    The right of non-unionised employees and minority unions to be consulted prior to dismissals based on operational requirements

    The position of workers and trade unions has changed drastically since the introduction of a Constitutional dispensation in South Africa. The Constitution affords both workers and trade unions protectable rights and greater influence at the workplace. To vindicate and assert these rights trade unions and workers approach the courts to vindicate these rights. Section 23 of the Constitution deals with labour rights and section 18 gives effect to the right to freedom of association. To give content to these rights the Constitution provides that courts must have regard to international law. In the context of these rights, one of the principles recognised by the International Labour Organisation through its Conventions is the principle of majoritarianism. In short, the principle endeavours to give effect to the will of trade unions representing the majority of employees in a workplace in relation to trade unions that represent the minority. This is achieved through collective bargaining, which typically results in the conclusion of collective agreements, whereby trade unions are given exclusive and or preferential rights. In AMCU v Royal Bafokeng the Constitutional Court held that, the principle of majoritarianism applies to and finds expression in section 189 of the Labour Relations Act. The effect of this judgment is that members of a minority trade union may be represented by a rival majority trade union during the consultation process when an employer has contemplated dismissals based on operational requirements. The minority judgement adopted a different approach, reasoning that, the principle of majoritarianism ought not to find application in the context of dismissals based on operational requirements. It found that section 189 is intended to give effect to the Constitutional right to fair labour practices and must therefore allow a fair procedure that permits an employee to choose who may represent him/her in a consultation process prior to dismissal.Thesis (LLM) -- Faculty of Law, Department of Mercantile law, 202

    Augmenting encoder-decoder networks for first-order logic formula parsing using attention pointer mechanisms

    Semantic parsing is the task of extracting a structured machine-interpretable representation from natural language utterance. This representation can be used for various applications such as question answering, information extraction, and dialogue systems. However, semantic parsing is a challenging problem that requires dealing with the ambiguity, variability, and complexity of natural language. This dissertation investigates neural parsing of natural language (NL) sentences to first-order logic (FOL) formulas. FOL is a widely used formal language for expressing logical statements and reasoning. FOL formulas can capture the meaning and structure of natural language sentences in a precise and unambiguous way. The problem is initially approached as a sequence-to-sequence mapping task using both LSTM-based and transformer encoder-decoder architectures for character-, subword-, and wordlevel text tokenisation. These models are trained on NL-FOL datasets using supervised learning and evaluated on various metrics such as exact match accuracy, syntactic validity, formula structure accuracy, and predicate/constant similarity. A novel augmented model is then introduced that decomposes the task of neural FOL parsing into four inter-dependent subtasks: template decoding, predicate and constant recognition, predicate set pointing, and object set pointing. The components for the four subtasks are jointly trained using multi-task learning and evaluated using the same metrics from the sequence-tosequence models. The results indicate improved performance over the sequence-to-sequence models and the modular design allows for more interpretability and flexibility. Additionally, to compensate for the scarcity of open-source, labelled NL-FOL datasets, a new benchmark is constructed from publicly accessible data. The data consists of NL sentences paired with corresponding FOL formulas in a standardised notation. The data is split into training, validation, and test sets. The main contributions of this dissertation are: an in-depth literature review covering decades of research presented with a consistent notation, the formation of a complex NL-FOL benchmark that includes algorithmically generated and human-annotated FOL formulas, proposal of a novel transformer encoder-decoder architecture that is shown to successfully train at significant depths, evaluation of twenty sequence-to-sequence models on the task of neural FOL parsing for different text representations and encoder-decoder architectures, the proposal of a novel augmented FOL parsing architecture, and an in-depth analysis of the strengths and weaknesses of these models.Thesis (MSc) -- Faculty of Science, School of Computer Science, Mathematics, Physics and Statistics , 202

    Development of TiO2 nanostructures with a modified energy band gap for hydrogen extraction

