Patent Pending: How the Current Patent Utility Requirement Hinders Biotechnological Innovation

    No full text
The legal system is always playing catch up to adapt to new legal landscapes, doctrines, and technology; however, patent law needs help to compete with biotechnological research in the race towards innovation. Biotechnological research in the realm of human health and medicine often involves the use of therapeutic drugs. The field of healthcare biotechnology takes biological systems and processes and generates novel, creative solutions to a number of human health conditions. However, the translation process for a new drug, therapy, or process is long and expensive which requires investors to help the researchers and scientists move their creations from inception to universal use. The United States Patent and Trademark Office has updated their criteria to accommodate the unique nature of biotechnological research, but the United States Court of Appeals for the Federal Circuit has not followed suit. The Court\u27s stringent application of the utility requirement in patent law precludes numerous biotechnological processes and products from patent protection. Changing the Court\u27s standard of interpretation will spur further innovation in the biotechnological field as researchers and scientists will receive necessary financial backing with the knowledge that patent protection is possible for their creations

    Multidisciplinarity and Interdisciplinarity in Law

This article aims to dismantle walls and barriers, tracking the contemporary trends in law that acknowledge the significant value of interdisciplinary cooperation. We strive to explore how collaborative contemplation on a legal issue, incorporating two or more academic and practical viewpoints, can enhance interactions across multiple disciplines, improve comprehension of intricate problems, and guide interventions. Ultimately, such collaborations can yield an innovative and synergistic knowledge base, fostering the development of new theories capable of explaining complex human phenomena from varied perspectives. These diverse vantage points are expected to generate superior and more fitting outcomes than those achievable by the field of law operating in isolation

Cannabis in the Clink: An Argument in Favor of Medical Marijuana for Disabled Inmates

In recent decades, medical marijuana programs have become commonplace, and most states in the United States of America are ready to accept marijuana as a natural alternative to treat symptoms of certain conditions such as chronic pain, cancer, mental illness, multiple sclerosis (MS), HIV/AIDS, and substance use disorder; as such, medical marijuana is readily accessible to those who have a qualifying diagnosis – the exception being those who are incarcerated. Although disability, substance abuse, and mental illness are prevalent among those under state supervision, these individuals are effectively prohibited from enjoying the benefits of medical marijuana. This Note will provide a comprehensive history of marijuana legislation in the United States, including a legal framework regarding the constitutionality of state medical marijuana programs, and an argument in favor of allowing qualifying inmates to access medical marijuana. This Note will also address counterarguments and will outline a logistical approach to administering medical marijuana to qualifying inmates
