Il codice del consumo (tra diritto interno e diritto europeo)\ud
The consumer code (between domestic and european right).\ud
This thesys is contains in four chapters concerning the different matters following the consumer code ( d.lg. n. 206/2005).\ud
Object of the research is the importance of the above mentioned measure, which is included in the named “sector codes”, in the Italian system and which puts the interpreter on the matter of settle the relation criterion between the special rulement, that the code provides, and the general rulement contents of the Civil Code.\ud
For this purpose this work agrees will the doctrine influential leaning, which suggests as ermeneutical methodology an axiologic and systematic interpretation of the whole rulement and according that outline, in virtue of the principles and values expressed by the Constitution\ud
and the European Treaties, the “consumer” in the first place a “person” and a “citizen”.\ud
That's why the research purpose is to evaluate if, and how, it could be possible to extend the operating of the rulement settled for the consumer care beyond the subjective borders established on the Comunitary Law, first, and on the domestic law, after, and at this purpose it has been studied deeper the rulement about the “category” regarding consumer contracts and company contracts. It results a rulement outline that allows to reject the theory of the named third contract and to affirm the possibility that the specifc consumer rules could be certainly enforced on company contracts, and vice versa: important is the protection demand of the “weak contractor” expressed by the concrete case and the peculiarity of the contractual operation concretely realized.\ud
In the thesys, moreover, has been analized the task carried out by the consumer right in the sphere of the process of building the European contractual right and, studying deeply the several initiatives by the European Comunity and by the doctrine trying to determinate the best harmonization of the rulement settled for the consumer protection, it has been proposed a view of the in forze law by the light of the principles of proportionality, reasonablity and adequaty.\ud

La tesi si propone di analizzare le differenti problematiche che presenta il codice del consumo, introdotto nell'ordinamento italiano con il d.lg. 6 settembre 2005, n. 206, assumendo come fondamentale\ud
chiave di lettura i princípi ed i valori espressi nella Costituzione italiana, nonche' quelli che hanno trovato affermazione nei Trattati comunitari.\ud
Oggetto specifico dell’indagine e' la valenza di questo\ud
provvedimento che viene a collocarsi tra i c.dd. «codici di settore», sollevando cosi' l'interrogativo sulla sua configurabilita' quale possibile manifestazione di quel piu' ampio fenomeno normativo riassunto nella formula «decodificazione», ovvero quale espressione\ud
di un processo di «ricodificazione».\ud
Ma al di la' di queste due impostazioni, nella ricerca svolta si intende analizzare il codice del consumo considerandolo come un complesso normativo che, superando la frammentarieta' della disciplina vigente in materia di tutela del consumatore, offre all'interprete uno scenario ermeneutico «nuovo» rispetto al passato, non tanto con riferimento al contenuto delle singole norme, quanto\ud
con riguardo alla possibilita' di avere delle stesse una diversa visione, organica e sistematica.\ud
Cosi', si procede ad un eseme delle varie disposizioni in esso contenute, assumendo come baricentro di ogni procedimento ermeneutico la Costituzione, nella convinzione che la «complessita'» del sistema puo' essere compresa soltanto se si riconosce il fondamento unitario dello stesso. Ed in questa prospettiva, l'obiettivo\ud
perseguito e' quello di verificare se, ed in quale modo, le disposizioni predisposte a tutela del consumatore rispondano alla necessita', costituzionalmente garantita, di tutelare i diritti della persona. Tutto cio' nella consapevolezza che il «consumatore» e' prima di tutto\ud
«persona» e «cittadino».\ud
In questa ottica, s'impone come necessario un approfondimento del significato che in questo contesto viene ad assumere il termine «codice» impiegato dal legislatore del 2005.\ud
Sono in modo specifico evidenziate le differenze con il codice civile del 1942 e le diverse esigenze di tutela alla base dei due provvedimento: il codice civile contraddistinto dall'«unicita'» del soggetto preso in considerazione e della «parita'» delle parti contraenti; il codice del consumo contenente, invece, la disciplina di\ud
numerosi rapporti contrattuali, i quali si caratterizzano per la presenza di un contraente che occupa una posizione di «debolezza» nei confronti della sua controparte, con la conseguenza che la finalita' perseguita da quest'ultima normativa appare essere quella di rispristinare una condizione di equilibrio fra le parti contraenti.\ud
Vengono, quindi, analizzate la struttura ed il contenuto del\ud
codice del consumo evidenziando in modo specifico gli «eccessi», le «lacune» e le «sviste» del provvedimento, il quale in varie occasioni si e' presentato come un «cantiere aperto». Diversi sono stati, infatti, gli interventi del legislatore con i quali progressivamente hanno fatto ingresso nel codice del consumo nuove discipline adottate in materia di tutela del consumatore dopo il 2005 – come ad esempio la normativa in tema di commercializzazione a distanza di servizi finanziari (art. 67-bis – 67-vicies bis, inseriti con il d.lg. 23 ottobre\ud
