    The criminal liability of the medical team considering the recent orientation of the Italian Court of Cassation

    This article aims to analyze the thematic of medical team liability considering the recent Italian Supreme Court case-law, highlighting the various problems linked to the identification of the responsibility of each member of the team. The participation of several subjects in the execution of medical treatment makes the question of criminal liability very complex, especially when it comes to inauspicious events, such as injuries or death, occurring during medical treatment. The question concerns the exact identification of the duty of care and vigilance of the medical team and whether this duty is in line with the principle of individual criminal responsibility guaranteed by Article 27 of the Italian Constitution. In this regard, the case-law has elaborated the so-called “principle of reasonable confidence”, according to which the division of labour that belongs to each member should involve a delimitation of his responsibility, limited only to what is within his competence, except in case of the person who organizes, directs, and controls the team. Precisely, based on this principle, the Italian Supreme Court in 2018 reasserted that in the medical team is necessary to identify the role played by each member, thus avoiding resorting to objective responsibility

    LIVING IN THE POST-PANDEMIC CITY

    This paper presents a project, under construction in the municipality of Aversa, born from a scientific collaboration between the Department of Architecture (principal investigators: professors Lorenzo Capobianco and Fabrizia Ippolito), the municipality of Aversa and the Campana Agency for Building Residential (ACER, former autonomous Institute of Popular Homes), first place in the Competition of the Campania Region for the realization of Social Residential Building Programs_PIERS of 2020. In a marginal city environment, in which all the characteristics and criticalities of the urban suburbs can be traced, this project, starts from the design of 85 dwellings distributed in 5 new buildings that "replace" the previous ones through a mechanism of progressive transfer of the inhabitants which makes it possible to build them on the same area as the buildings to be demolished, considerably extends its action by dealing with the improvement of environmental, physical and social conditions, for the neighbourhood and the community. The purpose of this contribution is to demonstrate how it is possible, starting from public buildings, to experiment with innovative ways of living in the home and the city, imagining innovative activities and spaces for relationships. The quality of the architecture starts from the design of the urban space and its collective spaces, from the new uses and from the new forms of proximity that are imagined for the post-pandemic city. The experimentation with new residential typologies (co-housing; turn-housing; co-living and housing-family/community) is accompanied by the provision of self-managed multifunctional condominium premises also to provide additional spaces that can be used for work and distance learning. Lastly, great attention is paid to the integrated design of the urban relationships and new proximity spaces that are substantiated in a new multilevel public agora and a small park with equipped greenery and areas for outdoor sports

    APPLICATION AND COMPARISON OF TWO METHODS FOR THE ESTIMATION OF THE VULNERABILITY AND SEISMIC RISK OF HISTORICAL UNREINFORCED MASONRY RESIDENTIAL BUILDINGS IN ALBANIA

    This paper discusses the vulnerability and seismic risk of historical unreinforced masonry URM buildings in Albania to earthquake-induced loads. Professionals have been using many methods to estimate the global and local structural capacity and performance of existing buildings. Non-linear methods are widely recognized and successfully applied even though they are relatively new and time-consuming. For a more practical and rapid evaluation of the need for structural consolidation of a large number of damaged buildings after strong earthquakes, two simplified methods can be used for the preliminary seismic evaluation of the structural capacity of buildings. In this research, the procedures used are described and the results of the application of these simplified methods in 11 minor existing residential buildings are shared. The first method is the FEMA P-154 method of evaluation of the probability of partial/total collapse. The second method is the Simplified Methodology by Dìaz Fuentes (2016), combined with the theoretical Principle of Virtual Works for the overturning of masonry panels. Both methods, it has been evaluated only the out-of-plane behaviour of masonry panels, as a mode of failure, since in-plane behaviour is strongly influenced by the level of compressive stresses. The comparison of results from the two methods shows that rapid evaluation methods are reliable for the preliminary selection of buildings, which might suffer partial/total collapse

    The purpose of the research is to study the way students visualise their study environment. A students’ design competition was held as part of a scientific-research project. The article analyses projects received during the competition and the tendencies they mark out concerning the role of colours and materials as an important means for visual differentiation of single-purpose functional zones in a multi-functional common space of a university study room. Projects are grouped based on the common features they share. Specifics of every group of features are compared with contemporary tendencies of using colours to optimize the working environment in study rooms

    Terms such as quality deviations, non-conformances, defects, quality failures, over budget and behind schedule are quite frequent in urban planning, architecture and civil engineering projects. The effort to analyze the parameters affecting quality, budget, schedule and functionality failure and/or diversion in construction industry is extensive. Nevertheless, the number of construction projects that have functional deficiencies minimally in one of their complementary elements is significant. The main reasons behind these deficiencies are considered to be the lack of experience, ineffective interaction of clients-consultantscontractors and corruption. This article attempts to shed light to another reason why construction projects fail to fulfill some of their main functional parameters, emphasizing that this is caused by an inconsiderate approach of the ones in charge of planning and building structures to their beneficiaries. In other words, urban planners, architects and civil engineers approach the structure in hand as “the center of the world”. This is somehow reflected in the structure which tends to demonstrate an Othering attitude, similar to that of the (former) colonizer to the (formerly) colonized, to their surroundings and beneficiaries

