INTRODUCTION

The advocate traveling the RICO1 road might well liken his expe-
rience to Dorothy of the Wizard of Oz as she trod down the "yellow
brick road." Examining the strange results in cases across the land,
he might wonder what sort of strange creature he will next encoun-
ter-a strawman, a tinman or, perhaps, the heartless lion. Most
assuredly, he will have seen cases by the dozen in which
"strawmen" are raised early on in decisions, only to be whisked
away in the final result. Then too, he will have seen narrow, brittle,
tin like decisions hewing closely to the most conservative interpreta-
tion of the RICO statute. He may well speculate with others at the
apparent lack of heart that the Supreme Court seems to have for
entering into the RICO fray.
To those of us who have followed closely the development of
Civil RICO from its twelve years of virtual somnolence, followed by
the explosion which has occurred since 1982, the California West-
ern Law Review Symposium promises to be a most timely event.
Civil RICO stands at the crossroads in the ongoing development of
this juggernaut of legal remedies. The full breadth and scope of
actions cognizable under RICO is limited only by the imagination
of aggressive litigators.
In the rapid expansion of RICO litigation, the commercial litiga-
tor seemed at first to be the prime mover in developing novel causes
of action. Thus, almost any matter predicated upon an allegation of
fraud could be molded into a RICO claim and lawyers by the hun-
dreds flocked to outdo each other in structuring causes of action.

From "prime rate" cases to section 1983 actions, with stops along
the way for security law violations, the course of Civil RICO has
indeed run the gamut.
Similarly, the field of those who have adopted RICO actions has
broadened to include labor lawyers, both on the side of unions and
management, insurance related cases, and class actions of every
nature.
Another area where the dust has hardly settled, and indeed is just
now gathering, is that of the possible use of the injunctive provisions
of RICO. Depending upon the course eventually taken by the
courts, be it narrow, liberal or somewhere in between, the entire
area of RICO's application to the injunctive remedy has the poten-
tial for expanding the use of the statute by geometric proportions.
Courts throughout the country have grappled with the broad
terms of the statute in varying ways. From an early restrictive view
which characterized many lower court decisions, to the more liberal
construction extended by most Appellate courts, the cases indeed
have been the height of inconsistency and have posed serious
problems to lawyers seeking to advise their clients as to predictable
results. The whole body of law continues to grow concerning each
and every element of the statute and indeed it is not too far off the
mark when we look at the cases construing "by reason of" a viola-
tion of section 1962, to say that virtually every phrase of the statute
furnishes an opportunity for judicial interpretation. "Enterprise"
has already attracted the scrupulous attention of judges all over
America with little, if any, consistent results.
Even as the contributors to the Symposium prepare for the task
of constructing signposts along the RICO road, circuit court opin-
ions indicating radical changes from previously established direc-
tions make the seers of RICO less than confident in forecasting the
way of the future for Civil RICO. Probably the most striking exam-
ple of the quandary in which the RICO student finds himself is
found in the recent action of the Second Circuit, when it handed
down a trilogy of cases holding that to sustain an action there must
be a showing that the defendant has previously been convicted of
predicate crimes and that the injury suffered other than that caused
by the predicate crimes must in fact be a separated "racketeering
enterprise" injury. Compounding the problem is the fact that in
each case the court split in its decision.
In what must be deemed a most unusual posture for the Second
Circuit, these cases represented a pointed change of view from the
majority views of other panels of the Court who had earlier held far
more liberal views. The Second Circuit, when called upon to re-

