Early Justifications of Indigenous and African Slavery in Colonial Latin America
No full textInternational audienceThis chapter inquires international law’s engagement with regard to Indigenous and African slavery in the Americas throughout the 16th century. First, it recalls that the initial set of laws governing slavery and forced labor in the Iberian American colonies drew from existing European medieval rules and institutions. Second, it explores the early debates that took place with regard to the morality and/or legality of exploitative practices targeting Indigenous Peoples and sub-Saharan Africans. The latter were considered human beings who, although barbarians, were endowed with reason and natural freedom, the loss of which could only be the consequence of human institutions and forms of interaction introduced by the law of nations (ius gentium), such as commerce and war. The chapter examines how these ideas and arguments were articulated together in order to subjugate native peoples in the Americas and in Angola, the region mostly affected by the transatlantic slave trade in the 17th century

A Justice Rendered by Women for Women? What Judicial Intervention Does to the Gender Gap
No full textInternational audienceThis paper examines the influence of judges’ gender on decisions in marital separation cases in France. Using detailed data on both judges and cases, we do not detect significant differences between male and female judges regarding child custody or child support. However, female judges grant significantly higher compensatory allowance compared to their male counterparts. Regardless of the dispute type, female judges do not render decisions closer to the demands of either female or male litigants than male judges do. Despite evidence that women judges are more sensitive to inequalities within couples than male judges, the effects of judicial decisions do not compensate for the inequalities created at the time of separation to the detriment of women. This is not due to judicial discretion but rather from the claims presented by litigants and the weight that judges assign to these claims in their decision-making processes. This paper thus challenges the notion of a feminine and therefore feminist justice, which would be “rendered by women for women.

Depuis plus de 50 ans, ce sont principalement des jeunes hommes noirs et arabes des quartiers populaires qui sont concernés. Parallèlement, depuis 10 ans, le nombre de mutilé·es par la répression de rassemblements ne cesse d’augmenter. Depuis les années 1970, dans la continuité des mobilisations des habitant·es des quartiers populaires et des héritier·ères de l’immigration post-coloniale, les luttes contre les violences policières sont toujours principalement portées par les Comités Vérité et justice

No full textInternational audienceThe CFDT is the only French trade union confederation to have a permanent strike fund at the confederal level. Created in 1973, it mainly fulfilled this role until the 1990s. Since then, it has broadened its remit by offering other types of support in the form of services to its members. In this article, we analyze this evolution by placing our reflection at the intersection of two debates: one on the evolution of worker solidarity and the other on the place of service unionism in France. We will see that the CFDT's approach to its strike fund is indeed part of a service-oriented logic, but that it largely retains a protest-oriented purpose.La Confédération française démocratique du travail (CFDT) est la seule centrale syndicale française à disposer d’une caisse de grève permanente à l’échelon confédéral. Créée en 1973, cette dernière a principalement rempli ce rôle jusqu’aux années 1990. Depuis, elle a élargi ses missions en proposant d’autres types de soutien, sous la forme de services rendus aux adhérent·es. Nous analysons dans ce texte cette évolution en inscrivant notre réflexion au croisement de deux débats : celui sur l’évolution de la solidarité ouvrière et celui sur la place prise en France par le syndicalisme de services. Nous verrons ainsi que l’orientation donnée par la CFDT à sa caisse de grève s’inscrit effectivement dans une logique de services mais qu’elle garde en large partie une finalité revendicative
Les données, l’algorithme et le foncier : acteurs et enjeux autour d’une stratégie d’aménagement communautaire dans la Métropole de Toulouse
No full textInternational audienceThe article examines the reconfiguration of land policies within Toulouse Métropole in light of national injunctions relating to the fight against soil artificialisation, as introduced by the Climate and Resilience Law. Faced with the limitations of traditional planning tools, Toulouse Métropole has developed a ‘land strategy’ based on a hierarchy of land resources, supported by digital and algorithmic tools and hybrid geographic data sources, in an approach marked by digital solutionism. The combination of internal expertise—notably that produced by the Toulouse Urban Planning Agency (AUAT)—and practices inspired by experiences outside the territory has enabled the production of territorial indicators and maps of mutable and available land, which are used as tools to aid public decision-making. Based on a qualitative survey conducted between 2019 and 2023 among local public and private actors, the study shows that this organisational change in land strategy aims to strengthen metropolitan coordination capacities in the face of the weakening of the public planning sector, by disseminating the analysis methods developed by the AUAT to member municipalities. This reorganisation is therefore contributing to the territorialisation of the metropolitan institution, based on a technical and administrative land management model initially developed by the central municipalities for their own use.L’article examine la reconfiguration des politiques foncières au sein de Toulouse Métropole à l’aune des injonctions nationales relatives à la lutte contre l’artificialisation des sols, telles qu’introduites par la loi Climat et Résilience. Confrontée aux limites des instruments classiques de l’aménagement, l’intercommunalité de Toulouse Métropole a élaboré, dans une démarche empreinte de solutionnisme numérique, une « stratégie foncière » reposant sur une hiérarchisation des ressources foncières, soutenue par des outils numériques et algorithmiques ainsi que par des sources de données géographiques hybrides. L’articulation d’expertises internes, notamment celles produites par l’Agence d’urbanisme de l’agglomération toulousaine (AUAT), et de pratiques inspirées d’expériences extérieures au territoire permet la production d’indicateurs territoriaux et de cartographies du foncier mutable et disponible, mobilisées comme instruments d’aide à la décision publique. Fondée sur une enquête qualitative menée entre 2019 et 2023 auprès d’acteurs publics locaux et privés, l’étude montre que cette évolution organisationnelle de la stratégie foncière vise à renforcer les capacités de coordination métropolitaine face à l’affaiblissement de la filière de l’aménagement public, en diffusant auprès des communes membres les méthodes d’analyse développées par l’AUAT. Ainsi, cette réorganisation participe à la territorialisation de l’institution métropolitaine à partir un mode de gestion technico-administratif du foncier initialement élaboré par les communes centrales pour elles-mêmes