2007, n. 221) e la disciplina dell'azione collettiva risarcitoria (art. 140-bis, introdotto dall'art. 2, comma 446, l. 24 dicembre 2007, n. 244 -legge finanziaria 2008-), rispetto alle quali si pongono, pero', non pochi problemi di coordinamento.\ud
Altro profilo meritevole di un'accurata indagine e' quello\ud
inerente il rapporto tra la disciplina del contratto stabilita nel codice del consumo e quella prevista dal codice civile. Qui, piu' in particolare, occorre precisare il significato delle «norme di coordinamento» di cui agli artt. 38 e 142 c. cons., nonché dell'all'art. 135 c. cons., i quali indicano come criterio per l'individuazione della\ud
normativa applicabile quello della «disposizione piu' favorevole» per il consumatore. E nel ricercare un contenuto a questa previsione, la soluzione che appare preferibile e' quella che assegna un'importanza\ud
minimale alla collocazione delle varie disposizioni nell'uno o nell'altro codice, mentre va attribuita fondamentale rilevanza al rapporto in cui le singole norme, funzionalmente considerate, si pongono rispetto ai «princípi fondamentali» dell'ordinamento.\ud
Questa impostazione mira a ricostruire il sistema in termini\ud
unitari e richiede che venga svolta un'interpretazione delle varie norme che non sia semplicemente letterale, ma sistematica ed assiologica, nonche' sopportata da criteri di valutazione che tengano anche conto della specificita' del caso concreto, ossia degli interessi di «quel» singolo consumatore protagonista di «quel» particolare rapporto di consumo, e degli interessi contrapposti in «quella»\ud
determinata fattispecie, nonche' dell'impatto che su di esso produce «quella» determinata norma.\ud
In questa analisi della normativa italiana non si puo', poi,\ud
prescindere da un richiamo alle esperienze maturate in altri\ud
ordinamenti europei ed, in particolare, alle diverse modalita' di recepimento delle direttive in materia di tutela del consumatore nell'ordinamento tedesco, francese e spagnolo. Il riferimento e', piu' specificamente, alla legge tedesca di modernizzazione del diritto delle\ud
obbligazioni (Gesetz zur Modernisierung des Schuldrechts), entrata in vigore il 1° gennaio 2002, che ha provveduto ad inserire nel codice civile tedesco le varie discipline relative alla tutela del consumatore; al code de la consommation francese di cui alla legge 18 gennaio\ud
1992, n. 92-60, la cui rilevanza quale autonoma fonte dei diritti dei consumatori trova conferma nel fatto che il recente Avant project di riforma delle disposizioni in materia di obbligazioni non prevede un trasferimento della disciplina in esso contenuta nel code civil; ed al Real Decreto Legislativo spagnolo del 16 novembre 2007, n. 1, che ha ricomposto in un texto refundido la disciplina contenuta nella Ley General para la Defensa de los Consumidores y Usuarios (legge 19 luglio 1984, n. 26) ed in altre leggi speciali. Rispetto a quest'ultimo, in particolare, e' possibile mettere in luce molteplici somiglianze con il codice del consumo italiano: come evidenziato, infatti, dalla dottrina spagnola, in esso accanto all'introduzione di rilevanti novita' e'\ud
possibile riscontrare dei profili di incompletezza e disorganicita'.\ud
Una volta delineato questo complesso quadro normativo, la\ud
tesi si propone di valutare se, ed in quale modo, sia possibile estendere l’operativita' delle disposizioni prediposte a tutela del consumatore oltre i limiti soggettivi indicati dal legislatore comunitario, prima, e quello nazionale, poi.\ud
Punto di partenza e' la nozione normativa di consumatore di\ud
cui all'art. 3, comma 1, lett. a, c. cons., che nell'attribuire espressamente tale qualifica soltanto alla «persona fisica» che agisce per «scopi estranei» all'esercizio dell'attivita' professionale eventualmente svolta, lascia ancóra aperta la questione se la tutela\ud
possa estendersi anche agli enti o alle persone giuridiche, e se possa considerarsi consumatore anche il contraente che persegue il soddisfacimento di esigenze di carattere sia privato che professionale.\ud
A questo scopo sono esaminate le decisioni della giurisprudenza comunitaria e di quella di legittimita' italiana che si occupano di questa problematica e sono presi in considerazione i vari provvedimenti comunitari che trattano tale tematica.\ud
Vengono, quindi, approfonditi i «nuovi profili» del contratto che la normativa consumeristica ha introdotto e sono richiamate quelle impostazioni dottrinali che configurano la «categoria» dei «contratti dei consumatori» in contrapposizione a quella dei «contratti d’impresa». In questo modo emerge un sistema di discipline le quali risultano, ciascuna con le proprie specificita', volte\ud
a garantire tutela al c.d. «contraente debole» ed e' proprio muovendo da tale finalita' che si ritiene possibile respingere, perché priva di fondamento, quella teoria che per offrire protezione ai soggetti deboli coinvolti in quelle fattispecie che non rientrano nell'una o nell'altra\ud