    In a century immersed in technological acceleration, documentation of heritage buildings is the preliminary action to solve any built heritage problem. The documentation procedure requires a wide range of quantitative and qualitative data to be investigated to produce accurate analyses from the building's digital presentation. However, capturing data and interpreting them is often done independently by different actors for various purposes. This paper aims to analyze the space of sacred objects that have converted their function and tries to include the documentation of the investigation process of the inherited heritage to draw results on the creation of space. The research will focus on the case of the Memorial of National Hero of Albania, Skanderbeg, which has undergone various transformations during different periods. Usually, a non-document of the historical material related to the building can lead to different interpretations that impact cultural monuments' restoration. Therefore, this research focuses on the converted spaces precisely for the duality that these spaces show and how carefully they should be treated during their preservation or restoration. The extracted data will be divided into four categories which include: available documentation obtained from the archives of the Institute of Monuments, historical materials obtained from the literature and related to the morphology of the structure in time, which help to create a more knowledgeable, deepened, and as a conclusion the current state of the monument obtained from the survey through laser scanner that will demonstrate to us regarding the status of heritage. This data will create a solid basis for further processes related to the visualization in different periods of the monument and carry out a comparative spatial analysis. In studying built heritage, the preparation of documentation on the converted space analysis is fundamental, contributing to "creating a permanent record" (Rossi, 1966) of the past and its presence. In the "analytical" report, its current state and understanding of its veracity encourage its preservation in the future. In this way, the visual model of the architecture and the modeling of the databases are linked together to create a complex information system that can be manipulated and interactive, and which can be helpful to understand, provide knowledge, provide communication, and enhance the values of architectural heritage

    Cities, as a source of and a solution to modern challenges (such as financial crisis or health related crisis), are complex systems that give urban policies broad spatial significance. Creating and implementing urban policies engages with many social, economic, environmental, and spatial concerns, which often conflict. Modern technologies offer new possibilities for (i) understanding the special characteristics of the urban space, and for (ii) forming alternative scenarios in forecasts or evaluations. This article uses bibliostatistics analysis and review of about 1,000 relevant articles of the period 2010 - 2021 to identify dominant planning methods and relevant technological approaches or models, with emphasis on knowledge-based systems, and to add new aspects to successful decision making in urban planning

    There is a commonly held view that African nationalism took shape out of contacts of African intellectuals with twentieth-century Pan-African leaders. Yet, this interpretation lacked concrete evidence, as many of these intellectuals owed their ideological formulation to Nineteenth-century teachings of Edward Wilmot Blyden. In his writings, Blyden articulated a thorough understanding of African’s strengths and weaknesses. For Blyden, Western civilization intended to make the African a caricature of European society. As a result, the situation of the African became one of chaos as he lived in strict psychological conflicts. A revival of the African personality rested as a solution to the distorted manhood of the African and a path to his future progress. This article examines Blyden’s theory of the African personality as revealed in early intellectual work in the Gold Coast (Ghana). Drawing on Blyden’s African personality theory, the article revealed that these intellectuals begun a vigorous campaign to oppose Europeanization of the African system of life and took an uncompromising stand against ideas of black “inferiority” and “backwardness”

    Cryptocurrency has become ubiquitous and is evolving constantly. The question is if our legal framework is catching up with it. Therefore, this article analyzes the arguments on the legitimacy and legality of cryptocurrency in order to emphasize the relation between corruption and cryptocurrency. The research has enlightened some cogent arguments on the possibility of perpetrators committing corruption acts through cryptocurrency. These arguments basically refer to some of the unique characteristics of cryptocurrency such as the quick value fluctuation, the difficulties in tractability and the lacking current legislation. The unique features of it may headline cryptocurrency as an immensely attractive environment for corruption activities. Hence the world has already faced some tangled scamming scandals with cryptocurrency specified herein. Therefore, the aim of this article is to highlight the possibility for corruption acts to be committed through cryptocurrency as a form of corruption unknown before

    Post-Kantian Perfectionism.

    This paper summarizes the major themes of my current monograph project and my recent co-edited volume on post-Kantian perfectionism. The central thesis is that Kant’s critique of rational heteronomy in the Groundwork effectively ruled out certain types of perfectionist ethics and their corresponding political applications, notably the programmes of Christian Wolff and his school, which were dominant in the German territories in the mid- to late eighteenth century. Kant’s critiques did not, however, preclude the emergence of a new type of perfectionism, no longer based on the state-sponsored promotion of eudaimonia or material, intellectual, and spiritual thriving, but on the advancement of freedom and the conditions for its exercise. Predicated on the idea of right, post-Kantian perfectionism focuses on maintaining and enhancing the juridical, political, and economic conditions for rightful interaction among self-defining individuals. Humboldt, Schiller, Fichte, Hegel, and the Hegelian School exemplify this new approach in different ways. Marx’s problematic relation to this tradition is outlined