solve the conflict, amazingly voted 8-3 against en banc considera-
tion of the cases.
While scholars continue to debate the future course of those
cases, the Third Circuit, which had consistently supported the
broader view of RICO, recently (February 1, 1985) reversed and
remanded a district court decision for the plaintiff on a 1962(c)
claim for the reason that the RICO "enterprise" and the corporate
defendant were not distinct entities. Whether this portends a
deeper philosophical change of heart, only time will tell.
The Litigation Section of the American Bar Association and the
Corporation and Business Section have combined their resources in
polling their memberships (almost 100,000 in total) seeking to as-
certain the views of practitioners in the RICO field as to their opin-
ion of the rapid growth of RICO and specifically whether legislative
changes should be sought.
Classic evidence of the need for the exchange of ideas which this
Symposium promotes can be found in the actions of other interested
parties.
The Office of Legal Policy of the United States Department of
Justice is in the midst of an in depth study as to the status and
future of both civil and criminal RICO. Civil RICO also received
the close attention of "The Vice President's Task Group on the
Regulation of Financial Services." In their report, after noting that
"RICO is attractive to litigants because it provides treble damages
and attorney fees that are unavailable under banking or security
laws and due to the breadth and ambiguity of the statute," it went
on to state, "consequently, the Task Group recommendations
would limit the application of the civil penalty provisions of RICO
to prevent their misuse by private parties in cases solely involving
legitimate business activities by financial institutions."
Deputy Attorney General Carol E. Dinkins, in a recent address
delivered at the University of Houston Law Center described the
RICO statute as "one of the most important and controversial
weapons in the government's legal arsenal and in the legal arsenal
of private plaintiffs." She went on to note that the statute is one
which is extremely powerful because of its broad substantive reach.
Until the Supreme Court enters the fray of Civil RICO, it is safe
to say that the turbulent RICO waters will continue to boil
unabated.
All litigators look forward with great interest to the work of the
California Western Law Review Symposium.

ANIMAL RIGHTS AND THE LAW. By Daniel S. Moretti. Dobbs Ferry,
N.Y.: Oceana Publications, Inc., 1984. Pp. 147. $7.50.
In this book, the author discusses seven areas of animal welfare legisla-
tion: 1) anti-cruelty laws, 2) laboratory animal welfare laws, 3) animal
trapping laws, 4) animal fighting laws, 5) wildlife legislation, 6) humane
slaughter laws, and 7) animal transportation laws. Each is accompanied
by a corresponding section in the appendix. This appendix gives the law
being discussed or information as to where the actual law may be found.
The author suggests that there are a number of state and federal laws
aimed at protecting animals from mistreatment. However, in his view,
these laws have been largely ineffective. A principal reason for their inef-
fectiveness can be attributed to a lack of funding, which could provide the
manpower necessary for enforcement. For example, state officials cannot
always check cars, trucks or trains to determine whether animals are being
transported under cruel conditions. Likewise, there are not enough forest
officials to make sure traps are checked within the prescribed trap-check-
ing times. In spite of the many impediments to enforcing animal protec-
tion laws, the author suggests in his final chapter, several thought
provoking alternatives, which if implemented could improve the legal sta-
tus of animals.
APPELLATE LITIGATION. By Richard R. Lynn. New York, N.Y.:
John Wiley & Sons, Inc., 1985. Pp. 542. $25.00 (cloth edition-$75.00).
Many lawsuits remain alive and difficult to settle until the final appellate
remedy has been exhausted. While there are several general works avail-
able to guide practitioners through the appellate process, the premise of
this book is that there are fundamental changes taking place in appellate
courts which should alter the basic attitude of appellate lawyers and dra-
matically change old habits. These changes have been discussed in jour-
nals and bar meetings, however, attention is usually focused on only one
issue at a time. Among the issues discussed are crowded appellate dockets
and oral argument restrictions.
This book is intended to be a comprehensive restatement of appellate
procedures and strategies in a modem context. It covers civil, criminal,
and administrative agency appeals in both state and federal courts. The
Federal Rules of Appellate Procedure are the starting point for much of
the discussion, and many principles in the Federal Rules are reflected in
the state appellate system. Where they differ, the procedures in both state
and federal appellate systems are outlined. Appellate procedure in the
United States Supreme Court is discussed in detail, while practice before

