Policy sull’accesso aperto (Open Access) alla letteratura scientifica
On January 29th 2014 the University of Trento adopted an Open Access policy which applies to all its members and their publications (scientific literature), except the works destined to commercial publishing with payment of royalties (unless otherwise specified by the author).
The policy consists in an Immediate Deposit and Optional Access (ID-OA) mandate: as soon as a work is accepted for publication, it must be deposited in the University Open Access Current Research Information System (CRIS) in the digital final accepted draft (whenever possible, the publisher’s proprietary PDF version). The deposit consists in the full text and bibliographic/contextual metadata. Upon careful check of the intellectual property rights, the work is published in OA through the University Institutional Open Access Repository, immediately after the deposit or within six (twelve for human or social sciences) months from the date of acceptance
Failure Processes in Embedded Monolayer Graphene under Axial Compression
Exfoliated monolayer graphene flakes were embedded in a polymer matrix and loaded under axial compression. By monitoring the shifts of the 2D Raman phonons of rectangular flakes of various sizes under load, the critical strain to failure was determined. Prior to loading care was taken for the examined area of the flake to be free of residual stresses. The critical strain values for first failure were found to be independent of flake size at a mean value of –0.60% corresponding to a yield stress up to -6 GPa. By combining Euler mechanics with a Winkler approach, we show that unlike buckling in air, the presence of the polymer constraint results in graphene buckling at a fixed value of strain with an estimated wrinkle wavelength of the order of 1–2 nm. These results were compared with DFT computations performed on analogue coronene/PMMA oligomers and a reasonable agreement was obtained

Casa Rosmini è, prima di tutto, testimone di esperienza. Se ciò vale in generale nel momento stesso in cui si ponga l’ipotesi di una casa-museo, sarà ancor più determinante se si tratta – come nel nostro caso – di una ‘casa-luogo di pensiero’: filosofico, storico, sociale, religioso.
Senza alcuna pretesa esaustiva il saggio si propone di raccogliere una serie di dati, in parte noti e in parte non ancora, al fine di tracciare una mappa ricognitiva del patrimonio di Casa Rosmini, di riconoscerne caratteri
e valenze, di proporne una sistematizzazione. Si vogliono così prendere in considerazione come unico insieme la casa, la sua storia, i suoi personaggi, le sue raccolte. Nuove considerazioni si volgono a fornire una chiave di lettura riferita a quanto lo stato attuale degli studi ci consegna.
Tale chiave interpretativa non è fine a se stessa, ma sottende un principio: la conoscenza dell’edificio e del suo patrimonio permette di immaginare un futuro per l’uno e l’altro, fermi restando i limiti dati dalla realtà
La responsabilità civile nell'attività sciistica = Ski Accidents and civil Liability
According to data collected from Dolomiti Superski, in the season 2013/2014 nearly ten million days of ski passes have been sold for a total of about 149 million "beeps", and that only in the Alpine area that ranges from San Martino di Castrozza to Plan de Corones, Val di Fassa, Alta Pusteria. These data give a measure of the size reached by this sport nowadays. Beautiful landscapes and bashed slopes, that seem snooker tables, attract millions of enthusiasts every winter, children and adults, from beginners to the more experienced ones.
Unfortunately, due to the crowding of ski areas, due to the harsh weather conditions occurring sometimes, due to the imprudent skiers or careless operators of the lifts or ski instructors, accidents occur as a result of which often skiers suffer damage, even serious ones, and hence the assault to the Courts to ask for compensation.
The legislator, pushed by the growing number of the ski area visitors and, with it, the number of accidents, enacted Law 363/2003 in order to regulate the obligations of operators of ski areas and the behavior of skiers. The main purpose of this law is to prevent accidents through a more careful and aware exploit of the slopes, both on the part of managers and users ... but once the incident occurred, however, the law in question fails to provide operators with the right elements to determine the consequences of accidents, and respond to requests for damages. The article 4 of Law n. 363/2003, for example, states that, in case of accidenti s identifiable a civil liability of the operator of ski areas, but it gives no indications about the nature of that responsibility. No Law, nor the 363/2003 or L. n.81/1991 - specifically dedicated to the profession of the ski instructor - tells us if the ski instructor can be considered responsible for the damages occurred to the pupils during lessons and which kind of responsibility the ski instructor has to face.
In absence of law evidence, the search for criteria and solutions about the responsibility of the operator, the ski instructor, the school, the costumer, in case of an accident, is left to the ingeniousness of the interpreters.