    A rise in fossil fuel depletion has motivated the research towards alternative, cost effective and clean processes for energy production through renewable sources. The scientific community is currently engaged in extensive research to exploit viable, sustainable methods for generating green hydrogen. Titania (TiO2) is historically the most studied photoactive semiconductor material with great potential in photoelectrochemical water splitting (PECWS), following the discovery by Fujishima and Honda in 1972. TiO2 possesses superior physicochemical characteristics and band gap edges, which enables the semiconductor to effectively facilitate the PECWS process. Efforts are still ongoing to explore alternatives for narrowing the optical band gap energy of TiO2, for an efficient photoelectrode. In this research work, open-ended and well-ordered TiO2 nanotubular arrays were synthesised by a three-step anodization process. The third anodization was crucial to detach the TiO2 thin film from an opaque Ti metal substrate. The free-standing thin films were transferred and pasted onto conductive FTO-coated glass substrates transparent to visible light and annealed at 400 ℃ for crystallisation. The multi-step anodization has shown an improved top tube morphology by eliminating an initiation TiO2 mesh formed when a conventional single-step anodization process is used under similar conditions. To widen the absorption range of the samples, CuO nanosheets were deposited onto nanotubular TiO2/FTO films through successive ionic layer adsorption (SILAR), a wet chemical method. The formation of a CuO/TiO2 nanostructure enhances the transfer of photogenerated carriers, suppressing charge recombination. This research focused on investigating the influence of selected SILAR parameters on the formation of CuO nanostructures. The first was the effect of precursor concentration on the structural, morphological and optical properties of the CuO/TiO2/FTO nanostructured photoelectrode. The effect of the precursor concentration on the structure and morphology was evident in the X-ray diffraction (XRD) patterns and scanning electron microscopy (SEM) micrographs. Crystallite sizes of deposited CuO increased from 10.6 nm to 15.7 nm when precursor concentration was varied from 0.02 M to 0.10 M. The UV-visible absorbance results show that an increase in precursor concentration leads to a red shift of both the peak absorbance and edge wavelength of the CuO/TiO2/FTO absorbance spectra. This phenomenon is believed to be caused by the presence of CuO, which exhibits active absorption in the visible spectrum. As evidenced by the study, the continued increase in precursor concentration does not result in a further widening of the absorption band. This is demonstrated by the example of a CuO/TiO2/FTO sample decorated with a 0.2 M precursor. The second was the effect of SILAR immersion cycles on the properties of the CuO/TiO2/FTO nanostructure developed. The increase in the number of immersion cycles led to a notable progression in the adsorption cupric oxide on the TiO2/FTO samples. A redshift in the absorbance peak and edge wavelength is observed in the UV-visible spectra of CuO/TiO2/FTO photoelectrode. The efficacy of the SILAR technique in modifying the absorption band of nanotubular TiO2 thin films has been conclusively demonstrated through comprehensive analysis and correlation of the relationships between the structure and optical properties, as evidenced by the XRD patterns, Raman spectra, SEM, TEM micrographs, and UV-visible absorbance spectra.Thesis (MSc) -- Faculty of Science, School of Computer Science, Mathematics, Physics and Statistics, 202

    Early screening for the post intensive care syndrome in a tertiary ICU follow-up clinic in the Eastern Cape