categoria, costruisce la figura del c.d. «terzo contratto».\ud
Un'interpretazione sistematica ed assiologica delle varie\ud
normative ci porta a riconoscere la vis espansiva delle differenti discipline, con la conseguenza che le norme proprie del diritto dei consumatori possono ben venire applicate ai contratti d'impresa, e viceversa: cio' che rileva, infatti, sono le esigenze di tutela del\ud
«contraente debole» espresse dalla fattispecie concreta e le\ud
caratteristiche dell’operazione contrattuale concretamente realizzata.\ud
Viene, pertanto, fatta propria quell'impostazione, autorevolmente prospettata, secondo cui l'intepretazione e la qualificazione di un fatto vanno considerati come un procedimento unitario volto all'individuazione della disciplina che «l'ordinamento globalmente considerato da' all'esigenza di tutela che il fatto manifesta, esigenza\ud
portatrice di una sua specifica irripetibilita'».\ud
Tutte queste considerazioni consentono di ricondurre le\ud
problematiche inerenti l'àmbito di operativita' della disciplina dei contratti dei consumatori all'interno del sistema e di considerare il presupposto soggettivo individuato dal legislatore non un limite all'applicazione della stessa. Cosi', si puo' affermare che laddove si\ud
riscontri la medesima esigenza di tutela che anima questa normativa, non sussistono impedimenti all'estensione degli strumenti di protezione in essa previsti anche ai contratti stipulati fra soggetti che non sono consumatori.\ud
Nella tesi viene, inoltre, analizzato il ruolo svolto dal diritto dei consumatori all'interno del dibattito che, oramai da tempo, si e' sviluppato intorno al processo di costruzione del «diritto contrattuale europeo». Si presenta in questo modo un piu' ampio orizzonte ermeneutico e la complessita' di questa indagine viene in evidenza se\ud
si considera che l'obiettivo dell'«armonizzazione» del diritto dei vari Stati membri ha formato oggetto dell’opera legislativa posta in essere dalle varie istituzioni comunitarie, e, nel contempo, rappresenta il risultato dell'attivita' di studio e di approfondimento compiuta dalla\ud
scienza giuridica.\ud
In questo settore molteplici sono le iniziative promesse a\ud
livello europeo e volte a realizzare il «ravvicinamento delle legislazioni», che rappresenta una delle finalita' della politica comunitaria individuata dall'art. 95 del Trattato dell'Unione europea.\ud
Piu' specificamente, peculiare attenzione va riservata al progetto di elaborazione del Common Frame of Reference, ossia di un complesso normativo che stabilisca i princípi ed una terminologia comune nel campo del diritto contrattuale, il quale viene anche descritto come\ud
strumento al quale il legislatore comunitario potra' ricorrere al fine di realizzare una semplificazione ed un miglioramento dell’acquis comunitario, in conformita' con l’obiettivo di assicurare l’elevata qualita' della normativa.\ud
Tutto questo trova un riscontro nel Libro verde pubblicato\ud
dalla Commissione europea l’8 febbraio 2007, dedicato alla revisione dell’acquis relativo ai consumatori ed avente ad oggetto otto direttive emanate in questa materia (la n. 577 del 1985, sui contratti conclusi fuori dei locali commerciali; la n. 314 del 1990, sui pacchetti turistici;\ud
la n. 13 del 1993, sulle clausole abusive; la n. 47 del 1994, sulla multiproprieta', la n. 7 del 1997 sui contratti a distanza; la n. 6 del 1998, sull’indicazione dei prezzi dei prodotti offerti ai consumatori; la n. 27 del 1998, sulle ingiunzioni per la protezione degli interessi dei\ud
consumatori; la n. 44 del 1999, su alcuni aspetti della vendita di beni di consumo e sulle garanzie relative). Scopo del riesame e' quello di raggiungere un «giusto equilibrio tra un elevato livello di tutela dei\ud
consumatori e la competitivita' delle imprese» e, a tal fine, le principali questioni individuate dalla Commissione sono: la necessita' di adeguare la disciplina esistente ai «nuovi sviluppi del mercato», tenendo conto in particolare delle problematiche sollevate dalla ruolo\ud
crescente della tecnologia digitale e dei servizi digitali; la «frammentazione delle regole» e la «diversita'» della normative nazionali di recipimento delle direttive europee. In particolare si ritiene che quest'ultima rende possibile l’introduzione di diversi livelli di protezione nei singoli Stati membri (anche più elevati di quelli previsti dalle stesse Direttive) e che sia la causa della «mancanza di fiducia» dei consumatori nella possibilita' di effettuare\ud
acquisti oltre frontiera. La Commissione si mostra, pertanto, consapevole del fatto che il ricorso, fin qui operato dal legislatore comunitario, ad una normazione settoriale non sia piu' idoneo a realizzare le condizioni di mercato unico, non riuscendo a garantire un trattamento uniforme a fattispecie identiche o che comunque presentano aspetti analoghi.\ud
Accanto a questo viene, poi, individuato quale altro difetto\ud
della normativa comunitaria adottata attraverso lo strumento delle direttive quello di avere perseguito una «armonizzazione minima», che consente ai legislatori nazionali di contenere l’impatto della legislazione comunitaria nei propri ordinamenti. Cosi', obiettivo del\ud
