    The Defence of Mental Disorder: A Divergence in the Application of R v Oommen Among Canadian Courts and the Need for Reform

    The law recognizes through section 16 of the Criminal Code that, in exceptional circumstances, a person may be incapable of possessing the knowledge or intent of wrongdoing necessary to ground criminal liability by reason of mental disorder. For three decades, the Supreme Court of Canada’s decision in R v Oommen has been the leading case on when the section 16 defence applies, such that an accused may be deemed not criminally responsible on account of mental disorder. This article examines a recently emerging divide in the application of section 16 and Oommen among Canadian courts that narrows the class of accuseds who may succeed in raising the defence. It will first summarize the elements of the defence and the principles enunciated by the Supreme Court of Canada in Oommen, and the historical foundations that informed the decision. This article will then analyze the shift towards a more narrow application of section 16 and Oommen, and explain the fault in this approach in light of the history and purpose of the defence. Finally, this article will propose a law reform that would protect the public, recognize the humanity of those living with mental illness, and resolve the current confusion as to what it means to possess knowledge of wrongdoing

    The growing interest in non-human animals is driven by advancements in biotechnology and an increased awareness of the importance of preserving biodiversity. This fascination with non-human creatures dates back far in history. Exploring the representation and interpretation of the animal world throughout different epochs helps us better understand our relationship with other forms of life and appreciate the richness of works celebrating the animal kingdom. Animal motifs, laden with symbolic meanings, provide a complex field of study where recurring patterns are less evident. This volume explores these relevant recurrences and identifies the narrative patterns that shape these animal representations, enabling a deeper understanding of the relationship between humans and animals.L’intérêt croissant pour les animaux non humains est stimulé par les avancées de la biotechnologie et une conscience accrue de la nécessité de préserver la biodiversité ; cependant cette fascination pour les créatures non humaines remonte à loin. Explorer la représentation et l’interprétation du monde animal à travers les époques permet de mieux comprendre notre relation avec les autres formes de vie et d’apprécier la richesse des œuvres célébrant le règne animal. Les motifs animaux, chargés de significations symboliques, offrent un terrain d’étude complexe où les schémas récurrents sont moins évidents. Ce volume explore ces récurrences pertinentes et identifie les schémas narratifs qui façonnent ces représentations animales, permettant non seulement une meilleure compréhension des textes narratifs, mais aussi de la relation entre les humains et les animaux

    The two poems presented here were both written with gratitude for the freedom of expression I enjoy in Canada. “How To Know I Am A Human” is from my new manuscript, A Life Between The Brackets, which addresses several themes and topics I stay close to, including the natural world, climate events such as wildfires and hurricanes, and local and global politics. “The Erosion Of Borders” is from my 2022 collection, A Matter Of Inclusion, which investigates the decisions people make to leave their homelands to begin new lives in Canada. It is my most overtly political work to date

    Of Being Stuck or Moving On: Border Temporalities Along the EU’s External Border in the Western Balkans

    This article focuses on two temporal dimensions of borders in an entangled perspective: first, the temporal dimension according to which borders may establish a temporal taxonomy by marking those living across the border as being more or less advanced or backward, and second, borders in the function of channelling mobility, accelerating or slowing down movements, or even bringing them to a standstill. Referring to social anthropological case studies at the EU external border between Bosnia-Herzegovina and Croatia, this article shows the entanglements of the different border temporalities and their impacts on migrants’ and locals’ self-perceptions. It argues that it is not only migrants from the Global South who dwell in a liminal time-space due to the increasing fortification of the border, but also that parts of the native population feel stuck due to the impossibility of imagining a future and of moving forward in life in their home region. This is reinforced by the movements of others leaving or transiting the region, a situation that has become symptomatic for the Western Balkans.     Franco–Italian Mont Blanc Dispute and Climate Change: Policy Perspectives after the Quirinal Treaty

    This policy report focuses on the border dispute between France and Italy over Mont Blanc in the context of climate change, examining the causes of the disagreement between the two countries and the effects of glacier melting on borders among Alpine countries. Adopting the approach of territorial singularities and mobile borders, the work analyzes the impact of initiatives such as the ETRS89 framework, which ensures GPS-validated mapping technologies in Europe, allowing measurements of border shifts. Insight is given to practices and agreements adopted by Italy, Switzerland, and Austria, such as two bilateral treaties incorporating mobile borders. Starting with a review of the current perspectives of cross-border cooperation between France and Italy after the recent Quirinal Treaty, the report suggests some steps that could be taken to strengthen synergies and mitigate the effects of the dispute: remapping the area, monitoring border shifts, and applying a shared regulation of access and off-limits areas across the entire Mont Blanc