    The Post ICU Syndrome (PICS) is defined as a constellation of new or worsened impairments in physical, cognitive, and/or psychological health which persist after critical care discharge. These deficits are more related to the patients’ intensive care unit (ICU) stay rather than to their original ICU admission diagnosis. Between 25-50% of critical care survivors suffer from PICS. There is a paucity of research on PICS in South Africa (SA). The primary objective of this study is to describe the incidence and co-occurrence of PICS symptoms, as well as the changes in instrumental activities of daily living and life roles in ICU survivors.The study was conducted in a multidisciplinary tertiary ICU in the Eastern Cape. Inclusion criteria were respiratory support for ≥ 48 hours, or a shocked state, and/or organ failure requiring ICU stay for 48 hours. Patients were assessed at six weeks and six months after hospital discharge. Physical impairment was measured by the six-minute walk test and ICU-acquired weakness by the Medical Research Council scale. Instrumental activities of daily living score and employment/educational status were determined. The Hospital Anxiety and Depression Scale and Impact of Event Scale-Revised questionnaires were used as screening tools for significant psychological symptoms. Screening for neurocognitive impairment was performed with the NeuroScreen application and compared to a matched control group. The Short Form-36 Health-Related Quality of Life questionnaire (HRQOL) was used to determine quality of life at baseline and study visits. 107 patients, half of whom had COVID-19, completed the six-month follow-up. Six months after hospital discharge, six out of ten patients were affected by PICS, five out of every ten suffered from physical impairment, four out of every ten reported significant psychological symptoms, with three out of every ten affected by both. Three out of ten experienced significant chronic pain. Overall, six out of every ten patients experienced significant psychological symptoms at either one or both study visits. Only one in ten had psychological symptoms in isolation at six months. Six out of every ten patients reported a significantly lower health-related quality of life at six months as compared to their baseline. Three out of every ten patients had not returned to their previous remunerative work, studying or home making. Neurocognitive impairment in this cohort was not verified, and this may have been due to the selection of the control group. However, there was a significant improvement in neurocognitive functioning from the six-week to the six-month study visits. Only 15% of patients received rehabilitation therapy after hospital discharge. Female sex, a higher co-morbidity score and an admission diagnosis of trauma were predictors of PICS symptoms. The study aimed to investigate the challenges facing indigenous games in Libode; to contribute within the anthropology of sport with specific reference to Libode in the Eastern Cape Province and to come up with recommendations with the view of addressing some of the challenges facing indigenous games in Libode. The study employed a qualitative approach and used interviews, questionnaires, observations, and participant observations as data collection methods. Data analysis was done through thematic data analysis. Cultural preservation was used as a conceptual framework for this study to understand the view of the participants in Libode.     This study sought to assess the level of community participation in disaster management by the communities that are most affected by floods and fires in informal settlements. The study aimed to assess the level of awareness of disaster risks at a community level and thereby provide recommendations to increase the level of participation, involvement and awareness in disaster management by the communities. This research adopted both qualitative and quantitative research approaches to form a mixed-method research approach. Data was collected using both approaches and converged to form the results and analysis of the empirical survey.     The influence of the physical environment on invertebrate larval transport, settlement and recruitment with insights on early-stage physiological performance

