    Ijtihad literally means ‘exertion’. Defined by the fuqaha' as the endeavour of the qualified jurist to discover the legal injunctions of the shari'ah, it is accepted as a valid source of law. The early fuqaha' such as Ibn Abi Layla, Abu Hanifah, and Malik b. Anas use the term ijtihad in a broad sense of al-ra'y, considered opinion or sound judgement. The fuqaha' generally apply various methods of ijtihad only when it becomes absolutely necessary to do so. In the areas dealing with 'ibadat or huquq Allah, there is generally no need to apply the secondary sources of law, particularly in regard to the basic principles of Islam. However, social and political problems lend themselves to continual application of ijtihad. To keep pace with development in the social, political, legal and economic fields it was felt necessary that a corresponding and more sophisticated development of the principle of ijtihad should take place. Thus the new modes of ijtihad like qiyas, istihsan, al-masalih al-mursalah, and istidlal, came into existence to cope with problems faced by the jurists..

    Abuse of religion and environmental pollution in Nigeria: An Islamic perspective

    The proliferation of places of worship and the increase in the number of devotees of religions are considered by many to be a welcome development, but their adverse effects on environmental degradation have hardly been considered. This paper attempts to study the role or the abuse of religion on environmental pollution and its implications for sustainable development in Nigeria. Based upon primary and secondary information, this study found that religion has largely been misused by its practitioners resulting in environmental pollution, with a serious negative influence on sustainable development. The paper further suggests possible solutions to this problem on the basis of Islamic injunctions for sustainable environmental development

    The Fidāwiyyah Assassins in Crusades and Counter-Crusades

    The Assassins have been the focus of serious study during this century in the West. Although the Assassins have left no insignificant impact on the Crusades and Counter-Crusades, this impact has not been properly studied. Scholars seem to have different, and at times, contradictory views on the subject. This paper maintains that the Assassins' activities during the Crusades and Counter-Crusades can only be comprehended in the context of their doctrines, because they acted in accordance with the latter and with the interests of their community. This article is an attempt to understand the motives of the Assassins for the policies that they pursued during the Crusades in the east, by comparing the findings of modem scholars on the subject against data collected from primary sources

    In the endless human quest for understanding the nature of life, cloning represents a new fundamental paradigm. Making a major departure from the normative mode of reproduction, it forces a new division of genetic endowment. Consequently, biological identity and individuality come to acquire new meanings. The inherent instrumentalism of cloning thus advances the dependence of moral choices in society. Ultimately, it manifests itself in the trinity of instrumentalism, namely: objectification, reductionism, and determinism. This, more than anything else, is the epic of contingency of the episteme. A contingent episteme in turn assumes the role of a moral arbitrator. This paper argues that cloning is the most potent catalyst for the emergence of neo-Genesis. The technological reincarnation then is merely a function of the inevitable evolution of the technique. Legislative controls on the technique itself simply betray the underlying moral contingency. It is asserted that irrespective of these controls, eventually, cloned human beings would be a reality. The dilemma faced by us, therefore, is not the challenge of technique but judgement on the moral future of human society. Is the "new birth" also the birth of a new norm?