Libro verde non e' soltanto quello di realizzare una riduzione ad unita' di concetti, definizioni e regole, ma anche quello di operare in àmbito contrattuale un passaggio dalla armonizzazione minima all’«armonizzazione massima».\ud
E' proprio muovendo da questa prospettiva che si considera\ud
che la revisione dell’acquis possa contribuire notevolmente ad accelerare il processo di armonizzazione del diritto contrattuale europeo. Ed in particolare, l’importanza del ruolo svolto dal diritto dei consumatori nel costruzione del Common Frame of Reference emerge nella «Seconda relazione sulla stato di avanzamento relativo al quadro comune di riferimento» del 25 luglio 2007. Qui la Commissione chiarisce che finalita' del Common Frame of Reference e' quella di essere «uno strumento propizio ad una migliore regolamentazione», riconoscendo che cio' rappresenta «un esercizio a lungo termine che intende garantire la coerenza e la buona qualita' della legislazione comunitaria nel settore del diritto dei contratti».\ud
Esso si considera, inoltre, volto a «definire chiaramente i termini giuridici, i principi fondamentali e le norme moderne e coerenti del diritto dei contratti per la revisione della legislazione settoriale esistente e per la preparazione di nuovi testi, nel caso fosse necessario»; ma viene espressamente specificato che «non e' destinato a garantire un’armonizzazione su vasta scala del diritto\ud
privato o a trasformarsi in un codice civile europeo». Cosi', le ambizioni iniziali della Commissione risultano chiaramente ridimensionate e questo troverebbe spiegazione nella presa di coscienza dell’opportunita' di indirizzare i lavori di realizzazione del Common Frame of Reference verso finalita' piu' immediate e facilmente perseguibili, tenuto conto anche che, come evidenziato nei vari documenti, e' la scarsa chiarezza in ordine ai contenuti ed alle forme di elaborazione del Common Frame of Reference la ragione\ud
che ha spinto le istituzioni comunitarie a concentrare la propria attenzione esclusivamente verso la revisione dell’acquis in materia di tutela del consumatore. Va, invece, registrato un diverso atteggiamento del Parlamento europeo il quale nella Risoluzione del 12 dicembre 2007 sul diritto contrattuale europeo, sottolinea espressamente «la sua convinzione che un approccio orientato verso una migliore regolamentazione in materia di Common Frame of\ud
Reference significhi che quest’ultimo non puo' essere limitato esclusivamente a questioni relative al diritto contrattuale dei consumatori, ma deve focalizzarsi su questioni di diritto contrattuale generale».\ud
L'attualita' e l'importanza della tematica emerge anche nei\ud
recentissimi documenti elaborati sia dagli studiosi civilisti europei che dalle istituzioni comunitarie. Ed il riferimento e' al Draft of Common Frame of Reference, del 29 dicembre 2007, elaborato dal Study Group on European Contract Law, dall’Acquis Group e dall’Insurance Groupe, e alla Proposta di direttiva del Parlamento e del Consiglio sui diritti dei consumatori dell'8 ottobre 2008, che,\ud
relativamente a quattro direttive (la n. 577 del 1985, la n. 13 del 1993, la n. 7 del 1997 e la n. 44 del 1999), propone l'adozione di un unico strumento orizzontale che disciplini gli aspetti comuni della normativa in modo sistematico, semplificando ed aggiornando le norme esistenti, risolvendo le incoerenze e colmando le lacune.\ud
L'approccio prescelto e' quello dell’armonizzazione completa come risulta dalla espressa previsione secondo cui «Gli Stati membri non possono mantenere o adottare nel loro diritto nazionale disposizioni divergenti da quelle stabilite dalla presente direttiva, incluse le disposizioni piu' o meno severe per garantire al consumatore un\ud
livello di tutela diverso» (art. 4 della Proposta).\ud
E' all'interno di questo contesto che pertanto va analizzato la normativa relativa ai diritti dei consumatori ed appare evidente l'affermarsi della tendenza legislativa a spostare l'attenzione dal soggetto-contraente all'atto di consumo. La disciplina di quest'ultimo sembra configurarsi quale nucleo essenziale del diritto contrattuale\ud
europeo e, nel processo di elaborazione di una normativa unitaria, si tratta di valutare quale sia, tra le diverse impostazioni prospettabili, quella che appare maggiormente rispondente ai princípi di proporzionalita', adeguatezza e razionalita'.\ud

Ecology and management of grassland in Umbria-Marches Apennine (central Italy)
The grasslands, like the majority of the terrestrial systems, are complex ecosystems and such complexity comes from the high number of biotic and abiotic elements which form this systems and from the interactions between the same elements, which could vary in time and space their nature and intensity.\ud
Keeping attention to this complexity and knowing that there is an equilibrium state in which the plant community has the maximum possible number of species, for a certain\ud
soil-climate context, this research work is centred on the description of the components of the grassland ecosystem, of the relations which exist between them and on the possible way of management, to achieve improvements in the future, in terms of productivity of phytocoenosis, of\ud
