    E-BUSINESS - A LOOK AT STRATEGY

    The thesis of the paper is this chapter is that to play an active entrepreneurial role in e- commerce, professionals need to develop holistic understanding of e-business issues, ‘business imagination’ skills of ‘creative win-win design’ and negotiation skills. In the first part of the paper the author discusses the e-business situation pointing at great opportunities, and often not so great practices. The second part presents a proposed ‘portal model’ for understanding e-business as a way to overcome the compartmentalisation of management disciplines. The third part shows the importances of negotiation skills, which, for the purpose of this paper are understood primarily as an ability to design solutions that are beneficial for all parties involved and create timely strategic alliances. The practical importance of those skills is shown in several cases. Among others, how negotiation mastery (not technical genius) of its founder enabled creation of the arguably the most successful corporation of our times. Finally, implications from management training and business education are discussed. Results of unpublished research (conducted with 124 groups) that show the limitations of verbal, cognitive education are presented. Consequently a holistic approach, which would include both classical “cognitive” and “emotional” intelligence as well as further research into the matter, is recommended

    THE HOT HAND EFFECT IN THE MUTUAL FUNDS MARKET IN POLAND

    In this paper, the hot hand effect is analyzed with respect to mutual fund performance in Poland. We show that investors are not able to generate “extra returns” by taking into account past performance of mutual funds, and the hot hand effect in particular. It is a heuristic that may be popular and useful when it comes to basketball, but risky in use when taking real investment decisions. An interesting result of the paper is the bi-period and multi-period persistence analysis; we find an absence of evidence of the hot hand effect on returns and risk-adjusted returns at three-month intervals.     Prawa pacjenta stanowią integralną część praw człowieka. Swoje źródło mają w jego godności. W prawie polskim nie ma definicji praw pacjenta. Należy przyjąć, iż prawa pacjen-ta to zespół uprawnień przysługujących osobie w związku z korzystaniem ze świadczeńzdrowotnych. Zgodnie z ustawą o zakładach opieki zdrowotnej świadczenie zdrowotne to działanie służące zachowaniu, ratowaniu, przywracaniu, a także poprawie zdrowia, i inne działania medyczne, wynikające z procesu leczenia lub odrębnych przepisów regulujących zasady ich wykonywania1. Pojęcia „pacjent” nie należy utożsamiać tylko z osobą chorą, po-nieważ bywa nim też człowiek zdrowy (np. medycyna pracy, bilans zdrowia dziecka). Prawa pacjenta to prawa podmiotowe, przysługujące w swoistej sytuacji życiowej. Prawa powyższe, poza aktami normatywnymi o charakterze międzynarodowym (np. konwencja bioetyczna), uregulowane są w Konstytucji RP i wielu różnych ustawach (szczególnie w ustawie o zakła-dach opieki zdrowotnej i ustawie o zawodzie lekarza). Prawa pacjenta to istotne zagadnienie o charakterze nie tylko społecznym, ale również ekonomicznym. Członkostwo Polski w UE skutkuje uzyskaniem przez polskiego pacjenta nowego uprawnienia – prawa do świadczeńzdrowotnych na terenie państw UE. Przedmiotem niniejszego artykułu jest przedstawienie zakresu podmiotowego i przedmiotowego prawa unijnego pacjenta, a przede wszystkim ana-liza zasad rozliczania kosztów świadczeń zdrowotnych, udzielonych polskiemu pacjentowi, ubezpieczonemu w państwach UE w ramach realizacji powyższego prawa. Nie należy rów-nież zapominać o istnieniu drugiej strony powyższego prawa, tj. rozliczaniu przez państwa członkowskie UE świadczeń zdrowotnych, udzielonych na terytorium Polski uprawnionym pacjentom. Zasady dokonywania powyższych rozliczeń są identyczne, jednakże różne są ich skutki dla polskiego systemu finansów publicznych

    This paper investigates the basis arguments of so-called legal logic and their relation to logic in its standard meaning. There is no doubt that legal arguments belong to logic in the wide sense (sensu largo), but their reduction to schemes of formal logic (logica sensu stricto) is a controversial issue. It can be demonstrated that only some legal arguments fall under explicit rules of formal logic, that is, having a deductive character. Most such reasoning is fallible, and its correctness depends on appealing to extra-logical principles taken fromlegal norms. For instance, if we say, “If it is permitted more, then it is permitted less” (argumentum a maiori ad minus), we assume that the concepts expressed by the words “more” and “less” are already defined