the various state supreme courts is described in broader terms. No appel-
late practice book can supplement the need to closely follow the appellate
court in your state. Continuing legal education and practice materials gen-
erated by state bar associations furnish details which are beyond the scope
of any nationwide publication. Nevertheless, this work prepares you to
anticipate change in appellate procedure and to adapt easily to appellate
work in other jurisdictions. Included are charts on various appellate prac-
tice topics, designed to briefly summarize the readily available statutes or
rules in each jurisdiction regarding that topic.
CONSTITUTIONAL CHOICES. By Lawrence H. Tribe. Cambridge,
Mass.: Harvard University Press, 1985. Pp. 458. No Price Given.
This book moves beyond the much debated issue of which judicial ap-
proaches to enforcing the Constitution are "legitimate" and which are not.
The author argues that all claims to legitimacy must remain suspect. In-
stead, the book focuses on the choices that must be made in resolving ac-
tual constitutional controversies. To do that, there is an examination of
problems as diverse as interstate banking, gender discrimination, church
subsidies, the constitutional amendment process, the war powers of the
President, and first amendment protection of American Nazis.
The author challenges the ruling premises underlying many of the
Supreme Court's positions on fundamental issues of government authority
and individual rights. The book discusses how the Court increasingly re-
sembles a judicial office of management and budget, straining constitu-
tional discourse by "balancing" what it counts as "costs" against what it
deems to be "benefits."
The author next explains how the Court's "calculus" systematically ex-
cludes basic concerns about the distribution of wealth and power and con-
ceals fundamental choices about the American policy. What is needed is
more candid confrontation of those choices and of the principles and per-
spective they reflect. The author expresses what he perceives has gone
wrong with judicial opinions and suggests ways in which the Court can
begin to reclaim the historic role entrusted to it by the Constitution.
THE FEDERAL RESERVE: AN INTENTIONAL MYSTERY. By Thibaut de
Saint Phalle. New York, N.Y.: Praeger Publishers, 1985. Pp. 315.
$14.95.
The Federal Reserve was created in 1913. It is interesting that so little
is known about its regulatory activities and how it controls United States
monetary policy. Part One of this book discusses regulation of United
States banks at home. Part Two is concerned with regulation of United
States banks abroad. The author believes that it is essential that everyone
understand not only the mechanics of how the federal system actually
works, but also the impact it has on each of our lives. As a powerful
organization, it requires continual surveillance. Only if we understand

how the federal reserve functions can we hope to reform that organization
to better serve us. This book is recommended not only for the 535 mem-
bers of Congress who must make future decisions on the financial services
industry, but also any American concerned about the impact of govern-
ment on the economic and banking systems.
LEGAL ASPECTS OF CRIMINAL EVIDENCE. By J.R. Hanley and W.W.
Schmidt. Berkeley, Cal.: McCutchan Publishing Corporation, 1984. Pp.
423. No Price Given.
An investigative law enforcement officer must be concerned with gath-
ering evidence in such a way that it will be later held admissible in court.
The most successful way to accomplish this often complex task, is to have
a thorough knowledge of court decisions and the rules of evidence. If the
investigative officer's knowledge is incomplete and evidence is gathered in
a manner not legally acceptable, several things may occur. First, it may
seriously affect a person's life, liberty or property. Second, the reputation
of the officer and the law enforcement agency by which he is employed is
called into question. Finally, if the evidence is not admissible in court,
conviction of the guilty may not occur. The authors have written this
book to inform not only law enforcement officers, but also students, on the
rules of evidence that guide the enforcement of criminal law at both the
investigative and trial stages. The book is written in a style that is under-
standable to both lawyers and non-lawyers alike. Therefore, it is recom-
mended reading for anyone within the criminal law field.
OBSCENITY AND PORNOGRAPHY: THE LAw UNDER THE FIRST
AMENDMENT. By Daniel S. Moretti. Dobbs Ferry, N.Y.: Oceana Publi-
cations, Inc., 1984. Pp. 147. $7.50.
This book is more than just a statement of the law of obscenity and
pornography. The author spends a great deal of time analyzing the devel-
opment of case law in the area. He also educates the reader on the vocabu-
lary required to thoroughly understand the subject. These combined
factors allow the reader to gain insight into not only judicial reasoning, but
constitutional principles as well.
The book is organized by first defining obscenity in the early years.
From there it is followed by a discussion of the Roth Test. After these
sections, there is a chapter which discusses the 1973 Obscenity and Por-
nography decisions. The book then delves into specific topics of pornogra-
phy. Representative examples of the topics discussed are: child
pornography, pornography and motion pictures, and cable television and
pornography. There are also appendices, which include a table of cases, a
list of statutes, movies banned in the United States since 1908, and other
valuable information for those interested in this area of the law.