soil defending, of biodiversity conservation and also in terms of improving the life conditions of human population. In particular, the main target of this phD was to create an exhaustive knowledge structure about Apennines grasslands, because until now, all the studies made were partial, tending to characterize the herbaceous communities from a\ud
phytosociological viewpoint, but not ecological-functional.\ud
Moreover, considering the size of the study area and the complexity of the research and of the management of grassland ecosystems, we thought to share the research work in the three years, the timing and the operations.\ud
In fact, the research plan was structured like a “pyramid” at the base of which there is the phytosociological research which is the support to all the other studies, while regarding on the timing we decided to concentrate each year in a bioclimatic belt, following this scheme:\ud

Design, Synthesis, Characterization and Biological activity of ligands for P2 Receptors
Purines and pyrimidines nucleosides and nucleotides are molecules involved in diverse physiological and pathophysiological processes through the activation of cell membrane receptors called purinergic receptors. The nucleotide adenosine 5’-triphosphate (ATP) is abundant inside cells, where it provides the energy for many biological reactions, while in the extracellular space, although present in much lower amount, it modulates important physiological functions through the interaction with purinergic P2 receptors, classified as:\ud
ionotropic P2X receptors, which represent a class of ligand-gated ion channels and metabotropic P2Y receptors, which belong to the superfamily of heterotrimeric G-protein\ud
coupled receptors. The physiological functions modulated by P2 receptors include neurotransmission, muscle contractility, neural and endocrine secretion, immune cell\ud
regulation or cell proliferation. At sensory nerve terminals in the periphery, P2X3 and P2X2/3 receptors have been identified as the principal P2X purinoceptors present. Among P2X receptors, the P2X3 subtype has showed ability to mediate pain sensation and there is strong evidence for a role of this subtype in neuropathic and chronic pain, in which plastic changes in the structure and function of P2X3 receptors are supposed to occur. Hence, the availability\ud
of new selective P2X3 ligands can provide novel analgesics for the treatment of neuropathic pain, often associated with currently incurable diseases including cancer and\ud
neurodegenerative disorders.\ud
Xanthine (e.g. caffeine) and adenine derivatives are known to be purinergic P1 receptor antagonists. Since the phosphorylation of several xanthine derivatives led to the discovery of a new class of compounds, called “mini-nucleotides”, which showed high affinity at P2X\ud
receptors, a similar approach has been used on adenine analogues.\ud
In fact, the first part of this work has been focused on the design and characterization of novel P2 receptor ligands obtained through the phosphorylation of adenine derivatives bearing a hydroxybutyl chain in position 9. The choice of such substitution was due to the fact that the\ud
very flexible hydroxybutyl chain can mimic the nucleotide sugar portion of ATP and can maintain the same interaction with P2 receptors. Hence, a series of purine derivatives were synthesized by reacting selected purine analogues, substituted or not in 2-positions, with 4-bromobutyl acetate and K2CO3 in DMF, to give the desired purine derivatives containing a 4 carbon chain. Furthermore, different groups like halogens, alkynyl or aralkyl chains were introduced in 2-position by several reactions. Subsequent deprotection of the alkyl chain gave purine mini-nucleosides having a free hydroxyl group, which is essential for phosphorylation.\ud
The newly synthesized mini-nucleosides were phosphorylated to obtain the corresponding mono, di- and tri-phosphates. The new mini-nucleotides were tested to explore their potential agonist or antagonist activity on HEK cells expressing P2X3 receptors, in comparison with the full agonist ,-meATP by using patch clamp technique. These studies demonstrated that certain “mini-nucleotides” behave as agonists of P2X3 receptors, thus producing rapid channel activation and desensitization.\ud

A Formal Framework for Modeling, Simulating and Analyzing Networks of Excitable Cells
The main goal of this thesis was to investigate the use of HA as a unifying systems biology approach to model, simulate and analyze excitable cell networks in general and those of cardiac myocytes in particular. We propose a new biological framework based on the Lynch et al. theory of Hybrid I/O Automata (HIOA) for modeling and simulating excitable tissue. Within this framework, we view an excitable tissue as the composition of two main kinds of components: a diffusion medium and a collection of cells, both modeled as an HIOA. This approach yields a notion of decomposition that allows us to describe a tissue as the parallel composition of several interacting tissues,\ud
a property that could be exploited to parallelize, and hence improve, the efficiency of the simulation process. On the basis of HA theory, we have developed CellExcite, an efficient simulation environment for excitable-cell\ud