    Most marine benthic organisms have a biphasic life cycle whereby the larvae are pelagic, and their distribution, transport and settlement are largely controlled by environmental factors. Among these factors, hydrodynamics have key direct effects. Nearshore water hydrodynamics are strongly influenced by wind. This study investigated whether wind indirectly affects the distribution, settlement and recruitment of invertebrate marine larvae. Additionally, larvae are exposed to a more constant, benign environment than they will experience after settlement, and therefore the possible effects of larval thermal history on the physiological plasticity of settled organisms was also estimated for possible long-term insights into population dynamics. Four sites, two on the western and two on the eastern side of Algoa Bay in Gqeberha (formerly known as Port Elizabeth), South Africa, were chosen for larval collection. Sites at opposite ends of the bay were selected as they were towards either side of the dominant wind directions in this region. At each site, two sampling stations were identified at 300 and 900 metres offshore, with station replicates 300 metres apart. Sampling of marine invertebrate larvae was conducted after two days of westerly or easterly winds at either of the two western or eastern sites. The number of hours of unidirectional wind determined the prevalent wind on the two days prior to sampling. Samples were collected with a plankton pump at three depths; surface, mid-depth and bottom. Simultaneously with plankton sampling, water properties (fluorescence, temperature, zonal and meridional flow, salinity and oxygen) were measured. Settlement/recruitment samples of mussels and barnacles were collected at six sites, two at either edge of the bay and two within the center of the bay. Plastic scouring pads and PVC plastic plates covered with safety-walk, placed at least 30 cm from each other, were used to collect settlers/recruits of mussels and barnacles, respectively. The pads and plates were replaced on a monthly basis for 14 months to quantify monthly settlement/recruitment. At four of the six sites used for quantifying settlement/recruitment, settlers and recruits were collected to measure the physiological responses of these two ontogenetic stages (settlers and recruits) to acute temperature variations which they might experience in the intertidal zone. Three temperature loggers were used to record real time temperature variation at each site over the period (one month) in which the artificial collectors were in position. Factorial ANOVA was used to investigate the effects of wind, depth, site, and distance from the shore on the abundance of larvae in the water column, as well as the effects of month and site on settlement/recruitment. Additionally, multiple regression analyses were used to investigate the effects of physical parameters, including upwelling and dissipation of turbulent kinetic energy, on the abundance of both larvae, settlers and recruits. Distance-based linear models and redundancy analyses were also carried out on the abundances of invertebrate larvae. Correlation analyses were performed to investigate the effect of the number of hours of directional wind on settlement. Lastly, correlation analyses between wind and currents were carried out. The results revealed a link between winds and currents, with wind speed directly proportional to surface current speed, which, as expected, decreased with depth. Current direction was, however, not perfectly aligned with wind direction. Larval distribution, settlement and recruitment were largely associated with the nearshore dissipation of turbulent kinetic energy and upwelling. Thus, overall larval, settler and recruit abundances were indirectly affected by wind. Physiologically, there was no significant difference in oxygen consumption between the juvenile ontogenetic stages (settlers and recruits) of mussels. Recruits exposed to average and maximum temperatures, however, consumed more oxygen than those exposed to low temperatures. Wind and wind-mediated currents as well as temperature have been shown to shape the distribution and shore supply of larvae, and this study contributes to the broad knowledge of population dynamics and replenishment, and the tight relation of abiotic factors affecting biological processes on the shore.Thesis (PhD) -- Faculty of Science, Zoology and Entomology, 202

    The mediating role of generational difference on the relationship between psychological capital, psychological empowerment, organisational support and the wellbeing of South African National Defence Force members

    There is a growing concern in understanding the contribution of generational difference (as a mediating variable) and factors that increase soldiers' well-being. This study aimed to determine the relationship between Psychological Capital, Psychological Empowerment and Organisational Support, and well-being. Additionally, it proposes the generational differences as a potential mediating factor among these variables. The study was guided by a positivist philosophy and quantitative research method was employed. The sample for this research consisted of 777 members from both Internal deployed within borders of Free state and those going for external deployment at De-Brug. The results show most respondents were male (78.3%) and 21.7% female. Most respondents were categorised as Gen Y (between 1981 - 1996, 67.0%), followed by Gen X (1965 - 1980, 24.8%) and Gen Z (1997 - 2012, 8.2%). Most respondents were in the SA Army, followed by SAAF and SAMHS and the SA Navy. Spearman’s Correlation and ANOVA analyses were conducted to test the relationship between the variables. The results revealed significant relationships between the variables included in the empirical model. However, Well-being does not have a statistically significant correlation with the mediation variable, generation cohort. Similarly, generation cohorts (X, Y, Z) do not significantly correlate with the predictor variables, Perceived Organisational Support, Psychological Empowerment. However, there is a statistically significant small negative correlation between generation cohort (Age) and Psychological Capital. The multiple regression analysis exhibited a significant overall model fit, indicating that 30% of the variance in employee well-being was accounted for by the predictors. Thus, this research implicates that the South African National Defence Force (SANDF) would benefit from developing a culture and adopting policies as well as programmes that prioritises psychological well-being above physical prowess. For this reason, the present study is regarded as offering a potentially valuable contribution to the existing body of research in the positive psychology and reveals practical implications and applications within the military context. The study recommends that combat readiness requires prioritising mental health above physical strength. Policymakers should consider psychological factors like psychological capital and psychological 6 empowerment. Training programmes should include Psychological Capital and cognitive resilience. There should also be further research on positive psychology and troops' well-being. These factors can help improve peacekeeping and combat force readiness. Understanding generational variations' mediating effect can inform resilience and training programmes.