The task assigned to the jurist is complex and intricate because the field of civil liability is full of nuances and the reality of the litigation is varied and multifaceted: the same ski accident is often assessed either through the rules of tort liability either through those of the contractual liability, with significant differences in terms of burden of proof and time limitation for the actor
Enforcement del diritto d'autore nell'ambito di Internet vs. protezione dei dati personali: bilanciamento tra diritti fondamentali e contesto culturale = Copyright enforcement in the Internet vs. personal data protection: balance between fundamental rights and cultural context
The starting point of this research are a number of selected lawsuits in which copyright holders have tried to enforce their rights against Internet users suspected of illegal file-sharing. In so doing, copyright enforcement collided with users’ information privacy. Employing a comparative and multidisciplinary approach, my aim is to understand the way judges solve the mentioned conflict between information privacy and copyright enforcement. The comparison involves the European system (with particular regard to Italy) and the North American ones (US and Canada). The idea behind my analysis is that technology affects society, which in turn affects lawmakers, and even judges. Indeed, judges do not live a secluded life, but operate within a society. Therefore, it is at least plausible, if not necessary, that their decisions reflect the values of that society. Many studies illustrate the way courts decide and if and how they can be influenced by the society and culture in which they operate. To assess if my statement is sound, I shall consider the perception of copyright in the three normative systems. The same analysis is undertaken with regard to information privacy. Importance is given also to the policies adopted for the two rights. Unsurprisingly, technology has affected in many ways the substance of both privacy and copyright norms, as well as people’s lives and people’s way of behaving. This has led to a different perception of the need to protect the aforementioned rights. The question I mean to answer is the following: could this be a reason why, despite similar legal frameworks, the outcomes of lawsuits are quite different among the considered legal systems? This is the goal of my research, conscious of the fact that anyway my answer can be just one of the many possible explanations

From Knowledge Organization to Knowledge Representation
So far, within the Library and Information Science (LIS) community, Knowledge Organization (KO) has developed its own very successful solutions to document search, allowing for the classification and search of millions of books. However, current KO solutions are limited in expressivity as they only support queries by document properties, e.g., by title, author and subject. In parallel, within the Artificial Intelligence and Semantic Web communities, Knowledge Representation (KR), has developed very powerful end expressive techniques which, via the use of ontologies, support queries by any entity property (e.g., the properties of the entities described in a document). However, KR has not scaled yet to the level of KO, mainly because of the lack of a precise and scalable entity specification methodology. In this paper we present DERA, a new methodology, inspired by the faceted approach, as introduced in KO, that retains all the advantages of KR and compensates for the limitations of KO. La prima tesi di laurea italiana in tema di sci e responsabilità civile = The first Italian dissertation on skiing and civil liability
Nell’anno accademico 1969-70 la tesi di laurea in giurisprudenza di Gianfranco de Bertolini era, almeno in base ai dati che possono oggi compulsarsi attraverso le moderne banche dati bibliografiche, la prima analisi giuridica che affrontava sistematicamente il tema delle regole che presiedono all’allocazione dei danni occorsi sulle piste da sci, un argomento che all’epoca solo timidamente faceva le sue prime apparizioni sui repertori di giurisprudenza, Quasi 45 anni dopo questa tesi merita di essere ripubblicata in veste digitale in open access sul WEB per almeno due motivi.
Primo, si tratta di un lavoro di ricerca inedito e originale che riveste un’evidente importanza storica per quanti studiano oggi un tema oggi routinariamente dibattuto nei tribunali, essendo al centro di un contenzioso in continuo sviluppo. In secondo luogo, leggendo le pagine di questo allor giovanissimo autore, il lettore vi troverà un’analisi giuridica che anticipa di almeno un dccennio le coordinate del dibattito sul tema della responsabilità civile nella pratica dello sci, con spunti decisamente originali che solo molti anni dopo troveranno modo di emergere nell’analisi dottrinaria e giurisprudenziale, a conferma – se non altro – delle doti di analisi che l’autore della tesi in parola ha poi avuto modo di mettere in evidenza nel corso della sua fortunata carriera di giurista pratico.
In the academic year 1969-70 Gianfranco de Bertolini’s JD disseration on “La responsabilità civile nell’infortuio sciistico” [Civil Liability and Ski Accidents] was, for what it can be today ascertained looking into bibliographical resources and data bases, the first piece of scholarship dealing with the (then) timidly raising issue of the allocation of damages for accidents occurring on the Italian ski slopes. Almost 45 years later, this dissertation deserves to be republished in digital form and made available in open access on the WEB for at least two reasons. First, it has clearly an historical importance for those who study what today has become a field of anlysis routinely debated in court, giving rise to a boosting litigation. Secondly, the reader will find in this early piece of scholarship a sharp analysis on a host of legal arguments, central for the development of the law of civil liability on the ski slopes, which emerged in legal scholarship and in case law only in the 80’s, to confirm the accuracy and inventive of the (then) young author.
