No full textLa présente étude est le fruit d’une actualité brulante du début des années 2000 vantant le recours aux partenariat public- privé (PPP). Un dispositif conçu et imaginé qui prend son essor dans un contexte de contraintes budgétaires auxquelles font face les collectivités publiques des pays industrialisés depuis les années 1970 du fait de l’accroissement du déficit et de la dette. Au Cameroun comme partout ailleurs, le contrat de partenariat s’impose alors à tous comme un outil de production et de gestion efficace des services publics. Le contrat de partenariat public-privé est donc un contrat administratif par nature qui, comme les autres contrats de droit administratif, s’est construit à l’image des contrats de droit privé. Cependant, l’évolution de la pratique contractuelle a donné naissance à un contrat qui déroge aux règles classiques de la commande publique. L’on en vient à s’interroger sur l’impact de ce caractère dérogatoire. Plus précisément de savoir s’il tend à éloigner le contrat de partenariat des fondements de la théorie générale du contrat ? Cette étude se donne donc pour objectifs de confronter le contrat de partenariat aux principes généraux de la théorie générale du contrat afin d’en ressortir la spécificité. Une spécificité qui est autant théorique que pratique. Celle-ci sera faite à la lumière des systèmes juridiques français et camerounais. Cette étude partira pour ce faire, d’une analyse du régime juridique du contrat de partenariat public privé qui servira de base à une analyse de la pratique de ce contrat et qui s’articule autour de deux grands axes : Le premier porte sur le contrat de partenariat, un contrat atypique au regard de la théorie générale du contrat et le deuxième est relatif au contrat de partenariat comme étant une pratique contractuelle à risque.The observation of the legal framework partnership contracts in France, reports of some complexity on the fact that this is a new legal instrument. In addition, the alliance between the public person and the private person continues to be the subject of several questions. In particular, the interests of the parties to the contract. The Cameroon country in transition therefore build on these public-private partnership contracts in order to attract foreign direct investors to fill its deficit in infrastructure. This thesis will be an opportunity to take an inventory of the current development of this practice in Cameroon, to understand the structure and the specificities of the institutional and regulatory framework for the promotion of public-private partnerships in Cameroon. A comparative analysis of legal frameworks and case law, partnership contracts between France and Cameroon. For the purpose, not to graft the Cameroonian system the French concept of partnerships but rather to understand the reasons for the success or failure of these contracts in France and improve their findings in Cameroon
Motivated to Serve: A Regulator Perspective on Public Service Motivation and Organizational Citizenship Behavior
No full textDrawing on regulatory focus theory, we investigate how public employees’ regulatory orientations (promotion and prevention focus) at work affect public service motivation (PSM) and change-oriented and maintenance-oriented organizational citizenship behavior (change-OCB; maintenance-OCB). The results, based on a three-wave study of 1,397 French police officers, empirically support expectations that the two regulatory orientations may activate PSM differently and are positively associated with change-OCB and maintenance-OCB. These findings underline the role of regulatory orientations as key psychological sources of PSM and OCB, extending existing public administration knowledge. This paper suggests that police organizations could benefit from integrating regulatory focus insights into their practices
Assessing the sensitivity of the Kaplan-Meier confidence interval according to the median follow-up
No full textMedian follow-up is often used to assess the quality of follow-up in longitudinal studies. Its relevance to evaluate the quality of the produced estimations seems obvious. However, there is no clear decision rule on its use. We evaluated the quality of the Kaplan-Meier estimator of the survival rate according to different values of the median follow-up in order to propose an objective decision rule.
We performed a sensitivity analysis via Monte Carlo simulations based on a reference sample, according to the literature. The log(–log) confidence interval of the Kaplan-Meier estimator of survival rate was evaluated in terms of coverage probability and length. The Monte Carlo simulation was performed for 10,000 replications considering 170 values for the median follow-up.
We could observe a high relationship between the quality of the estimation and the median follow-up. Heavy censorship leads to an overestimation of the survival rate and anti-conservative confidence intervals. From a threshold value of the median follow-up, the values of the criteria reach a plateau and good estimations of the survival rate are achieved.
More precisely, simulations show that reliable Kaplan-Meier estimations cannot be obtained when the median follow-up is less than two thirds of the estimation time. This provides factual elements to evaluate results for long longitudinal studies or to assess ongoing cohorts