    TECHNOLOGY AS A MEDIUM OF ARTISTIC CREATION: THE CASE OF BIOTECHNOLOGY

    In recent decades, artists have lost interest in the search for new solutions. In the celebration of traditional techné, and in pursuit of means of expression, they have turned to extreme areas of human activity or to the field of science and new technologies. The latest gene-editing technologies open up new challenges for art and force a rethinking of the interpretation of projects, artefacts, performances, and installations by artists focused on biotechnology. This is especially due to the fact that, for the time being, art criticism is in thrall to a posthuman discourse (grounded in theories of postmodernism) that at various levels focuses on the nature– culture opposition, primarily delimiting the biological aspects of humans to the interspecies social relationships of human and non-human beings. Because of this, artists and critics lack appropriate philosophical concepts to develop interpretive frameworks for art that reach into the realm of empirical investigations of human nature. Transhumanist discourse seems to offer a solution of sorts.  Although still evolving and facing ethical critiques, it provides a more appropriate (emulative) framework for some contemporary  artistic activities than the existing posthuman discourse

    Diversity within top management teams (TMTs) has significant implications for firm financial performance, particularly in dynamic industries like the automotive sector. This paper analyze the relationship between TMT diversity and financial outcomes in companies associated with the Volkswagen Group, operating in an intensely competitive market marked by technological advancements. This comprehensive paper synthesizes studies investigating the correlation between TMT diversity and financial performance within the automotive domain. Employing quantitative approaches, these studies assess demographic factors such as gender, age, ethnicity, andeducational background. The analysis unveils distinct patterns of impact. Gender diversity within TMTs exhibits a positive influence on financial performance, with heightened profitability and increased market value being notable outcomes. Age diversity shows a nuanced trend, with moderate levels enhancing strategic decision-making capabilities and fostering innovation. Increased ethnic diversity within TMTs is associated with elevated innovation and overall firm performance. Furthermore, educational diversity within TMTs is found to bolster firm performance, underscoring its pivotal role in strategic decision-making and innovation. By offering a comprehensive synthesis of TMT diversity's connection to financial performance within the Volkswagen Group's context, this paper contributes novel perspectives. The study emphasizes the methodologies utilized, outlines key findings, and underscores the original contributions made by existing research. This study illuminates the profound influence of TMT diversity on shaping strategic decisions and fostering innovation in the automotive sector. Importantly, it highlights the crucial role of TMT diversity in driving positive financial outcomes

    THE IMPACT OF IFRS ADOPTION ON ECONOMIC GROWTH IN TRANSITION COUNTRIES: EVIDENCE FROM CIS

    International financial reporting standards (IFRS) have become a worldwide common accounting language which most countries have adopted. However, there are no studies obtained based on transition economies in a particular geographic zone. Thus, this study is carried out to observe the influence of IFRS adoptation on the economic growth of 11 CIS countries from 2005 to 2018. To examine the actual effect of the variables, the regression model was divided into two submodels based on the category of variables. There is a difference between the economic growth in adopted and non-adopted states. The adoption of IFRS showed negative and insignificant relation to GDP per capita. The number of observations after fully adopting IFRS was low, the data on IFRS adoption was challenging, and an advanced econometric model should be selected. The study compared CIS results with Eastern European countries to see a clear pattern and generate an efficient suggestion for policy implementation. The policy implementations related to Uzbekistan were also provided

    SOURCES OF UNCERTAINTY AND THEIR IMPACT ON STOCK PRICES EVIDENCE FROM EMERGING ECONOMIES

    This study investigates the short- and long-term effects of various sources of uncertainty on the share prices of key exchanges in emerging nations. The sample comprises monthly time series data from January 2017 to December 2021 for China, India, Russia, and Brazil. The study contains a version of Autoregressive-Distributive-Lag (ARDL) with error correction as well as other relevant approaches to time series. Economic policy, climate policy, pandemics, and Twitter-based uncertainty may cause a long-term decline in SSE (Shanghai Stock Exchange) composite index and BSE (Bombay Stock Exchange) Sensex index. In China, geopolitical, climatic, and pandemic uncertainty are short-term sources of uncertainty, and in India, economic policy, geopolitical, and pandemic uncertainty. Moreover, no sources of uncertainty have a long-term impact on Russia's Moscow Exchange (MOEX) index. All sources except climate uncertainty are short-term MOEX index contributors. Pandemics and Twitter-based uncertainty are long-term sources, whereas economic policy and Twitter-based uncertainty are short-term sources for Brazilian Stock Exchange (BOVESPA) Index. This research adds to the literature by examining the relationship between distinct sources of uncertainty and an emerging market share prices index. It provides the behavior of leading share price indexes in the presence of uncertainty. The study's conclusions only apply to emerging economies. Future research may take into account a panel dataset consisting of a large number of emerging nations to examine the same set of variables
