No full textInternational audienceIn diesem Artikel wird die kürzlich verabschiedete Produkthaftungsrichtlinie analysiert und der Hintergrund und die Gründe für das neue Instrument sowie die Änderungen, die durch die neuen Vorschriften eingeführt wurden, untersucht. Diese Änderungen wirken sich auf Schlüsselaspekte der Haftungsregelung aus, einschließlich des erweiterten Produktbegriffs, des Begriffs des Mangels, des erstattungsfähigen Schadens, der Beweislast und der damit verbundenen Beweisfragen. Er bedauert, dass einige andere grundlegende Fragen im Zusammenhang mit der beabsichtigten Strenge und den Gründen für die verschuldensunabhängige Haftung nicht angesprochen wurden.This article analyses the recently adopted Product Liability Directive, exploring the background and reasons for the new instrument and the changes ushered in by the new rules. These modifications impact on key aspects of the liability regime including the expanded concept of a product, the notion of defect, recoverable harm, burden of proof and related evidential matters. It regrets that some other fundamental issues relating to the intended strictness and rationales for strict liability were not addressed.En este artículo se analiza la Directiva de responsabilidad por productos recientemente adoptada, se exploran los antecedentes y las razones de este nuevo instrumento y los cambios introducidos por las nuevas normas. Estas modificaciones afectan a aspectos clave del régimen de responsabilidad, como el concepto ampliado de producto, la noción de defecto, el daño indemnizable, la carga de la prueba y las cuestiones probatorias relacionadas. El artículo lamenta que no se hayan abordado otras cuestiones fundamentales relacionadas con la rigurosidad prevista y los fundamentos de la responsabilidad objetiva.Cet article analyse la directive sur la responsabilité du fait des produits récemment adoptée, en explorant le contexte et les raisons du nouvel instrument et les changements introduits par les nouvelles règles. Ces modifications ont une incidence sur des aspects clés du régime de responsabilité, notamment la notion élargie de produit, la notion de défaut, le préjudice indemnisable, le fardeau de la preuve et les questions de preuve connexes. Potentially Problematic Word Usages and How to Detect Them: A Survey
No full textInternational audienceWe introduce and frame the concept of potentially problematic word usages (PPWUs): word occurrences that are likely to cause communication breakdowns of a semantic nature. While much research has been devoted to lexical complexity, ambiguity, vagueness and related issues, no work has attempted to fully capture the intricate nature of PPWUs. We review linguistic factors, datasets and metrics that can be helpful for PPWU detection. We also discuss challenges to their study, such as their complexity and subjectivity, and highlight the need for future work on this phenomenon
Toward the Automatic Detection of Word Meaning Negotiation Indicators in Conversation
No full textInternational audienceWord Meaning Negotiations (WMN) are sequences in conversation where speakers collectively discuss and shape word meaning. These exchanges can provide insight into conversational dynamics and word-related misunderstandings, but they are hard to find in corpora. In order to facilitate data collection and speed up the WMN annotation process, we introduce the task of detecting WMN indicators - utterances where a speaker signals the need to clarify or challenge word meaning. We train a wide range of models and reveal the difficulty of the task. Our models have better precision than previous regular-expression based approaches and show some generalization abilities, but have moderate recall. However, this constitutes a promising first step toward an iterative process for obtaining more data
La résolution d’un grand défi au sein d’un organisme de recherche : tensions, co-construction et leadership dans la recherche publique
No full textFocusing on a public research organization committed to tackling a major chal- lenge—namely, that of considering the climate and environmental transition in conjunction with food, agriculture, and ecology issues—our study draws on fifty interviews (twenty-one with directors of research or research support units, and twenty-nine with other staff members from those same twenty-one units) to analyze the tensions and contradictions that arise in this context. Our findings point to the organizational complexity inherent in responding to such a major challenge and high- light the tensions that run through the day-to-day activity of the organization. Far from hindering collective action, these tensions prove to be fruitful: they are tran- scended by organizational mechanisms that foster dialogue, co-construction, and collective intelligence. This study also provides a renewed perspective on the role of research unit directors, highlighting the importance of servant leadership—collec- tively oriented and supportive—in helping to resolve major systemic challenges on a day-to-day basis.Portant sur un organisme de recherche public engagé dans la résolution d’un grand défi – celui de penser la transition climatique et environnementale en articulation avec les enjeux d’alimentation, d’agriculture et d’écologie, notre étude s’appuie sur 50 entretiens (dont 21 avec des directeurs d’unités de recherche ou d’appui à la recherche et 29 avec d’autres agents de ces 21 unités) pour analyser les tensions et contradictions qui émergent en leur sein et dans leur environnement institutionnel. Nos résultats révèlent la complexité organisationnelle inhérente à la résolution de ce grand défi et mettent en lumière les dynamiques multiples qui traversent l’activité quotidienne de l’organisme. Loin d’entraver l’action collective, les tensions identifiées se révèlent fécondes : elles sont transcendées par des dispositifs organisationnels qui favorisent le dialogue, la co-construction et l’intelligence collective. Cette étude apporte également un éclairage renouvelé sur le rôle des directeurs d’unités de recherche, soulignant l’importance d’un leadership serviteur, orienté vers le collectif, pour accompagner au quotidien la résolution de défis systémiques majeurs
Harmonizing dockless E-scooters: insights from Paris
No full textInternational audienceImproper parking is one of the most significant barriers to the adoption and acceptance of dockless shared e-scooters worldwide. This paper investigates the effects of mandatory parking regulations in Paris that require e-scooters to be parked in designated bays in the form of painted corrals. To assess the impact of these regulations and their unintended effects, we develop a novel multicriteria evaluation method around three principles: efficiency, accessibility, and compliance. Using a unique large-scale database that geolocates every parked e-scooter in the city at threehour intervals, we find that designated parking bays improve mis-parking by reducing cluttering. However, they also unintentionally reduce accessibility. Furthermore, we provide insights into the persistence of mis-parking and the congestion of parking bays, two key factors that contributed to the ban of shared e-scooters in the city
