Sector research and potential avenues for future development of the field. Building on seminal work by Helmut Anheier and Lester Salamon, the volume provides necessary updates to ensure further Third Sector research is relevant and impactful due to the changing landscape of international relations and the way that the Third Sector interacts with the state, corporates, and wider civil society to face the new global challenges: environmental, economic and social. The book is articulated in five sections that are organized to move from “theory” to “definition” and “classification” towards “aggregation” (measurement, counting), plus one section dedicated to the relationship between Third Sector and faith. The sixth and final section synthesizes the scientific conversation developed in the five previous ones and opens new research paths for the future. Encompassing multi-disciplinary approaches and international points of view, the volume is directed towards graduate students and researchers across the academic spectrum as well as practitioners and policymakers working in the Third Sector. Chapter 1 Hazy-Clear Beginnings or a Purpose Beyond the Legend

    No full text
Indian traces in Korean Culture examines the enduring cross-cultural discourse between India and Korea over the centuries, emphasizing the transformative power of cultural exchange beyond geographical and temporal constraints. The book analyses how symbols transcend sensory realms and embody spiritual content and suggests that Indian associations in Korean culture reflect a hybridized nature, seamlessly blending cultural elements. The author presents various facets of the cultural exchange between India and Korea, covering Princess Hŏ Hwang-ok's legendary Indian origins shaping Korean identity, Ilyŏn's strategic documentation of Buddhism's transmission, the influence of Indian figures such as Gandhi and Tagore, an exploration of literature from ancient Buddhist verse to modern poets like Kim Yang-shik and Shiva Ryu, and a study of cultural exchange in K-pop. Facilitating a possible alternative to Huntington’s theory of the clash of civilisations, this book provides evidence that the multifaceted encounters between cultures are a historical process that co-shapes civilisational change on a global scale. The first monograph solely dedicated to India-Korea cultural connection from antiquity to the present, this book offers a paradigm shift, inviting readers to explore fresh insights and reshape their understanding of cultural exchanges. It will be of interest to researchers in intercultural communication, Cultural Studies, Cultural History and Asian Studies, in particular Korea and India

    Market-Oriented Disinformation Research

    No full text
Market-Oriented Disinformation Research explores the spread of false or misleading information online through the lens of marketing theory and consumer research. It examines how the business models of digital platforms and advertising technology firms (AdTech) generate digital markets that incentivize the circulation of harmful content for profit. Rather than viewing disinformation and misinformation as accidental byproducts, the book proposes that they thrive in the current markets designed for digital advertising and influencer marketing. Readers will learn how the amplification of disinformation can be linked to social media’s business model. Examples include how social media algorithms promote addictive content, how fake news sites use ad fraud to lure in advertising revenue, and how some content creators rely on clickbait, ragebait, bots, and conspiracy theories to boost their engagement metrics. The book is a must-read for scholars in journalism, media studies, and political communication, as well as policymakers interested in the democratic governance of social media platforms. In addition, it calls for digital marketing, advertising, and brand management professionals to take responsibility for their ad spending by advocating for greater oversight over AdTech intermediaries to prevent unethical actors from monetizing the harmful content that polarizes society and undermines democratic institutions

Viability of UNCLOS amid Emerging Global Maritime Challenges

    No full text
This open access book assesses UNCLOS' resilience and vitality as a legal framework for addressing emerging global maritime challenges. Against the backdrop of a number of emerging global maritime challenges, including the rise of sea levels and the maintenance of maritime safety and connectivity, the preservation of marine biodiversity of areas beyond national jurisdiction, and the promotion of marine scientific research, a contention has been made that UNCLOS does not provide sufficient or efficient regulation, and therefore, that countries should negotiate new legal provisions to complement or replace UNCLOS. Within this context, in the first part of the book, UNCLOS as a general well-established legal framework is reviewed. In the part that follows, an analysis of the positive points, limitations, and shortcomings of UNCLOS provisions in specific areas such as navigation rights, sea level rise, marine scientific research, and BBNJ is provided. The book goes on to a more individualized analysis and offers suggestions regarding the application of legal frameworks in UNCLOS to promote cooperation and manage maritime challenges in the South China Sea, an area where UNCLOS is often interpreted and applied with considerable variation. The book serves as a distinctive resource for practitioners, researchers, lecturers, and students in international and maritime law. It is also a valuable reference for policymakers and government advisors who want to get a thorough understanding of the developments of UNCLOS

Paradoxes of PrEP for HIV Prevention

    No full text
Available open access digitally under CC-BY licence. Pre-exposure prophylaxis (PrEP) is a drug taken by HIV-negative people that reduces the risk of getting HIV. Comparing two case studies in Denmark and Zimbabwe, this book demonstrates six paradoxes that users often encounter in navigating their PrEP journey. These paradoxes lead to contentions, uncertainties, dilemmas and ambiguities that need to be carefully and pensively responded to through what the author terms ‘everyday PrEP negotiations’. The social nature and need for such everyday PrEP negotiations help explain why PrEP works for some people and not for others. This book argues that such insight is critical to make PrEP work for more people and to inform social public health responses
