    No full text
We report ab initio study of the electronic, mechanical and structural properties for the negative thermal expansion (NTE) application of antiperovskites manganese nitrides materials Mn3XN (X=Al, Ga, Zn). Using first principle calculations based on generalized gradient approximation (GGA), the electronic, structural, and mechanical properties of the Mn3XN (X = Al, Ga, Zn) phases were investigated. The optimized lattice parameters give the first reference to the upcoming theoretical and experimental studies. THERMO_PW as a post-processing code was used for the computation of elastic constants that were used to derive bulk modulus (B), shear modulus (G), Young\u27s modulus (E), Poisson\u27s ratio (õ), and hardness. The calculated elastic constants are in excellent agreement with the available data. Moreover, obtained elastic constants revealed that both the Mn3ZnN and Mn3GaN phases are brittle. The band structure and density of states analysis showed that these phases are electrical conductors, having strong directional bonding existing near the Fermi level between Mn -N atoms due to Mn-d and N-p hybridization. The Mn3GaN compound has the highest Debye temperature (452.8K), while Mn3ZnN has Debye temperature of (283.4K) indicating that they are thermodynamically and dynamically stable and can be synthesized experimentally. Mn3AlN compound has Debye temperature (0.000K) indicating the system is unstable for compressional deformation

The effectiveness of the investigative powers of the Independent Policing and Oversight Authority : Christine Wanjiku

    Get PDF
Is the Independent Policing Oversight Authority (IPOA) a toothless dog or a lame duck? Some have put forward that IPOA was set up for failure since inception. This commentary critiques the reality of these sentiments from the perspective of IPOA’s power to investigate complaints on Kenyan police use of excessive force. Investigations into the reported claims of police brutality is among IPOA’s key accountability measures over police (mis)conduct. However, IPOA has encountered various challenges in executing its mandate, especially the ‘blue conduct of silence’. This paper demonstrates that despite the challenges in executing investigations, IPOA has managed to complete some investigations and secure some convictions

THE ENFORCEMENT OF THE RIGHT OF ESTABLISHMENT BEFORE THE ECOWAS COURT: JURISDICTIONAL HURDLES FOR INDIVIDUALS: Julius Edobor

    Get PDF
The Economic Community of West African States Court of Justice (ECCJ) was established in 1991 by the Protocol on the ECCJ. This article examines the jurisdictional challenges faced by individuals in approaching the ECCJ with regard to the violation of the right of establishment within the sub-region. Fundamentally, the inability of the ECOWAS citizens to access the ECCJ to litigate ECOWAS Protocols is given prominent emphasis with reference to the case of Pinheiro v. Republic of Ghana. Although, the ECCJ can now assume jurisdiction over cases of human rights violations through its expanded mandate, its jurisdiction is still very limited, given the inability of individuals to use the jurisdiction of the Court for the interpretation and application of ECOWAS Protocols. The study, therefore, argues for an amendment to the ECOWAS instruments to accommodate the protection of individual rights. It also argues for the Court’s courageous approach in interpreting ECOWAS Protocols in line with the object of ECOWAS, to accommodate suits by individuals seeking to enforce their Community right

    Get PDF
The aim of this study was to examine the effect of standard costing on financial performance. The study adopted explanatory research design and stratified sampling technique for data collection on a questionnaire with closed-ended questions. The sample size for the study was 220 consisting of 63 auditors and 157 accountants from 48 manufacturing industries. Cronbach’s alpha and factor analysis were used to test for the reliability and construct validity of the research instrument respectively while the hypothesis was tested using regression analysis. The result of the study revealed that standard costing (β = 0.216, P>0.000) with R2= 0.662 had a positive significant effect on the financial performance of manufacturing industries. The study concluded that there is a significant correlation between standard costing and financial performance and that one unit change in standard costing would cause one unit change in financial performance. Likewise, the study recommended proper costing records and the application of standard costing by manufacturing firms to help them in financial performance assessment and gain control over costs. Further research studies should consider targeting operation managers and financial managers. The scope of the study was limited to manufacturing industries hence future studies should focus on service industries to establish whether the study would yield the same results

The study sought to assess the effect of Porter’s generic strategies on firm performance of Tyre dealers within Nairobi County. The study adopted a descriptive research design. The population of the study were tyre dealers in Nairobi County. A sample of 200 tyre dealers was picked through random sampling in Nairobi County. Out of the targeted tyre dealers that were picked through simple random sampling, 108 were responsive indicating a 54% response rate, this large sample ensured the reliability of the responses while the mode of the structure of the questionnaires guaranteed the validity of the data collected. After analysis of the data through correlation and multiple regression, it was deduced that there is a strong effect of Porter’s generic strategies on firm performance, with a strong correlation coefficient of 0.975, 0.928 and 0.976 for cost leadership, differentiation and focus respectively. Multiple regression deduced that 95.2% of firm performance was attributed to cost leadership, differentiation and focus strategies based on the regression model. Based on the regression model cost leadership has a deduced coefficient of 0.84 implying that an increase in a unit of firm performance is due to an increase in 0.84 unit of cost leadership. Differentiation generated a co-efficient of 0.09 implying an increase in one unit of performance due to an increase in 0.09 unit of differentiation Focus strategy deduced a co-efficient of -0.05 implying a reduction of a unit of performance by an increase in practice of focus by 0.05. This overall indicated that cost leadership and differentiation have a positive effect on performance while focus strategy has a negative effect on firm performance

JURISDICTIONAL OVERLAPS IN TRADE AND INVESTMENT DISPUTES SETTLEMENT IN THE EAC: REFLECTIONS ON THE EAST AFRICAN COURT OF JUSTICE’S ‘CONSTRAINED JURISDICTION’: Augustus Mutemi Mbila* and Edmond Shikoli

    Get PDF
This study seeks to examine the jurisdiction of the East African Court of Justice (EACJ) to hear and determine trade and investment disputes within the East African Community (EAC) in line with its principle of having a people-centred and market-based community. The research is anchored on the hypothesis that the jurisdiction of the EACJ to determine commercial disputes arising out of trade and investment activities within the region is constrained. The study establishes that there exist parallel dispute resolution mechanisms whose effect is to constrain the jurisdiction of the EACJ to hear commercial disputes within the EAC. This in turn affects both the consistency and predictability of trade and investment jurisprudence in the EAC. These mechanisms include the East African Committee on Trade Remedies, the EAC Competition Authority, arbitral tribunals within national jurisdictions of Partner States, and dispute resolution mechanisms of other regional economic communities (RECs) where EAC Partner States are also members. The study recommends treaty amendments to restate the Court’s jurisdiction and also to accord it exclusive original and appellate jurisdiction in matters of relevance to trade and investmen