TANGIBLE EVIDENCE: How TO USE EXHIBITS AT TRIAL. By Deanne
C. Siemer. Clifton, N.J.: Law & Business, Inc., 1984. Pp. 326. $55.00.
The author points out that the most important events within a case can
be bolstered by the sound use of tangible evidence, which will complement
the oral testimony of witnesses. Most people learn and remember more
readily when they can see the material being explained. Also, most people
find exhibits more interesting than oral testimony and, in subtle ways,
more reliable. Both judges and jurors are affected by these phenomena.
To work with tangible evidence effectively, you need to know what objects
or techniques are available, what kind of media to select for a particular
situation, and how to qualify the material as evidence.
In Part I of the book, the author discusses the general requirements for
bringing tangible evidence into the trial through either the illustrative
materials used by the attorney, a view of the scene by the fact finder, or
exhibits used with the testimony of witnesses. In Part II, there is a discus-
sion of specific evidentiary foundations, objections, technical problems and
tactical considerations with respect to twenty different kinds of tangible
evidence. The materials in this section are directed to the procedural
problems presented by the various kinds of tangible evidence that may be
available when a lawyer plans a trial. Because of these problems, the dis-
cussion is detailed, so as to assist both the beginning attorney and the at-
torney with a specialized problem. To facilitate these diverse needs, the
chapters are subdivided using a standard format so that the various subject
matters are easy to locate. This book is recommended for all attorneys
who are concerned with how to present and use tangible evidence more
effectively at trial.
WOMEN ON TRIAL: A STUDY OF FEMALE SUSPECTS AND DEFEND-
ANTS IN THE SYSTEM OF CRIMINAL JUSTICE. By Susan S.M. Edwards.
Dover, N.H.: Manchester University Press, 1984. Pp. 288. $18.85 (cloth
edition).
All the actors in the drama of crime, trial and punishment apply to their
roles an ideology of crime, sometimes conscious, often not. This is a study
of the ways in which these theories and prejudices influence the treatment
of women suspects and defendants. The author spent two years interview-
ing all the participating groups in the criminal justice system and analyz-
ing their actions, prejudices and weaknesses. She examines the attitudes of
police officers, store detectives, probation officers, lawyers, legislators, and
bureaucrats, but the center of the study revolves around the principal char-
acters-the women on trial.
The book examines the proposition that women, whether as suspects,
defendants or offenders, are dealt with in accordance with the degree to
which their criminal behavior deviates from what is expected of them in
their appropriate gender role. Some of the expectations placed on women

are the degree to which they are seen as a good wife, mother and home-
maker, how decent and moral they are, and above all whether they are
feminine.
This study throws new light on the cumbersome and sometimes incon-
gruous processes of the law. It deals with a crucial area of concern about
sexual discrimination and offers a challenging perspective on several cur-
rent debates, such as that over the admissibility of pre-menstrual tension.
The audience that will find this book of interest is not limited to the soci-
ologist or criminologist. Those concerned with the current legal status of
women in the criminal justice system will also benefit from the author's
research.

FEDERAL TAX ASPECTS OF BANKRUPTCY. By C. Richard McQueen

1984. No price given. Bankruptcy is one of the books in Shepard's/Mc-
Graw Hill's "Tax and Estate Planning Series" which provides the special-
ized practitioner a single source for quick reference in a particular area.
As evidenced by its title, Bankruptcy is devoted to the federal tax impli-
cations of bankruptcy. More specifically, it is geared to apprise attorneys
and accountants of the form and spirit of the Bankruptcy Tax Act of 1980,
and its interaction with the Bankruptcy Reform Act of 1978 and general
federal tax law.
This entails an examination of pre-1980 Act judicial tax principles re-
garding the tax treatment accorded the discharged debtor. Following are
detailed chapters on the impact of the 1980 Act, including, particular ap-
plications to individuals and corporations, tax aspects of various business
transactions, as well as miscellaneous tax questions which confront the at-
torney for the insolvent. Bankruptcy also devotes time to the procedural
and jurisdictional import of the 1978 and 1980 Acts in addition to report-
ing obligations and the priority of federal tax liens.
The value of Bankruptcy to the attorney lies in its format and organiza-
tion. It is expansive in its coverage and smartly designed for practical ref-
erence. Bankruptcy further provides a copy of the Bankruptcy Tax Act of
1980, a table of relevant cases and planned supplements.
TAX STRATEGIES FOR SEPARATION AND DIVORCE. By William J.
Brown. Shepard's/McGraw-Hill: Colorado Springs, Colorado. 1984. No
price given. Another in the "Tax and Estate Planning Series," Divorce
again provides the lawyer with a focused work for initial reference. For
the client amidst divorce or separation, this book is a guide that confronts
one of the many issues raised in such proceedings: tax consequences.
The book sets forth the many taxable events which may exist in a mari-
tal breakup. Divorce covers tax treatment for alimony payments to ex-
spouses, for example, differences between periodic, lump sum payments or
alimony trusts. It also includes tax treatment given to property transfers,
settlements and attorney's fees as well as the relationship of estate and gift
tax laws to the dissolution of a marriage.
The true value of Divorce to the counselor lies in its use before a legal
breakup of the marriage. This book thus enables the attorney to ascertain
the most favorable tax treatment for his particular client, prior to settle-
ment. Divorce is practice-oriented, and includes an appendix providing ex-
emplar federal tax forms, a copy of the Domestic Relations Tax Reform