networks. CellExcite allows the user to sketch a tissue of excitable cells, plan the stimuli to be applied during simulation, and customize the diffusion model. CellExcite adopts Hybrid I/O Automata (HIOA) as the computational\ud
model in order to efficiently capture both discrete and continuous excitable-cell behavior. We demonstrate the feasibility of our HIOA-based framework to capture and mimic different kinds of wave-propagation behavior in 2D isotropic cardiac tissue, including normal wave propagation along the tissue; the creation of spiral waves; the break-up of spiral waves into more complex patterns such as fibrillation; and the recovery of the tissue to the resting state via electrical defibrillation. We address also the problem of specifying and detecting emergent behavior in networks of cardiac myocytes, spiral electric waves in particular, a precursor to atrial and ventricular fibrillation.\ud
To solve this problem we: (1) Apply discrete mode-abstraction to the cycle-linear hybrid automata (CLHA) we have recently developed for modeling the behavior of myocyte networks; (2) Introduce the new concept of\ud
spatial-superposition of CLHA modes; (3) Develop a new spatial logic, based on spatial-superposition, for specifying emergent behavior; (4) Devise a new method for learning the formulae of this logic from the spatial patterns under investigation; and (5) Apply bounded model checking to detect (within milliseconds) the onset of spiral waves. We have implemented our methodology as the Emerald tool-suite, a component of our EHA framework for specification, simulation, analysis and control of excitable hybrid automata. We illustrate the effectiveness of our approach by applying Emerald to the scalar electrical fields produced by our CellExcite simulator. Furthermore, we focus our attention on understanding of the synchronized collective behavior that is essential in the networks of pacemaker cells in the heart and could be useful for developing methods to control the dynamics of systems with desired properties. For this purpose we define a subclass of timed automata, called oscillator timed automata, suitable to model biological coupled oscillators.\ud

Diabetes and DNA damage: an in vitro model\ud
As estimated by WHO, there are in the world about 1.1 billion overweight subjects, with a rapid increase in prevalence. Excess body weight is an important risk factor for the development of many chronic degenerative diseases such as Type II diabetes and the "metabolic syndrome" (Metabolic Syndrome, Mets).\ud
Whether people suffering from diabetes that those with Mets have a morbid condition characterized by hyperglycemia associated with hyperinsulinemia, hypertension and dyslipidemia.\ud
Recently, it has been suggested that high blood glucose concentrations can cause an increase in intracellular production of free radicals which is known to be capable of inducing damage to DNA in cells. More recently it has also been suggested that high concentrations of glucose are able to increase the susceptibility of DNA to genotoxic effects of xenobiotic.\ud
The aim of this work was to verify the hypothesis that high concentrations of glucose added to the medium of hepatoma human cells (HepG2) are able to change the susceptibility to the same genotoxic compounds and investigate if antioxidant could restore normal homeostasis.\ud
To this end, HepG2 cells were cultured for 24 hours (37 °C, 5% CO2) in the presence of scalar glucose concentrations (1; 2,5; 5 and 10 g/l) and then treated for 4 hours with 4-nitroquinoline N-oxide (4NQO) in presence and absence of Trolox®. The extent of damage to DNA was evaluated using comet test in alkaline conditions.\ud
The results showed that treatment with high concentrations of glucose did not alter the levels of primary DNA damage, while the co-exposure with 4NQO increase levels of damage depending on the concentration of glucose. \ud
The results obtained in this preliminary approach suggest that the condition of hyperglycemia favors an increased susceptibility of DNA to genotoxic insults and the used oxidant inhibitors suppress, even not completely, the intracellular generation of reactive oxygen species induced by high glucose.\u
Sugar-modified nucleosides: synthesis, conformational analysis and biological evaluation\ud

Considerable progress has been made in the search for novel nucleoside structures with anticancer and/or antiviral activity by modifications in the nucleobase and/or in the sugar moiety and several branched-chain sugar nucleosides have shown potent antitumor activity. These agents behave as antimetabolites that interact with a number of intracellular targets\ud
blocking the DNA chain elongation or interfering with biosynthesis of nucleosides and nucleotides, a limiting process in cell proliferation. Many of the enzymes involved in these pathways are highly active in cancer cells, such as ribonucleotide reductase (RNR). RNR is a multisubunit radical-containing enzyme involved in the conversion of\ud
ribonucleoside diphosphates to the corresponding 2'-deoxyribonucleotides, which are building blocks for DNA replication and repair. Increased RNR activity has been\ud
associated with malignant transformation and tumor cell growth; it is therefore an excellent target for cancer chemotherapy. In recent years, several nucleoside RNR\ud
