Valuation of conservation easements: What happens to surrounding property
This session will cover facts that conservation easements have added tremendous value to land preservation in the United States. We will discuss the taxable status of this property type, along with including a presentation of states who offer reductions in property taxes due to the conservation easements and that policies of taxable status vary widely among the states. We will discuss whether a conservation easement increases the subjects’ property value and conclude the session with a review of the effects of conservation easements on surrounding property values
Red flags in big box appraisals
Lowe\u27s Home Centers filed several lawsuits to appeal the assessed values for four separate owner-occupied stores in Sarasota County, Florida. The property owner\u27s appraisal reports included elements of the “dark store methodology, with support from a Big Box Transaction Analysis report for adjustments and analysis. While preparing for trial, assessor\u27s counsel and fee appraiser Shawn Wilson, MAI, identified several red flags in these big box appraisals. This presentation covers the process of researching and rebutting those red flag appraisal issues. The cases were set for trial in 2023 but settled in mediation
Protest & appeals: A defense of commercial values in non-disclosure states
The assessor is responsible for the proper annual valuation for each property. Following the law and defending valuations presents a unique challenge in non-disclosure states. Because sales prices play a large role in determining property value, assessment professionals in non-disclosure states are often at a disadvantage. The use of informal negotiations and settlements presents a first opportunity to set current and correct assessments