Act of 1984, the House Committee Report on the Tax Act of 1984, and the
Tax Reform Bill of 1984. The family, tax, or general practitioner will find
Divorce a worthy addition to the library. Supplements are planned.
EMPLOYMENT DISCRIMINATION LAW. By Barbara Lindemann Schlei
and Paul Grossman. The Bureau of National Affairs, Inc.: Washington,
D.C. 1983. Pp. 1661. No price given. Employment is a massive treatise
presented by the American Bar Association's Section of Labor and Em-
ployment Law. Exhaustive in its scope, this book is equally broad in its
appeal to the student and practicing attorney.
For the student, Employment provides a historical and scholarly view of
the development of the law in the labor and employment arenas. Employ-
ment presents a complete examination of the many categories of discrimi-
nation which exist as well as the judicial treatment of each, especially the
posture of the United States Supreme Court. This book is likewise an ex-
cellent reference for the researcher or law clerk in search of a coherent
"big picture."
Similarly, Employment offers the practitioner a practical tool for the
several issues presented by a possible employment discrimination client.
This book provides the attorney a single source for determination of the
general rights and recources available. To wit, there are chapters devoted
to unions and employment agencies, legislative sources of protection, pro-
cedure and litigation of employment discrimination cases.
This book's attributes and value can not be overstated. For the student
and scholar, Employment is a competent and well researched statement on
employment discrimination law. For the attorney, it is a cogent reference
for purposes of counseling and litigating an employment discrimination
dispute.
MANUAL OF FOREIGN INVESTMENT IN THE UNITED STATES. Edited
by: Eugene Marans, Peter C. Williams, Joseph P. Griffin and Joseph E.
Pattison. Shepard's/McGraw-Hill: Colorado Springs, Colorado. 1984.
Pp. 630. No price given. Manual is an update of a highly popular refer-
ence work on foreign investment published in 1980 by the Unified District
of Columbia Bar. To deal with the complex questions presented by a for-
eign investor, this book is designed for initial consultation.
Manual is a compilation of articles, written by authors with interest and
knowledge, regarding investment from abroad into American ventures.
While a collection of articles, the book is cogently organized into two main
sections.
The first part is devoted to the general legal requirements and considera-
tions which face the foreign investor. Specifically, there are pieces describ-
ing restrictions and limitations on foreign investment presented by the

Constitution, treaties and antitrust laws. Also discussed are tax, security

communication businesses as well as real property. In sum, this book
presents competent coverage of the many issues which are presented when
the foreign investor seeks to capitalize a United States concern.

ever-changing areas of the law. The many issues raised in a domestic dis-
pute are subject to unstable and often complex legal consequences. Agree-
ments' goal is to provide the general or family practitioner with a reference
to confront these several issues.
The method chosen by the authors is to provide a comprehensive book
which discusses the historical background of family law and traditional
policy justifications for developments in this area of the law. It also covers
the treatment being accorded family law matters by federal and state legis-
lation, as well as the respective courts.
Agreements, in providing a handy tool for reference, does not limit itself
to the status of family law in what can be described as trend-setting states.
Its treatment is much broader, setting forth the stance of all of the states in
family law matters. Thus, this book has value to every family practitioner
as it provides a comprehensive discussion for his own as well as other
jurisdictions.