inhibitors have entered clinical trial or application such as arabinosylcytosine (ara-C), gemcitabine, cladribine, fludarabine and clofarabine.\ud
A previous structure-activity relationship study reported by us, identified the 3'-C-methyladenosine (3'-Me-Ado) as a mechanism-based RNR inhibitor endowed with a significant antitumor activity against a panel of human leukemia and carcinoma cell lines.\ud
To further investigate the structural determinants of 3'-Me-Ado required for the antitumor activity, in the first part of my PhD project, a number of 3'-C-methyl ribonucleosides with different purinic and pyrimidinic nucleobases and the 3'-C-methyl derivatives of the antitumor agents 5-fluorouridine and 9-( β-D-arabinofuranosyl)- adenine were synthesized and evaluated on human tumor cell lines.\ud
The biological results showed that the structure of 3'-Me-Ado is crucial for the antitumor activity of this type of ribose-modified nucleosides.\ud
A further structure-activity relationship study of synthesized adenine 3'-C-methylribonucleosides containing different substituent at N6-amino group of nucleobase such\ud
as a cycloalkyl, aryl or heteroaryl group confirmed that any modification in the structure of 3'-Me-Ado is detrimental for the antitumor activity.\ud
The obtained results have been rationalized by docking studies utilizing the X-ray structure of the subunit Rnr1 of the RNR from Saccharomyces cerevisiae complexed with ADP.\ud
The ribose recognition domain of adenosine derivatives appears to be of considerable importance not only for cytotoxic activity, but also for agonistic activity at adenosine receptors (ARs).\ud
The physiological agonist adenosine modulates a variety of functions through four receptor subtypes classified as A1, A2A, A2B and A3. A1 adenosine receptors (A1 ARs) are expressed in high density in the brain, in adipose tissue and in medium to low levels in many peripheral organ and tissues such as heart, lung and kidney. Thus, A1 agonists\ud
have many therapeutic potentials; however the clinical application of A1 full agonists is hampered by several side effects. In this respect, it has been reported that A1 partial agonist may be therapeutically advantageous.\ud
Among the adenosine derivatives, some 5'-chloro-5'-deoxy-N6-cycloalkyl(bicycloalkyl)- analogues were found A1 agonists with high affinity and selectivity for rat A1 AR or partial agonists for this AR subtype.\ud
In the search for potent and selective A1 AR agonists we have previously investigated a series of 2'-C-methylribofuranosyl analogues of selective A1 AR agonists and 2-chloro- 2'-C-methyl-N6-cyclopentyl-adenosine (2'-Me-CCPA) emerged as a potent and highly selective full agonist at rat, bovine and human A1 vs A2A, A2B and A3 ARs.\ud
On the base of these findings, in the second part of my work, a series of 5'-substituted derivatives of potent and selective A1 AR agonists were synthesized and tested for\ud
affinity and selectivity at different model of adenosine receptor subtypes.\ud
In particular, a series of 5'-carbamoyl or 5'-thionocarbamoyl derivatives of 2'-Me-CPA, 2'-Me-CCPA, N6-[(R)-3-tetrahydrofuranyl]adenosine and 2-chloro analogue were synthesized and evaluated for binding affinity at ARs from bovine, porcine and human species.\ud
Moreover, a series of 5'-chloro-5'-deoxy-N6-cycloalkyl(bicycloalkyl)-substituted adenosine and 2'-C-methyladenosine derivatives and 2-chloro analogues were\ud
synthesized and evaluated for affinity and efficacy at all cloned human AR subtypes.\ud
In this study, two adenosine derivatives displayed the highest affinity in the subnanomolar range and relevant selectivity for hA1 vs the other human receptor\ud
subtypes. This result was rationalized by a molecular modeling analysis
1,4-Dioxane Nucleus as a Suitable Scaffold for the Characterization of Different Receptor Systems\ud
One of the strategies, which can lead to the discovery of novel biologically active compounds and over the last 20 years has emerged as a fruitful approach, is the identification and use of molecular scaffolds with versatile binding properties. For such structures, bearing appropriate molecular decoration and, therefore, able to\ud
recognize with high affinity more unrelated targets, the term “privileged structure” has been proposed.\ud
In this study it has been demonstrated that the properly substituted 1,4-dioxane nucleus has proven to be a suitable scaffold for:\ud
a) potent muscarinic receptor (mAChRs) agonists and antagonists;\ud
b) selective alpha2A-adrenoreceptor (alpha2A-ARs) antagonists;\ud
c) selective alpha1D-adrenoreceptor (alpha1D-ARs) antagonists;\ud
d) potent 5-HT1A serotoninergic receptor full agonists;\ud
e) potential anticancer agents.\ud
It is well known that the (1,3-dioxolan-4-yl)-N,N,N-trimethylmethanaminium iodide nucleus has been used for many years as a scaffold for its ability to give potent\ud
muscarinic agonists or antagonists, depending on the size of the substituent in position 2 (methyl or bulkier group, respectively). Inspired by this scaffold, I designed, prepared and studied at all five muscarinic receptor subtypes two series of 1,4-dioxane analogues substituted in positions 5 and 6 with methyl or bulkier groups to obtain agonists and antagonists, respectively.\ud
