It examines the fate of pre-insolvency assignments and the legal nature of the assignment declaration under section 287 paragraph 2 sentence 1 InsO, particularly from a methodological perspective.PublishedDie Arbeit untersucht die Abtretungserklärung im Restschuldbefreiungsverfahren, das aufgrund zuletzt wieder leicht steigender Überschuldungsquote eine ungebrochen hohe praktische Relevanz besitzt. Es ermöglicht natürlichen Personen einen wirtschaftlichen Neubeginn und soll Gläubiger durch die Abtretung künftiger Bezüge teilweise kompensieren. Teil A beleuchtet die Entwicklung der seit 1999 mehrfach reformierten Regelungen und zeigt, wie sich die ursprünglich vorgesehene Trennung von Insolvenz- und Restschuldbefreiungsverfahren zunehmend auflöste. Teil B analysiert die Wirkung vorinsolvenzlicher Zessionen, die während des Regel- und Restschuldbefreiungsverfahren unwirksam sind, nach deren Abschluss jedoch wieder aufleben können. Teil C untersucht die Rechtsnatur der Abtretungserklärung insbesondere unter methodischen Gesichtspunkten, die Massezugehörigkeit der abgetretenen Forderungen sowie die Korrektur von Verteilungsfehlern im Restschuldbefreiungsverfahren

Butlers Konzept der Verkörperung aus den Gender-Studies beziehen, arbeitet der zweite Band zum Komplexen Erzählen mit dem Embodiment-Begriff der Neurowissenschaften nach F. Varela und überträgt diesen auf die literarische Produktion.
