    This paper aims to analyse the relationship between the law and the body from a legal and philosophical perspective.The presupposition of the following remarks is that the technological development is the defining feature of the modern societies. This phenomenon has relevant implications on the languages describing the body and its disposability. The enigma of the body, which has always concerned the philosophical thought, is nowadays of great importance, since it is a privileged position from which to look at the modernity.The law, that has always taken the corporeity into account, is concerned with the emersion of the digital persona, which now more than ever calls for appropriate protection.The investigated matter recalls the distinction between personality rights and property rights. The existential situations can be subject of agreements that entail a non-contractual nature. Yet, market-alienability and non-patrimonial interest get to be strictly entangled in the case of contracts regulating aspects of one’s identity, in which case existential components remain

    The Council of State (nr. 894/24) appropriately removed the decision by which the Lazio Regional Administrative Court (nr. 18790/23) had suspended the AGCOM regulation on fair compensation, thereby allowing an important attempt to experiment with co-regulation not to be interrupted, in order to strike a balance in the area of free dissemination of online newspaper content between the interests of digital platforms, publishers and the public of the users of the information disseminated.Digital platforms 'over the top' escape the sovereignty of the legislators of individual territorial states, so that, in order to succeed in adopting market regulation, there is a need for a virtuous collaboration of the platforms themselves, in a public-private co-regulation perspective, facilitated by the role of the sector Authorities, in application of the principle of subsidiarity. Il Consiglio di Stato (n. 894/24) ha riformato il provvedimento con cui il TAR del Lazio (n. 18790/23) aveva sospeso il regolamento AGCOM sull’equo compenso, con ciò consentendo di non interrompere un importante tentativo di sperimentare la co-regolazione, al fine di trovare un punto di equilibrio in materia di libera diffusione di contenuti dei giornali on-line tra gli interessi delle piattaforme digitali, degli editori e del pubblico dei fruitori delle informazioni divulgate.Le piattaforme digitali “over the top” sfuggono alla sovranità dei legislatori dei singoli stati territoriali di talché, per riuscire ad adottare una regolamentazione del mercato, si impone la necessità di una virtuosa collaborazione delle stesse piattaforme, in un’ottica di co-regolazione tra pubblico e privato, agevolata dal ruolo delle Authorities di settore, in applicazione del principio di sussidiarietà

    AbstractThis paper proposes an analysis of the representation of motherhood present in the adventures of the superheroines of comics and cinema in the last ten years: these characters, thanks to the immediate international success, are part of the collective imagination, conveying very pervasive messages about gender roles. In particular, the superheroines spread a mixture of gender models that are complex to interpret in the light of traditional of new stereotypes; moreover, they shall forward to the general public some latent and inconspicuous messages, but very incisive, about motherhood.The latter is a crucial element in the construction of gender identity, in its symbolic, cultural, and social aspects. A pedagogical reflection of the gender models conveyed with particular regard to the representation of motherhood is, therefore, necessary and urgent, in order to stimulate boys and girls toward conscious and critical fruition. RiassuntoIl contributo propone un’analisi della rappresentazione della maternità presente nelle avventure delle supereroine dei fumetti e del cinema negli ultimi dieci anni, nella consapevolezza che tali personaggi, grazie all’immediato successo internazionale, sono entrati nell’immaginario collettivo, veicolando messaggi molto pervasivi in merito ai ruoli di genere. In particolare, le supereroine, oltre a trasmettere un aggregato di modelli di genere complessi da leggere alla sola luce degli stereotipi tradizionali o meno, stanno veicolando al grande pubblico alcuni messaggi latenti e meno vistosi, ma molto incisivi, riguardo alla maternità: quest’ultima costituisce un elemento cruciale nella costruzione dell’identità di genere, nei suoi aspetti simbolici, culturali, sociali. Una lettura pedagogica dei modelli di genere veicolati con particolare riguardo alla rappresentazione della maternità è dunque necessaria e urgente, ai fini di poter stimolare ragazzi e ragazze verso una fruizione consapevole e verso uno sguardo critico

    This paper aims to focus attention on the condition of NEETs in relation to gender. The latest national and international data confirm, in fact, that being a woman is a predictor of social and labour exclusion. Girls are more marginalised than their male peers, a condition that was exacerbated during the Covid-19 pandemic. Questioning and investigating these forms of exclusion is therefore a matter of urgency for all those involved in education and social inclusion. In particular, the article is interested in analysing the relationship between NEETs and gender and the educational/pedagogical perspectives useful for re-orienting learning and training spaces, capable of enhancing a “pedagogy of difference”. The proposal concernes a distance learning, through an open, massive and flexible course (MOOC), in order to creating new spaces of subjectivation of young people and weaving networks of meaning, sharing the same paths and promoting educational alliances with a view to greater accessibility to training.Riassunto Il presente lavoro ha l’obiettivo di focalizzare l’attenzione sulla condizione dei NEET in relazione al genere. Gli ultimi dati nazionali e internazionali confermano, infatti, che l’essere donna è un fattore predittivo della condizione di esclusione sociale e lavorativa. Le ragazze rispetto ai coetanei maschi sono maggiormente marginalizzate; condizione che si è acutizzata durante la pandemia da Covid-19. Interrogarsi e approfondire queste forme di esclusione assume quindi carattere di urgenza anche per tutti coloro che si occupano di educazione e inclusione sociale. In particolare, l’articolo esplora la relazione esistente tra NEET e genere e le prospettive educativo/ pedagogiche utili a ri-orientare spazi di apprendimento e formazione, in grado di valorizzare una pedagogia della differenza. La proposta che viene promossa nel lavoro è quella di un percorso di apprendimento a distanza, attraverso un corso aperto, massivo, e flessibile (MOOC), con l’intenzione di creare nuovi spazi di soggettivazione dei giovani e intessere reti di senso, condividendo medesimi percorsi e promuovendo alleanze educative nell’ottica di una maggiore accessibilità alla formazione

    The contribution shows how the platform economy is today an infrastructure for migrant labour and for a pool of potential workers predatorily included in a labour market free from the formal constraints of employment. The inclusion of this mass of labour takes place under the sign of the adverse incorporation, highlighted empirically from two different case studies: Uber drivers in Argentina and delivery riders in Italy. In the same (formal and informal) rules of engagement of the gig-economy, therefore, a dynamic of labour entrapment emerges, to the point of determining a sort of parallel labour market characterised by the indeterminacy of employment, in which both the vulnerabilities of individuals and the flows of global migrations characterising this labour force are brought to the fore. In both case studies, the fieldwork has uncovered forms of digital caporalato and exploitation that predominantly affect the migrant component of the workforce, and which empirically delineate what several authors have termed a process of refeudalisation of labour.Keywords:Gig-economy; Digital “caporalato”; Migrant Labour; Refeudalisation

    In France, the Orientation et Réussite des Étudiants (ORE) law, inclued Parcoursup, has generalised a form of selection, not always assumed, at the entrance to all higher education. To evaluate applications, the Fiche avenir encourages higher education courses to take into account the skills acquired by students outside the classroom. In return, students are invited to highlight their commitments, their extra-curricular activities and any other personal experience they deem relevant.     In this paper social innovation is analyzed as an “epistemological episode” related to the bureaucratic evolution of the Third Sector and anchored to disciplinary knowledge such as Urban Studies and the organizational analysis of social movements too. The authors aim to examine the contradictions of socially sustainable and innovative reforms in relation to the production of “capability technologies” to the advantage of territorialized organizations, increasingly oriented towards the provision of complex services and a state of tension towards improvement.