Concerning agonists the most interesting compound was the cis-trimethyl-(6-methyl-1,4-dioxan-2-ylmethyl)-ammonium iodide. Such a compound behaved as a full agonist at M1-M3 subtypes (pD2 = 5.65, 7.57, 7.34, respectively) and as a partial agonist at M4 subtype (pD2 = 5.87).\ud
As expected, the replacement of the methyl group in positions 5 or 6 of the agonist compounds with bulkier aryl or cycloalkyl rings modulated their muscarinic profile\ud
from agonists to antagonists. The most productive modification for affinity was the insertion of two phenyl groups in position 6, such a derivative proving to be a potent antagonist at all muscarinic receptor subtypes.\ud
The biological evaluation of the enantiomers of the most interesting both agonist or antagonist compounds demonstrated that the muscarinic effect was closely related to the stereochemistry of the ligands.\ud
It is well known that the benzodioxane nucleus bearing an appropriate substituent at position 2 can discriminate markedly among alpha-AR adrenoreceptor subtypes. In fact, WB 4101 and Idazoxan, both carrying a 1,4-benzodioxan-2-yl moiety as a basic feature but having a different 2-substituent [(2,6-dimethoxyphenoxy)ethylamine, or\ud
imidazoline] are highly selective for alpha1- and alpha2-ARs, respectively. A variety of their analogues have been studied involving a modification of the dehydrodioxane ring to develop high-affinity, site-selective ligands for each of the three alpha 1- and alpha2-AR subtypes (alpha1a/A, alpha1b/B,B alpha1d/D; alpha2A, alpha2B,B alpha2C). I have expanded on the structure-activity relationship study by investigating the possibility that the quite planar 1,4- benzodioxane privileged structure of WB 4101 and Idazoxan might be replaced by the less conformationally constrained 1,4-dioxane ring. The increased flexibility of 1,4-dioxane moiety might allow a better interaction with alpha-AR subtypes or favour the interaction with only one of them, leading hopefully to selectivity. Therefore, WB 4101- and Idazoxan-related derivatives obtained by inserting one or two phenyl groups in 5 or 6 position of 1,4-dioxane nucleus were designed and studied by binding and functional experiments.\ud
The pharmacological profiles of alpha2-AR antagonists related to Idazoxan were investigated using CHO cell lines stably expressing cDNAs encoding human alpha2A-, alpha2B-, and alpha2C-AR subtypes by cytosensor microphysiometer. Among the new compounds, only trans-2-(5-phenyl-1,4-dioxan-2-yl)-4,5-dihydro-1H-imidazole behaved as a competitive antagonist at alpha2A-AR subtype with a pKb value of 7.14\ud
similar to that of Idazoxan (pKb = 7.73). Interestingly, unlike Idazoxan, this compound was not active at alpha2B-, and alpha2C-AR subtypes. Therefore, for its particular alpha2A selective antagonism, this compound might be of interest for antinociceptive drug development, according to the observation that alpha2A-AR selective antagonists mightincrease the opioid analgesia.\ud
Concerning the alpha1-AR antagonists the replacement of the condensed benzene ring of WB 4101 with two phenyl rings inserted in position 6 of the 1,4-dioxane nucleus,\ud
along with the simultaneous removal of one methoxy group in the 2,6-dimethoxyphenoxy moiety, favoured alpha 1d subtype selectivity. In fact, the alpha1d affinity value (pKi = 8.94) was significantly higher than those for alpha1a and alpha1b subtypes (pKi =7.56 and 7.25, respectively).\ud
Moreover, the WB 4101-related derivatives were also evaluated on HeLa cells, expressing 5-HT1A serotoninergic receptor, since it is well known that this receptor\ud
exhibits a high degree of homology to alpha1-ARs. Among all the 5-phenyl, 6-phenyl and 5,5-diphenyl derivatives the presence of a 2-methoxy substituent in the 2-phenoxyethyl moiety was beneficial for high 5-HT1A affinity. When two phenyl rings were inserted in position 6, the methoxy-substitution in the 2-phenoxyethyl moiety did not seem to affect binding to the 5-HT1A receptor, all three derivatives\ud
(unsubstituted, 2-methoxy- and 2,6-dimethoxy-substituted) showing similar nM affinity values. Interestingly, the 6,6-diphenyl derivative bearing the 2,6- dimethoxyphenoxy moiety, examined in the [35S]GTP_S binding at the human cloned 5-HT1A receptor, was a potent full agonist with a pD2 value of 8.28. It also showed good selectivity for 5-HT1A towards the alpha1A-, alpha1B- and alpha1D-AR subtypes, representing a new lead in the design of potent full 5-HT1A agonists significantly selective over alpha1-ARs.\ud
Moreover, following our recent observation that alpha1D- and alpha1B-ARs are expressed in PC-3 prostate cancer cells and are involved in the modulation of apoptosis and cell proliferation, the cytotoxic effects of the new compounds on this cell line were determined. The 6,6-diphenyl derivative unsubstituted in the 2,6-dimethoxyphenoxy\ud
moiety exhibited the highest potency in inhibiting PC-3 cell growth and seemed to activate a mitochondrial-independent apoptotic pathway.\ud
In conclusion, the results obtained in my research proved the ability of the 1,4-dioxane nucleus to act as a versatile biological scaffold
