    Expanding American Indian Land Stewardship: An Environmental Solution for a Country in Crisis

    Land is the central foundation around which all life is formed. Therefore, societies must have a stable connection with the land in order to be structurally sound. If this connection is weak or inflexible, every building-block of civilization laid on top of it will inevitably crumble. Some societies have established stable relationships with the land by working around and responding to nature’s rhythms in order to satisfy their needs. Whereas other societies have ignored nature’s intricacies and instead have tried to strong-arm nature into yielding to their whims. These two diametrically opposed approaches to conceiving of humans’ relationship with the land are exemplified by America’s Indigenous peoples and Colonial immigrants, respectively. Over the 15,000 plus years that American Indians have spent on this continent, they have developed a system of land use that has allowed them to live sustainably within their means. They have also created a system of land stewardship that reflects their deep reverence for the land as a living, breathing entity. This is in stark contrast to the system developed by White immigrants, which treats the land as a commodity, and fails to devote resources to its protection, unless it is benefitting a private interest. As this paper will demonstrate, these conceptions of land are deeply entrenched in each society’s identity. Thus, if America’s federal government is to find a solution to its self-inflicted climate crisis, it must look outside of itself for answers. It must instead look to the infinite stores of wisdom that have been passed down for generations by our Nation’s original inhabitants. But America must be careful not to perpetuate its appropriative track record by integrating this wisdom into its existing management system without also integrating the Indigenous peoples that provided it. Only by recognizing American Indian land rights will America have a fighting chance in saving this country from environmental extinction. As an achievable first step, the U.S. federal government must recognize American Indians’ international law right to Free, Prior, and Informed consent

    This paper offers a conceptual portrait of leadership and a framework for exercising it in the realm of ethics. The paper provides an account of what constitutes leadership, a set of moral standards for its ethical exercise, and a distinction between leadership that meets these standards and leadership that not only meets them, but positively engages them. This engagement is central for leadership in ethics. The main context for analysis in the paper is organizational. Leadership is essential for the success of organizations and morally important in their daily operations. The paper also describes its nature and role in less structured realms. Leadership is not limited to chains of command, not separable from elements in a culture in which it is exercised, and not confined to any one sphere of endeavor or even to the realm of work

    In the presence of trimethylsilyl trifluoromethanesulfonate (TMSOTf) and 2,6-lutidine, α,α-disubstituted aldehydes condense with electron-rich aromatic aldehydes to yield β, β- disubstituted styrenes. More electron-rich aromatic aldehydes react more rapidly and in higher yield. Preliminary results suggest that the reaction may proceed via the ionization and formal deformylation of an aldol intermediate

    This Article reviews significant recent developments in the laws affecting Virginia state and local taxation. Its Parts cover legislative activity, judicial decisions, and selected opinions and other pronouncements from the Virginia Department of Taxation (the “Tax Department” or “Department of Taxation”) and the Attorney General of Virginia over the past year. Part I of this Article addresses state taxes. Part II covers local taxes, including real and tangible personal property taxes, license taxes, and discrete local taxes. The overall purpose of this Article is to provide Virginia tax and general practitioners with a concise overview of the recent developments in Virginia taxation that are most likely to impact their clients. However, it does not address many of the numerous minor, locality-specific, or technical legislative changes to Title 58.1 of the Code of Virginia, which covers taxation

    Covid-19 and Energy Justice: Utility Bill Relief in Virginia

    Energy justice has captured national attention as scholars have spotlighted inequities in energy production and distribution activities, energy and utility regulation, and the clean energy transition. Within this broader context, this Article reflects on the successes and setbacks for the movement toward energy justice through a case study focusing on legislative, executive, and regulatory attempts between 2020 and 2022 to provide relief for Virginia utility customers harmed by the COVID-19 pandemic. The Article begins by defining the problem of energy insecurity and demonstrating that the pandemic exacerbated existing energy insecurity for vulnerable citizens of Virginia. It then traces the efforts over this two-year period of the General Assembly, Governor Northam and the Virginia State Corporation Commission to address the challenge, through temporary moratoria on utility bill payments and other means, including proposals to provide direct relief to utility customers and more sweeping proposals to reform Virginia’s public utility law to comprehensively address energy insecurity concerns. Ultimately, even though only modest relief was made available, advocates could also claim success with the enactment of a new state law that adopted and subsequently modified a new Percentage of Income Payment Program that is to be further refined and implemented by agency actions. Looking more broadly at these actions, one may draw encouragement from the fact that issues of energy insecurity have featured more prominently than ever before in Virginia’s energy policymaking discussions and that activists at all levels have created advocacy networks that may prove durable in the long run. Still, the Article concludes, much more remains to be done to address energy justice during the upcoming multi-decade clean energy transition put in motion by the Virginia Clean Economy Act

    Zeros of optimal polynomial approximants in ℓp

    The study of inner and cyclic functions in ℓ spaces requires a better understanding of the zeros of the so-called optimal polynomial approximants. We determine that a point of the complex plane is the zero of an optimal polynomial approximant for some element of ℓ if and only if it lies outside of a closed disk (centered at the origin) of a particular radius which depends on the value of p. We find the value of this radius for ≠2. In addition, for each positive integer d there is a polynomial of degree at most d that minimizes the modulus of the root of its optimal linear polynomial approximant. We develop a method for finding these extremal functions and discuss their properties. The method involves the Lagrange multiplier method and a resulting dynamical system
